CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS

That, this Contract or Lease, made and entered Into this Aor July, 2019, in w+atetY1 ,
Metro Manila, Philippines by and between :

MRS. PORFIRIA G. HENSON, legal age, widowed, Filipino Citizen and with residential
address at 1st zone Barangay San Antonio, Bacolor, Pamapanga, hereinafter referred to as
LESSOR.
AND

METRO VERSATILE BUILD-TECH represented by MS. JESSICA G. CAI, legal age, single,
Filipino Citizen and with residential address at 101, Simoun St. Sto. Domingo, Quezon City,
hereinafter referred to as the LESSEE;

WITNESSETH, THAT
WHEREAS, the LESSOR Is the owner of a furn ished two-storey house and furnishining
(hereinafter listed as Annex A) located at 1st Zone Barangay San Antonio, Bacolor, Pamapanga
hereinafter referred to as the (LEASED PREMISES).

WHEREAS, the LESSEE desires to lease the PREMISES, and the LESSOR is w illing to lease
the same unto the LESSEE, subject to the terms and conditions hereinafter specified;

NOW, THEREFORE, for and in consideration of the foregoing and mutual covenants
herein contained, the LESSOR has let and by these presents does hereby let and lease unto the
LESSEE the aforementioned LEASED PREMISES, and the LESSEE hereby accept the same by way
of lease, subject to the following terms and conditions :

1. LEASE PERIOD - This lease shall be for a period of SIX (6) MONTHS, beginning
July 10, 2019 until midnight of January 10, 2020. Any renewal of the Lease shall be subject to
a new agreement by the parties and an advance written notice of thirty (30) days by the LESSEE
before the expiration of the contract.

2. RENTAL - Pursuant to the escalation clause agreed upon by the parties, it is


hereby agreed that the monthly rental for the LEASED PREMISES shall be PESOS : Ten
Thousand (Pl0,000.00), Philippine Currency, EXCLUSIVE of the Maintenance Service Fee by the
Care taker amounting to Three Thousand (P3,000.00)

3. TERMS OF PAYMENT - Upon signing of this Contract of Lease, the LESSE shall give
unto the LESSOR the amount of SIXTY THOUSAND PESOS (60,000.00) as full advance payment
for the SIX (6) Months rent. The Maintenance Service Fee by the Caretaker will be given every
10th of the Month beginning August 10, 2019 until the expiration of this contract.

4. UTILITIES. WATER, ELECTRICITY, TELEPHONE, ETC. All expenses for monthly


consumption of water, use of telephone lines, electricity, and for other services utized by the
LESSEE, shall be for the account of the LESSEE.

5. USE OF LEASED PREMISES. - The LEASED PREMISES shall not sublease, transfer,
assign or in any manner, dispose of the leasehold rights on the LEASED PREMISES or any part

thereof, without the prior consent of the LESSOR, which consent shall not be unreasonable
withheld.

6. ACCESS AND RIGHT - The LESSOR, during the duration of the term of this LEASE
with prior consent of the LESSEE, reserves the right at any reasonable hour of the day or night
especially in case of emergency to enter and inspect the premises.

14 SALE. TRANSFER AND M ORTGAGE - In the !'Vent of sale, tran sfe r. m ort gag!' or

l S. ABANDONMENT OF THE LEASED PREMISES OR PRE-TERMIN ATION OF LEASE -


This Lease ,s guaranteed for the duration of this Contract . In t he event t hat the LESSEE
abando ns the LEASED PREM ISES or t erminates the lease before the expiratio n or th e agreed
period , all amounts paid or deposited by th e LESSEE to the LESSO R shall be for rei ted in favor o f
the LESSOR. The LESSEE shall likewise be liable for all unpaid bills of e lect rici ty, wa te r,
telepho n e, etc.
Upon Termination of the lease or in case of abandonment of the pre mises, the LESSOR
shall be free t o enter and o ccupy the LEASED PREMISES.

16. DESTRUCTION OF PREM ISES - If during the period of this lease, the LEASED
PREMI SES are destroyed or rende red unfit for use o f th e LESSEE by reason of fortuitous events
such as earthquake and act s of God circumstances, this lease shall be auto m atically t erminated.
The LESSOR shall return to the LESSEE such unused rental payment s that correspond t o the
unexpired period of the lease. The Security Deposit or the balance ther eof remaining after th e
se ttlem ent of accounts in Sectio n 2 h erein shall likewise be refunded. J
17. THIRD PARTY LIABILITY - The LESSEE, during th e occupancy or the LEASED
PREMISES, shall hold th e LESSOR free and h armless from any d am ages o r liability o f th e LEASED
PREM ISES caused to the third parties by the LESSEE, its agents or guest s. The LESSOR sh all
hold t he LESSEE free and harmless from any damage or liabilit y t o the PREMI SES when such
damage o r liability ,s caused by fortuitous events o r acts or God , such as typhoon , earthquake,
flood, et c., wh ich are beyond the control of the LESSEE.
18. VIOLATIONS - Any violation to the terms provided for in this contract on the part
of the LESSOR or LESSEE not remedied within thirty (30) days from notice shall be sufficient
ground for the termination of the CONTRACT OF LEASE, by the aggrieved party without any
need of judicial action.

19. MODIFICATION OF CONTRACT - This contract shall not in any way be amended,
modified or notated except by virtue of a written instrument signed by the LESSOR and the
LESSEE, or by their duly authorized representatives.

20. RIGHT OF FIRST REFUSAL - The LESSEE is given the right of the first refusal to
purchase the LEASED PROPERTY in the event the LESSOR decides to sell. It is understood that
in the event the LESSEE does not want to exercise this right or to match the offer of a buyer, the
same shall be communicated to the LESSOR within fifteen (15) days from receipt of LESSOR'S
notice. However, the terms and conditions of this lease shall continue to be effective and
binding and shall be respected by the parties to the sale or to any third person.

21. SEVERABILITY - If any part, term or provision of this Contract shall become
invalid or unenforceable, the validity or enforceability of the remaining portions or provisions
shall not be affected, and the rights and obligations of the Parties shall be construed as if this
Contract did not contain the particular invalid or unenforceable part, term or provision .
