PEOPLE v ASTROLOGO 
FACTS: 
• Astrologo was charged with rape, committed against his own daughter by means of force and intimidation 
• TC found him guilty beyond reasonable doubt of the crime of rape 
• Sentenced him to suffer imprisonment of RP 
• Ordered him to pay P75k as civil indemnity 
• Php 75,000.00 as moral damages 
• CA affirmed the conviction of Astrologo 
• Reduced the amount of indemnity from 75k to 50k 
• Php 25,000.00 as exemplary damages 
HELD/RATIO 
• Civil indemnity is in the nature of actual damages 
• Mandatory upon the finding of the fact of rape 
• Court affirmed the conviction 
• Held that the reduction of civil indemnity was proper because the crime committed was only simple rape 
PEOPLE v APATTAD 
FACTS: 
• Apattad raped his daughter of minor age multiple times from 2001 to 2003. 
• When AAA told her mother, she whipped her for not telling her about it immediately. 
○ She was afraid that they would get killed. 
○ Apattad and the mother where always fighting and AAA even saw her father slap her mother 
• They went to DSWD in Cagayan where AAA was interviewed by a DSWD personnel  
• They went to the police station where AAA executed a sworn statement 
• Trial Court held Apattad guilty for 3 counts of Rape. 
• Pay P150,000 
• CA affirmed Trial Court 
• Pay P75,000 for each count of rape 
• Pay P75,000 for moral damages for each count of rape 
• Pay 25,000 for exemplary damages for each count of rape 

HELD/RATIO: 
• When the circumstances surrounding the crime would justify the imposition of the death penalty were it not for RA 9346, the award of civil
indemnity of the crime of rape should be 75k 
• People v Victor: indemnity is an expression of the displeasure of the Court over the incidence of heinous crimes against chastity 
• In rape cases, when the victim is under 18 or when the offender is a parent, ascendant, step‐parent, guardian, relative by consanguinity
or affinity within the third civil degree, or the common law spouse of the parent of the victim, the imposable penalty is death.  

PEOPLE v BANAGO 
FACTS: 
• Bañago was charged before the Regional Trial Court of Malolos, Bulacan by Dolores Jaurigue with the crime of rape 
• TC sentenced him to suffer imprisonment of RP and ordered him to indemnify the victim the sum of P50,000.00 as moral damages 
HELD/RATIO: 
• Court affirmed the conviction but modified the decision by including civil indemnity for rape 
• Award of moral damages is separate and distinct from the civil indemnity awarded to rape victims 
• Moral damages cannot take the place of the civil indemnity 
• Moral damages is discretionary on the part of the Court 
• Civil indemnity is in the nature of actual damages, and is mandatory upon the finding of the fact of rape 
• Ordered Banago to pay 75k as civil indemnity in addition to the 50k moral damages 
PEOPLE v BARTOLINI 
FACTS: 
• Bartolini was charged with (3) counts of rape against his (2) daughters, AAA (14 years old) and BBB (16 years old) 
• TC found him guilty beyond reasonable doubt of  three counts of incestuous rape against his two daughters 
• suffer the penalty of Death by Lethal Injection. To pay Seventy‐Five Thousand (P75,000.00) pesos as civil indemnity and Fifty Thousand
(P50,000.00) pesos as moral damages and to pay the costs 
• CA: affirmed conviction but modified penalties by reducing the penalty of death to reclusion perpetua following the abolition of the death
penalty and by modifying the monetary award in favor of the victims 
• (a) in Criminal Case Nos. [99‐1‐]2083‐H and [99‐1‐]2085‐H, the penalty of death is reduced to reclusion perpetua; and to pay the amount
of (P75,000.00) as civil indemnity, (P75,000.00) as moral damages and (P25,000.00) as exemplary damages for each count; and 
• (b) in Criminal Case No. [99‐1‐]2084‐H, the accused is sentenced to suffer the penalty of reclusion perpetua; and to pay the amount of
(P50,000.00) as civil indemnity, the amount of (P50,000.00) as moral damages, (P25,000.00) as exemplary damages; 
• (c) with costs.

HELD/RATIO 
• Court modified the judgment by finding the accused guilty of two counts of qualified rape in two of the three cases 
• Sentenced him to RP in lieu of death 
• In the third case, the Court found him guilty of simple  rape 
• Because in this case, notably absent in the information, is a specific averment of the victim's age at the time the offense against her was
committed 
• Such an omission committed by the prosecutor is fatal in the imposition of the supreme penalty of death against the offender. 
• Sentenced him to RP 
• Court increased the civil indemnity in the third case from 50k to 75k 
• People v Catubig: The commission of an offense has a two pronged effect 
• On the public = breaches the social order 
• On the private victim = Caused personal sufferings 
• Each effect is addressed by prescription of heavier punishment for the accused and by the award of additional damages to the victim 
• Increase of penalty = exacerbation of the offense by attendance of aggravating circumstances, whether ordinary or qualifying 
• Award of damages = intended for the offended party who suffers because of the crime 
• Where the special qualifying circumstances of age and relationship, even if it is not alleged in the info, are established in trial, the award
of civil indemnity and moral damages in a conviction for simple rape should EQUAL the award of civil indemnity and moral damages in
conviction for qualified rape 
•Victim's suffering is just as great when her father who raped her is convicted for qualified rape as when he is convicted only for
simple rape due to technicality 
PEOPLE v ANTICAMARA 
FACTS: 
• TC found him guilty beyond reasonable doubt of the crime of rape 
HELD/RATIO 
• Court held that civil indemnification in the amount of 75k is mandatory upon the finding of rape
