BRIEF MEMO/OTHER MATTERS:

Respondent was arrested on June 18, 2018 at Brgy. San Diego

Zone 3, Tayabas City when he was caught in the act of collecting money
bets for STL without permit or authority from Pirouette Gaming
Corporation, STL operator in Quezon Province.

Going over the documents submitted by the complaint, no

certification from Pirouette Gaming Corporation was attached to prove
that respondent is not authorized by the said corporation to collect
money bets for STL.

After inquest proceeding, respondent filed his counter-affidavit

alleging among others that at the time of his arrest, he was not in
possession of his identification card issued by Pirouette Gaming
Corporation. Respondent attached in his counter-affidavit the said
identification card.

For: Violation of PD 1602 as amended by RA 9287

IN VIEW OF THE FOREGOING, for lack of probable cause, the

undersigned respectfully recommends to the Honorable City Prosecutor
the DISMISSAL of the complaint for Violation of PD 1602 as amended by
RA 9287 against EDUARDO ESPOLLAR BAASIS.

The Chief of Police of CPS Tayabas City or his authorized

representative is ordered to release respondent EDUARDO ESPOLLAR
BAASIS from detention unless he is being held for some other lawful
cause/s.
