As a CONSTITUTIONALIST my concern is the true meaning and application of the constitution.

What is so idiotic is that when I write critical about Jews I am not racist because I am of
Jewish blood. When I write critical about Protestant I am not racist because being baptized
as such. What therefore we have is a perception that merely criticism anyone not being of

didn’t want to get the brown shoe past on their dresses. As such, we need to be careful to not be oversensitive
and blame whatever on racism when it might have absolutely nothing to do with racism but merely to do with
coincident such as being at the wrong time at some location that you are say a victim not intended at all to be
racism.
We are swarmed with racism claims and it is like the Salem Witch-hunt where people image racial
discrimination where none might be involved. Let it be clear as a child I skipped school often because of
being bullied, etc, but looking back now being a senior I simply look at it as being an unpleasant part of
growing up. I am not perfect and cannot expect others to be any better. So, don’t thrive on it but get on with
your life.

I am sorry that my late colleague and co-delegate for Queensland, Mr. Macrossan, is not here to express his

What this also means that all those land rights issues about Aboriginals really relates to the
“race” issue, and falls under Commonwealth of Australia legislative powers, and as such I view
beyond the powers of the State of Victoria to legislate on this subject! Hence all legislation

This is the legal basis upon which the federation was based.
Aboriginals lived throughout the landmass Australia, not uncommon murdering other tribes,
regardless of being Aboriginal. They didn’t have a common language, or a common
representation, at least that is what I understood from the numerous conversations I had with
various elders of different Aboriginal tribes. It is in my view therefore inappropriate indeed
ridiculous to refer to Aboriginals as if they are and were one nation. They never had a flag that is
now being used to purport to be an Aboriginal flag.
Aboriginals were residing, so the Framers of the Constitution referred to, in Asia also and as such
it is utter nonsense to hold that because a person is of a certain race then somehow they owned
the land or were custodians of the land where their forefathers may never have set foot on the
landmass Australia, formally known as New Holland.
Likewise, because I am Caucasian and was born in the Netherlands doesn’t mean then that I can
claim land rights upon what is now Western Australia because the Dutch settled there in the
1600’s, and so the Captain shipwrecked and coming ashore with about 70 men then staying in
New Holland (as then known) and integrating with Aboriginal tribes and establishing settlements
(as recorded in the shipping journal of a French ship) and technically as Captain did bring Dutch
law to New Holland. Also the French referred to dark skinned children with blond hair.

both ran a story about a cave discovered by Nick Vašíček. The paintings depicted in the programs also do
seem to coordinate with the logbook records of Dutch ships that in the 1600’s were travelling there for

 At various times the Dutch were shipwrecked in what is now known as Australia, and below various extracts
of ship log books are quoted, showing that the light coloured Aboriginals were of Dutch heritage and their
building method showed this also.
As Captain Cook took New Holland upon the basis that there was no form of government existing even so,
unbeknown to him, the Dutch had created a form of limited government “A remarkable circumstance is
the presence amongst them of a race, to appearance, totally different, and almost white, who
seem to exercise no small influence over the rest.”.

Government in those times was where there was a leadership, and as one of the Dutch shipwrecked persons
was a Captain, he would obviously have exercised his leadership role when assimilating with the Aboriginals
and the result was light coloured Aboriginals (mixed races) and tracks of land being used to grow potato like
vegetables which Aboriginals were not known to do as they were more nomadic within an area. Also the
Dutch house kind of buildings indicate Dutch heritage.

It should be understood that some of this I published on 15 March 2010 (part of a litigation case then before
VCAT about FEE SIMPLE when representing Mr Francis James Colosimo) being weeks before the recent
reports and as such as a CONSTITUTIONALIST made my claim without that I relied upon the channel 9
and Channel 7 reports.

What must be stated is that when checking the various Dutch ship logbooks and charts then there are ample
of data about the Dutch entering what is now known as Australia!

When one then check the Letter patent you find that the British could not take New Holland at all legitimately
because it didn’t allow to conquer the land at all. It means that Aboriginal land rights in certain parts of
Australia actually due to the assimilation with the Dutch is all along rather Aboriginal land ownership!

Conclusion
This is but a very small sample of the sort of evidence that is available from the diaries and journals
of the early explorers in Western Australia. These "superior" huts, wells and native paths were
obviously built with European assistance and not from itinerant visitors from ships sailing
past or whalers and sealers dropping in, from time to time, for rest and recuperation. These
were built for use by the builders (the castaways) who had no option but to improve their lot where
possible. The adoption of European agricultural practices by the natives in the form of warren fields
allowed them to adopt a more sedentary lifestyle such as those the Europeans enjoyed at home.
Taken altogether, this “body of evidence” points, indubitably, to these New Holland castaways
having been accepted into the indigenous community. This acceptance extended to intermarriage
and the production of offspring.

This opens up the possibility of the existence of ancestral links amongst today's aboriginals
reaching back to the castaways of VOC shipwreck days.

It also opens up the possibilty of these Europeans being officialy recognised as Australia's
first European settlers.

Clearly anyone born in the Commonwealth of Australia is a native. And to try to work out how
many, not just of Europe but also of other continents/countries there is DNA of a mixture of so
called Aboriginals and others may make it extremely difficult to recognize just the so called
Aboriginals and exclude others who might in fact show a greater DNA result to that of who we
refer to as Aboriginals. The question then becomes are we going to recognise whomever in the
world claims to be Aboriginal/ Aboriginal descent? Again, we might just do better to recognise
anyone with origin from Africa and we are then inclusive of everyone, well until the experts
change their views and claim that the DNA purportedly traced back to Africa after all might not
have been so as they located some Alien from outer space who’s DNA turn out to be the real
basis of all humans.

findings are upon what they assume and over time they may have to rectify it. If indeed the world
originally was one entire land mass then anyone could have been walking along it and if as I
understand with New Zealand the original inhabitants were murdered out then why not consider
the same having eventuated in Australia by late comers who now claim to be the First people,
even so the different groups cannot all be the First People. We had this issue about the Apology
and it was claimed that is all they wanted. Well they got it and they seem to me to be in the
business to continue no matter what. Over the decades various of those who claim to be of
Aboriginal Descent made clear they in the end want to get rid of anyone they hold is not an
Aboriginal native. However they also claim that anyone with a trace of Aboriginal descent no
matter how little is deemed to be an Aboriginal. Well again as we all allegedly are from Africa
then for get about Aboriginal heritage just celebrate we are all allegedly Afrikaners by
descent regardless of the colour of our skin. Anyone who wants to claim traditional RIGHTS AS
First People of Africa can go and make a claim. I do not know how successful anyone might be
doing so, but that is another story.
We need to return to the organics and legal principles embed in of our federal constitution!
