DEED OF EXTRA-JUDICIAL SETTLEMENT AND SPECIAL POWER OF ATTORNEY

KNOW ALL MEN BY THESE PRESENTS:

This Deed is entered into and executed by and among the Heirs of Pura Cabanag, namely:
FAUSTINO CABAJON, SR., husband and children BERNARD C. CABAJON, BEBILYN C.
CABAJON, JUVY CABAJON-CUERDA, CAROLINE CABAJON-CARIN, RAHIEMA
CABAJON-IQUIO, and FAUSTINO CABAJON, JR., all of legal age, Filipinos, married, except
Faustino Cabajon, Sr. and Bebilyn Cabajon, who are widow and single, respectively and
residents of Poblacion, Sibulan, Negros Oriental;

WITNESSETH:

That FAUSTINO CABAJON, SR., married to Pura Cabajon, is the registered owner of a
certain parcel of land known as Lot No. 86-B, Psd-07-041148, located in Poblacion, Sibulan,
Negros Oriental, covered by Transfer Certificate of Title No. T-31645, which is more particularly
described as follows:

“A parcel of land, known as Lot No. 86-B, being a portion of Lot No. 86, located in
Poblacion, Sibulan, Negros Oriental. Bounded on the North by Rizal Street; on the
East by Lot No. 86-C; on the South by Lot No. 88; and on the West by Lot No. 86-A;
containing an area of ONE HUNDRED NINETY NINE (199) Square Meters, more
or less;

That PURA CABANAG CABAJON, died intestate sometime in the September 23, 2012,
leaving without any testamentary will nor debts not settled until the present and upon her death
she was survived by her husband and children who are her only compulsory heirs, the
aforementioned parties herein;

NOW THEREFORE, invoking the provisions of Section 1, Rule 74 and other related
laws on successions, the above-named heirs of PURA CABANAG-CABAJON, by these
presents, do hereby settle and adjudicate unto themselves, their heirs and assigns the above-
described parcel of land, in accordance with their rights, interests and participation therein, free
from all liens and encumbrances;

WITNESSETH FURTHER:

That herein children of spouses Faustino Cabajon, Sr. and the late Pura Cabanag, have
appointed their father, FAUSTINO CABAJON, SR. to be their Attorney in fact, in their place
and stead to MORTGAGE or SELL the aforementioned parcel of land to any interested
mortgagee or buyer at the price agreed upon them and to get and receive the proceeds thereof;
and to sign any and all documents pertaining to the said transactions and authority; that we are
granting and giving unto our said attorney in fact, full power and authority to do and perform
each and every act necessary in order to give full effect of the foregoing authority and hereby
ratifying and confirming all that our said attorney in fact shall lawfully do or cause to be done by
virtue hereof;

That the parties herein declares that the aforementioned parcels of land is a residential land
, hence not covered by the provisions of the Comprehensive Agrarian Reform Law of the
Philippines.

IN WITNESS WHEREOF, we have hereunto affixed our signatures this ____day of May
2013 at Sibulan, Negros Oriental.

all the parties herein who exhibited their respective Community Tax Certificate Numbers/ID
Numbers all known to me to be the same persons who executed the foregoing document
consisting of two (2) pages, including this page of acknowledgment and all pages are duly signed
by them, together with their two instrumental witnesses and that they acknowledged to me that
the same is their free act and voluntary deed.
