This DEED is entered into and executed by, SUSANA FORTUITO, of legal age, Filipino,
Single, and a resident of barangay Magatas, Sibulan, Negros Oriental, hereinafter called the
VENDOR, in favor of,
WILFREDO CALENTIG, also of legal age, Filipino, married to Jocelyn Mendoza and
with residence and postal address at barangay San Antonio, Sibulan, Negros Oriental,
hereinafter referred to as the VENDEE;
WITNESSETH:
That the herein vendor, Susana Fortuito is a co-owner of one-third (1/3) portion of a
certain parcel of land known as Lot No 3103, LRC Cad. Rec.No. 358, of the Cadastral Survey of
Sibulan, with all of the improvements found therein, located in barangay Magatas, Sibulan,
Negros Oriental, covered by Transfer Certificate of Title No. T-13623
That Susana Fortuito acquired the said one-third (1/3) share, thru inheritance as shown in
the Deed of Extrajudicial Settlement and Partition, known as Doc. No.295; Page No. 60; Book
No. XXV; Series of 2011, notarized Atty. Dino Tanoy, Notary Public;
WITNESSETH FURTHER:
That for and in consideration of the sum of ONE HUNDRED FIFTY THOUSAND
PESOS (Php150,000.00), Philippine Currency, in hand paid by the herein Vendee, WILFREDO
CALENTIG and receipt in full is hereby acknowledged by the Vendor, SUSANA FORTUITO
herein to her entire satisfactions and that by virtue of these presents, the herein Vendor does
hereby SELL, TRANSFER, and CONVEY unto the vendee, his heirs and assigns, all the
vendor’s rights, interests and participations over the one-third (1/3) portion of the above-
mentioned parcel of land, including all the improvements found therein, free from all liens and
encumbrances;
That the vendor herein declares that due notice has been given to all persons affected by
this transaction in compliance with the provisions of the New Civil Code of the Philippines,
pertaining to the rights of the redemptioner and preemptioner, but nobody opted to exercise the
said rights; further the vendor declares that and the said parcel of land is not tenanted and not
covered by the Comprehensive Agrarian Reform Law because the said parcel of land is within
the retention limits of the vendor, and the vendor warrants her title and ownership over the said
parcel of land and will defend the rights of the vendee against any adverse claim whatsoever.
