CONSTITUTION AND BY-LAWS OF THE OFFICIAL STUDENT


PUBLICATIONS OF MOBO NATIONAL HIGH SCHOOL
PREAMBLE
We, the students of Mobo National High School, with the help of our Almighty God, and
believing in the need for a free, organized and official student publication, and in the need to uphold
the truth and protect students’ rights, hereby form an editorial board and staff that shall embody the
ideals and principles of responsible, fair, accurate, and truthful journalism in order to put first above
others the welfare of the studentry, the school and the community do hereby promulgate and adopt
this constitution and by-laws that will promote, implement, and maintain our goals and aspirations.

Be it deliberated and conceded by the existing Editorial Board and Staff assembled and be it
approved by the school principal, the division journalism coordinator and the schools division
superintendent:

ARTICLE I
NAME AND OFFICE OF THE STUDENT PUBLICATIONS

Section 1.The official name of the official student publications of Mobo National High School shall
be The Swamp for the English publication and Ang Latian for the Filipino publication.
Section 2. The nameplate (whose appearance may change depending on the need) of the publications
in its every issue should always bear the school’s official logo with the established background of a
swamp as a symbolic attribution to the origin of the publication’s name.
Section 3. The official student publications of the school should have a conspicuous and functional
office inside the school’s premises which shall be the center for all the activities, affairs, trainings
and meetings of the editorial staff. The school paper office shall be run and managed by the
designated school paper advisers.

ARTICLE II
DECLARATION OF POLICY

Section 1. As stated in the implementing rules and regulations of R.A.7079 or the Campus
Journalism Act of 1991, it has been declared a state policy to uphold and protect the freedom of the
press even at a campus level and to promote the development and growth of campus journalism as a
means of strengthening ethical values, encouraging critical and creative thinking and developing
moral character and personal discipline of the Filipino youth. In furtherance of this policy and
bringing it in the context of the campus level, the school should therefore undertake various
programs, trainings and projects aimed for promoting responsible and free journalism. The campus
paper teacher-advisers and personnel involved in the campus journalism program of the school have
the duty to support and promote the editorial policies, programs and objectives embodied in this
Constitution and By-Laws.

ARTICLE III
OBJECTIVES

The official student publications shall serve the best interests of the students, of the school and of the
community with the following objectives to wit:
Section 1. To serve as the voice of the students, of the school and of the community in documenting
significant events and worthwhile accomplishments;
Section 2. To serve as laboratory for young writers to develop their journalistic writing skills;
Section 3. To serve as bridge which fosters the sense of cooperation and unity among the school, the
home and the community;
Section 4. To strengthen the values of discipline, cooperation, accuracy, fairness, tactfulness,
truthfulness, responsibility and leadership among student writers;
Section 5. To influence public opinion through the critical presentation, evaluation and interpretation
of events and issues; and
Section 6. To create an avenue where student writers act as guardians of students’ rights as the
student publication serves as the eyes and ears of the readers hence educating the students and the
people in the community.

ARTICLE IV
MEETINGS

Section 1. Regular meeting of the Editorial Board and Staff shall be held every Wednesdays of the
month during the school year at a specified room at 4:00-5:00 p.m. The meeting can be cancelled
subject to the unavailability of the editorial staff and/or other intervening factors such as school
activities, meetings called by the department head and principal etc.
Section 2. In the case of upcoming school paper contests and/or conferences and in completing the
issues of the publications, the advisers can set meetings and/or trainings on weekdays or weekends
provided that permission shall be asked from the school principal and consent shall be secured from
the parents of the journalists.
Section 3: No other school organizations can hold a student journalist from attending the meeting
especially that the meeting is regularly set and is cited in this constitution and by-laws. Hence, the
teacher-adviser of other school organizations can meet with the concerned student journalist(s) on
other days except the aforementioned day and time above.

ARTICLE V
AMENDMENTS

Section 1. This constitution and by-laws may be amended and/or ratified with a two-third rate of the
Editorial Board and Staff provided that notice is given to the school head.
Section 2. No amendments and/or ratification shall be done unless there is a proposed written
amendment passed to the Editor-in-Chief and noted by the school paper advisers and the school
head.

ARTICLE VI
EFFECTIVITY

Section1. Amendments of the general constitution and by-laws of the school’s student publications
shall take effect immediately after the approval of the school head.

BY-LAWS

ARTICLE I
MEMBERSHIPAND RECRUITMENT

Section 1. Every bona fide student of the school are members of the studentry to whom the editorial
staff of the student publications shall be accountable at all times.
Section 2. Every bona fide student of the school can be a part of the editorial staff of both The
Swamp and Ang Latian provided that he/she passes the qualifying examination, undergoes the
interview and the orientation program to be administered by the school paper advisers.
Section 3. In order to reach all aspirants, the incumbent editorial board and staff together with the
school paper advisers shall take necessary measures to recruit members and shall indulge to activities
such as but are not limited to posting written announcements, distributing leaflets, making an
announcement during the flag ceremonies and forming a sign-up booth during the orientation day.
Section 4. Any editorial staff can be recruited and can be a member in any time of the school year
provided that he/she meets the provisions under Section 2 of this article.
Section 5. Once the members have been recruited and pooled, their appointments and designations as
to their positions shall be taken care of by the school paper advisers. Provisions are made under
Article III, Appointment of the Editorial Board and Staff.

ARTICLE II
THE CAMPUS STAFFERS’ IDENTITY

Section 1. The student staffers shall wear the prescribed school uniform from Monday – Friday.
Though there is no declared wash day, the editorial staff shall be allowed to wear their previous
school paper uniform worn during conferences and/or those prescribed by the school paper advisers
during Fridays. The said shirts shall be deemed acceptable for they also bear the student journalists’
identity as part of the campus paper.
Section 2. The editorial staff and members are highly encouraged to always wear their school paper
identification card along with their school ID as this establishes their identity as part of the campus
paper. Moreover, all staffers should always wear their ID if they are covering an event/issue for the
publication especially during events where they do not wear their uniform.

ARTICLE III
APPOINTMENT OF THE EDITORIAL BOARD AND STAFF

Section 1. The appointment of the Editorial Board and Staff especially on the chief, managing and
section editors shall be based on the expertise and growth the staffers have shown while performing
the task of being a journalist. Furthermore, he/ she must pass a set of qualifying examination and
must undergo an interview that will satisfy the standards of the school paper advisers.
Section 2. The school paper advisers for English and Filipino shall be the one to decide whom to
suspend, replace and/or appoint depending on the provisions stated under Article VIII.
Section 3. The school paper advisers shall be the ones to decide whether there is a need for the
reorganization of the Editorial Board and Staff every year depending on a felt need for doing so.
Section 4. If reorganization in the editorial staff has happened, the school paper advisers should
notify the school head in writing regarding the new composition of the Editorial Board and Staff.

ARTICLE IV
EDITORIAL BOARD AND STAFF’S COMPOSITION AND THEIR DUTIES AND
QUALIFICATIONS

Section 1. The Editorial Board and Staff of the The Swamp and Ang Latian shall consist of the
following:
A. Editor-in-Chief/ Punong Patnugot
B. Associate Editor-in-Chief/ Pangalawang Patnugot
C. Managing Editor (optional)
D. News Editor/ Patnugot sa Balita
E. Feature Editor/ Patnugot sa Tanging Lathalain
F. Copy Editor/ Patnugot sa Pagwawasto at Pag-uulo ng Balita
G. Sports Editor/Patnugot sa Isports
H. Science and Health/Technology News Editor/ Patnugot sa Balitang Pang-agham,
Pangkalusugan at Pangteknolohiya
I. Photojournalist/ Tagakuha ng Larawang Pampahayagan
J. Layout Artist/ Taga-Disenyo at Tagaanyo ng Pahayagan
K. Editorial Cartoonist/ Tagaguhit ng Kartung Pang-Editoryal
L. Reporters and Staffers/Mga Tagapagbalita
Section 2. General Qualifications of the Editorial Board and Staff
A. Members must be a bona fide Mobo NHS student and must have at least one year of
residency in the school.
B. Members can have or cannot have experiences in seminars, workshops, trainings and/or
conferences related to campus journalism when they join the editorial staff.
C. Members must have satisfactory grades especially in their language subjects.
D. Members must have passed the screening and/or qualifying examination administered by
the School Paper Advisers.
E. Members must possess a pleasing personality, a professional work attitude and must
value the principles of fairness, truthfulness, accuracy, responsibility, leadership and
integrity.
F. Members must understand fully the Editorial Board’s policies as stated in this
Constitution and By-Laws.

Section 3. Qualifications and Duties of the Editor-in-Chief/ Punong Patnugot


A. Must be a grade 9, grade 10 or senior high student
B. Has at least 2 years of residency in the school
C. Supervises the editorial staff of the paper
D. Writes the editorials of the campus paper after consultation with the other members of the
editorial staff
E. Edits all articles preparatory to submission of the same to the school paper adviser for
final editing and approval for publication
F. Supervises the preparation of the page designing in cooperation with the managing editor
and the layout artist
G. Causes the accomplishment of all assignments properly and on time
H. Acts as liaison officer between the editorial staff and the adviser
I. Calls meetings of the staff in consultation with the school paper adviser

Section 4. Qualifications and Duties of the Associate Editor-in-Chief/ Pangalawang Patnugot


A. Must be a grade 9, grade 10 or senior high student
B. Has at least 2 years of residency in the school
C. Assists the editor-in-chief in editing articles
D. Writes editorials of the school paper when requested by the school paper advisers
E. Prepares assignments of section editors in consultation with the editor-in-chief and with
the school paper adviser
F. Cooperates in the preparation of the page designing with the editor-in-chief, managing
editor and the layout artist

Section 5. Qualifications and Duties of the Managing Editor


A. Must be a grade 9, grade 10 or senior high student
B. Has at least 2 years of residency in the school
C. Brings articles and dummy to the printing press for typesetting
D. Checks articles for typographical errors
E. Assists the editor-in-chief and layout artist in page designing

Section 6. Qualifications and Duties of the News Editor/ Patnugot sa Balita


A. Must be a grade 8, grade 9, grade 10 or senior high student
B. Has at least one year of residency in the school
C. Assigns reporters to cover events for publication
D. Writes news articles on assignment from the editor-in-chief or through his own initiative
in consultation with the latter
E. Edits all news articles before submitting them to the editor-in-chief

Section 7. Qualifications and Duties of the Feature Editor/ Patnugot sa Tanging Lathalain
A. Must be a grade 8, grade 9, grade 10 or senior high student
B. Has at least one year of residency in the school
C. Gives out assignments to feature writers
D. Writes regular feature articles or columns
E. Edits all feature articles before submitting them to the editor-in-chief

Section 8. Qualifications and Duties of the Copy Editor/ Patnugot sa Pagwawasto at Pag-uulo
ng Balita
A. Must be a grade 8, grade 9, grade 10 or senior high student
B. Has at least one year of residency in the school
C. Checks facts, errors in grammar, spelling, punctuation, usage, organization and other
errors of every article
D. Improves articles by writing effective leads and deleting editorialized and irrelevant
materials
E. Writes headline and decides its typography
F. Gives instructions to the typesetter regarding font type, font size to be used and the number
of columns and ems

Section 9. Qualifications and Duties of the Sports Editor/Patnugot sa Isports


A. Must be a grade 8, grade 9, grade 10 or senior high student
B. Has at least one year of residency in the school
C. Gives out assignments to reporters to cover sports events
D. Writes articles unassigned to reporters
E. Edits all sports articles received before submitting them to the editor-in-chief

Section 10. Qualifications and Duties of the Science and Health/Technology News Editor/
Patnugot sa Balitang Pang-agham, Pangkalusugan at Pangteknolohiya
A. Must be a grade 8, grade 9, grade 10 or senior high student
B. Has at least one year of residency in the school
C. Assigns reporters to cover science, health and technology events or news for publication
D. Writes science news articles on assignment from the editor-in-chief or through his own
initiative in consultation with the latter
E. Edits all science news articles before submitting them to the editor-in-chief

Section 11. Qualifications and Duties of the Photojournalist/ Tagakuha ng Larawang


Pampahayagan
A. May come from any year level
B. Has at least one year of residency in the school
C. Photographs events for publication
D. Prepares pictorial articles of the school paper in consultation with the managing editor
and the editor-in-chief
E. Writes captions of pictures utilized by the paper in cooperation with the editor-in-chief
F. Labels or properly identifies all pictures made available for publication (Any labeling,
cropping or enhancement of the picture should be written in pencil at the back of the
pictures)
G. Assigns pictorial assignments to other staffers and provides technical assistance to them

Section 12. Qualifications and Duties of the Layout Artist/Taga-anyo at TagaDisenyo ng


Pahayagan
A. May come from any year level.
B. Has at least one year of residency in the school
C. Possesses the technical expertise in dealing with the computer, Adobe In-Design,
Photoshop and other applications helpful in creating the best page make-up
D. Helps the school paper adviser in page designing of the paper
E. Finally decides on the typography of all the sections in consultation with the section
editors, editor-in-chief and the school paper adviser

Section 13. Qualifications and Duties of the Editorial Cartoonist/ Tagaguhit ng Kartong Pang-
Editoryal
A. May come from any year level.
B. Has at least one year of residency in the school
C. Possesses the expertise in drawing and/or sketching
D. Prepares the editorial cartoons
E. Draws illustrations for features and non-news articles as the cases arise

Section 14. Qualifications and Duties of the Reporters/ Mga Tagapagbalita


A. May come from any year level.
B. Have at least one year of residency in the school
C. Gather the cold and raw facts of an assigned event and writes an article out of the same
D. Receive assignments from the section editors and accomplish the same properly and on
time

ARTICLE V
THE SCHOOL PAPER ADVISER

Section 1. Selection of School Paper Adviser


A. The School Paper adviser shall be designated by the school head.
B. As stated in Regional Memorandum No. 15 s. of 2015, priority is given to language
teachers (English or Filipino) especially those with previous experience in school paper
advising from other schools or those who were campus paper staffers during their
undergraduate years. In cases when these teachers cannot assume the role, those teaching
Social Studies can be appointed; as long as such teachers exhibit potential, enthusiasm
and commitment in handling the school paper.
Section 2. Tenure of Office as SPA (under the provisions of RM 15 s.2015)
A. Every school paper adviser should be appointed/designated for a minimum of five (5)
school years. This is to enable them to acquire the necessary skills needed in school
paper advising, which in turn, will empower them to train students in various areas in
campus journalism and facilitate the production of comprehensive school paper
B. Upon expiration of the tenure, the School Head can then decide to appoint a new school
paper adviser, or retain the services of the school paper advisers if they have exhibited
exemplary performance and dedication in the field of campus journalism.
Section 3. Workload
A. As stipulated in DECS Order No. 94, s. 1992, student publication advising
task/assignment shall be considered as one teaching/work load.
Section 4. Number of School Paper (under the provisions of RM 15 s.2015)
A. There should be a minimum of one school paper adviser and a maximum of two school
paper advisers in a school publication, one in English and another one in Filipino, when applicable.
B. It also follows that if the school has one SPA in English and another SPA in Filipino, there
should be at least two publications (1 English, 1 Filipino) of the school paper in one school year.
Section 5. Roles and Functions
A. The school paper advisers shall perform his/her roles as stated in Regional Memorandum
15 s. 2015and shall abide by the implementing rules and regulations of R. A. 7079 or the
Campus Journalism Act of 1991.

ARTICLE VI
STUDENT PUBLICATIONS’ FUNDS

Section 1. For general guidelines of funding the student publication, the Mobo NHS campus paper
advisers shall refer to Sections 1-6 of the Implementing Rules and Regulations of Republic Act 7079
or the Campus Journalism Act of 1991.
Section 2. If the fee for the printing of the student publication shall be sourced from the school’s
MOOE or from the Special Education Fund coming from the local government unit, the school paper
advisers must prepare a financial report of the issuance made.
Section 3. The school paper advisers together with the editorial staff are the persons responsible for
managing the fund well for trainings, conferences, seminars, issuances and for other purposes
related to campus journalism.
Section 4. The school head shall have the prerogative to release and hold funds for the student
publications especially if the school has not collected publication fees from the studentry. However,
the campus paper advisers, the school head and all concerned personnel should do the necessary
means to procure funds to continue the promotion of responsible and free journalism.

ARTICLE VII
PRESS CONFERENCES/ TRAINING SEMINARS

Section 1. In support to the Campus Journalism Act of 1991, the school should support the exercise
of free journalism by sending student-editors/writers and teacher-advisers to press conferences
(cluster, division, regional or national level), seminar-workshops and other related trainings which
are viewed to further strengthen their competencies as part of the editorial staff.
Section 2. Expenses of Editorial Staff to Press Conferences/Training Seminars-- Expenses
relative to the attendance of the editorial board and staff to the press conferences and trainings shall
be subsidized from the student publication funds, MOOE, SEF and other appropriations subject to
the usual auditing rules and regulations.
Section 3. Editorial Staff’s Agreement in Attending Press Conferences
A. A student staffer who has been a part of the editorial staff and has been chosen to
participate in the press conference at the division level shall no longer be allowed to join
in as many contests that he/she wants as offered by the DepEd and/or other public and
private institutions.
B. The student staffer shall only be allowed to join in two contests prior to the schedule of
the press conference; one is the press conference and the other one (in any subject area).
Since this would entail that a staffer can be out of focus, he/she must show effective time
management to retain his status as a contestant for the press conference. Failing to do so,
the school paper adviser shall have the prerogative to replace him/her with another
contestant from the pool of the editorial board.
C. No other teachers aside from the other teacher-coach mentioned above can get a student
staffer as a contestant especially during the trainings scheduled for the press conferences.
The school paper adviser must be notified first by the concerned teacher personally or
through the student staffer so that an agreement can be reached.
Section 4. Benefits of the Editorial Staff in Attending Press Conferences
A. A student staffer who has brought honor to the school for having participated in the
division, regional and national press conference is qualified for considerations and special
agreements from the school-based personnel pursuant to Regional Memorandum 121 s.
2002 and as cited in the student handbook of the school.
B. Guidelines for Rating Athletes/Participants in all DepEd Palaro/Cultural/Academic
Contests based on Regional Memorandum no.121, s.2002
1. For a more effective and smooth conduct of school sports and cultural/academic
contests in the region and in view of the numerous complaints of coaches, trainers,
parents/guardians, pupils and students, the following guidelines in rating of
students/pupils participating in such special activities including their scheduled
practice shall be implemented effective school year 2002-2003 and thereafter.
a. The grade/rating of athletes/participants during the time that they are included in
the delegation lists as representatives of the school/district, division/region to the
school/district/provincial/regional/national athletic meets and cultural/academic
activities such as NAMCYA, Dance Drama, Literary/Musical Contests, Math
Contest, Pop Quiz etc. shall be retained or increased in the academic and
vocational subjects and more points in Physical Education subject be awarded for
athletes.
b. These athletes/participants to said special activities shall be excused from their
classes during the training period up to the actual duration of the Palaro and
during cultural/academic contests.
c. Efforts should be made by school heads/administrators in such a way that make-
up classes, special projects and appropriate incentives be provided these
athletes/participants to make up for the lessons missed and comply with other
subject requirements.
2. There is a need for subject teachers and class advisers to understand and give their full
support to school/sports/cultural/academic contests which are geared toward the total
development of our pupils and students.
C. Additional Guidelines for Campus Staffers attending Press Conferences
1. Any campus staffer who shall be attending press conferences should be given
considerations by the subject teachers and class adviser considering that the former
shall be representing the name and shall bringing honor of/to the school.
2. Any deadline in written works and performance tasks should be extended for the
campus staffers in order for them to have full focus and attention to the press
conference they are currently attending. (This is based on the significant observations
of the SPAs that campus staffers are still bothered of their subject requirements even
during the actual contests because teachers do not give considerations on such
matters.)
3. In addition to the mentioned guidelines, campus staffers should at least be given 5-8
days (depending on the difficulty of the task) to comply with the subject requirements
they missed. Teachers have the prerogative of giving the highest score to every
staffer’s missed requirement. In case of examinations and/or activities, if the staffer
opted to take the ones he/she missed and he/she obtained the highest grade then, this
will be his/her rating in the said requirement.
D. Teachers who would not comply with the provisions stated under this article Section 4,
A-C must be dealt with accordingly by the school head. The concerned teacher (s) must
be given advice, feedback and or instructions pertaining to this matter regarding the
benefits that journalists should receive.
E. Based on DepEd Order No. 36 s. 2016, Policy Guidelines on Awards and Recognition for
the K to 12 Basic Education Program, student staffers who have become participants
and/or winners in press conferences shall be given “Special Recognition Award” during
the Recognition and Completion Ceremonies as a proof that they have brought honor to
the school.

ARTICLE VIII
SECURITY OF TENURE, DISCIPLINARY ACTIONS AND TERMS OF SUSPENSION
AND REPLACEMENT OF THE EDITORIAL BOARD AND STAFF

Section 1. A member of the student publication staff must maintain his/her satisfactory academic
standing in order to retain membership in the staff. (as stated in Rule VIII Section 1 of the Rules and
Regulation for Implementation of R.A. 7079/ Campus Journalism Act of 1991)
Section 2. A student shall not be expelled or suspended solely on the basis of articles he/she has
written. (as stated in Rule VIII Section 1 of the Rules and Regulation for Implementation of R.A.
7079/ Campus Journalism Act of 1991)
Section 3. The Editorial Board and Staff (especially the chief, associate, managing and section
editors) must not hold positions especially in the Supreme Student Government and must hold only
minor positions (limited to grade level representatives) in other school organizations.
Section 4. Reporters and other student staffers will be allowed to hold major positions in other
school organizations provided that their new duty shall not bring conflicts with their campus paper
duties especially under time management.
Section 5. Provisions under sections 3 and 4 are hereby stated because holding other positions in
other school organizations would not only make the staffers out of focus due to the workloads but
also as members of the campus press, the editorial staff should be objective and non-partisan.
Section 6. Disciplinary Actions, Terms of Suspension and Replacement of Editorial Staff
A member of the editorial staff shall be given disciplinary actions and shall be suspended
and/or replaced if found to violate the following cases to wit:
A. If a student staffer holds a position under the Supreme Student Government and/or major
positions in other school organizations, he/she shall be immediately replaced by the
concerned school paper adviser. The rules under Article 1, Membership and Recruitment
shall be strictly followed.
B. If a student staffer has committed a libelous, scandalous and defamatory post in writing,
in verbal form or in any form of social media, he/she shall be temporarily suspended from
his/her position and shall be advised and talked with by the respective school paper
adviser. However, if the act has been repeatedly done for at least three times, the student
staffer shall be removed from the staff.
C. If a student staffer has committed any other erroneous action/ misbehavior found in the
student handbook that renders him unfit from continuing to perform his/her task, he/she
shall be temporarily suspended from his/her position and shall be advised and talked with
by the respective school paper adviser. However, if any misbehavior has been repeatedly
done for at least three times, the student staffer shall be removed from the staff.
D. If a student staffer has failed to attend 1-2 trainings and/or meetings without a valid and
justifiable reason, he/she shall be temporarily suspended from his/her position and shall
be advised and talked with by the respective school paper adviser.
E. If a student staffer has failed to attend 3 trainings relating to his/her competence for
contests and/or conferences and/or in finishing an issue for a student publication without
proper notification and valid reason and has been proven to intentionally neglect his/her
duty, he/she shall be immediately removed from the editorial staff. He/She shall be
replaced following the rules under Article 1, Membership and Recruitment.
Section 7. A member of the Editorial Board and Staff shall hold office as long as he/she performs
well his/her duties as a student staffer and as long as he/she is not found to violate the provisions
aforementioned under Section 6.
Section 8. In case, any student staffer will resign, drop or transfer to other school, the one who will
replace him/her is the one who shall pass the qualifying examination, the interview and the standards
of the concerned school paper adviser still following the implementing rules under this by-laws.

ARTICLE IX
EFFECTIVITY

Section1. The implementing rules and regulations of the constitution and by-laws of the school’s
student publications shall take effect immediately after the approval of the school head, the division
journalism coordinator and the schools division superintendent.

Deliberated, signed and approved during the Second Editorial Board and Staff Assembly
on May 31, 2017 at Mobo National High School, Mobo, Masbate, Philippines.
