AGREEMENT ON EASEMENT OF RIGHT OF WAY

KNOW ALL MEN BY THESE PRESENTS:

This Agreement is executed this ______________ at _______________, by and between
the owner/Co-owners of the land subject of the easement, represented herein by
__________________, of legal age, married, Filipino, and a resident of _________________
[hereinafter referred to as the GRANTOR]; and
_______________________________ [hereinafter referred to as the GRANTEE],
likewise of legal age, Filipino, married, and a resident of _____________________________;

WHEREAS, GRANTOR are the owners of certain real property briefly described as Lot
________ with a total area of _________ square meters and declared under Tax Declaration No.
____________, situated at ________________;
WHEREAS, GRANTEE seeks an easement and right of way through and within said Lot
_________, and/or the right of ingress and egress in, from and to said easement, for the purpose
of locating, establishing, constructing the Barangay Hall, Barangay Health Center and other
buildings and installations to be made by the Barangay of ___________ to the adjacent lot, and
which is now owned by the said Barangay;
NOW THEREFORE, FOR GOOD AND VALUABLE CONSIDERATION, the receipt and
sufficiency of which is hereby acknowledged, GRANTOR hereby grants unto GRANTEE its
successors and assigns, an easement and right of way through and within the property above-
described, and for this purpose to open a public road or pathway, with four (4) meters width and
at least fifty (50) meters of length or until it reaches the GRANTEE’s lot to serve as path of entry
and egress in going to and from the area of the GRANTEE, and as depicted on Exhibit “A” of
this Agreement found at the dorsal side hereof;
This Agreement is intended for the Barangay use and the public, by which the GRANTOR
reserves and shall have the right at all times for itself, its heirs and assigns, to use and enjoy the
property in a manner consistent with the nature of the property;
The agreement on easement and right of way shall last for a long as the intent of this
Agreement exists.
IN WITNESS WHEREOF, the parties have signed this agreement on the date and at the place
above written.

BEFORE ME, a Notary Public for and in ___________, this ______________ personally
appeared the parties above signatories, known to me and to me known to be the same persons
who executed and voluntarily signed the foregoing Agreement, which they acknowledged before
me as their free and voluntary act and deed.
