This downward trend in bankruptcy filings mirrored the upward trend in commodity prices over the last two
years. However, natural gas prices remain depressed from historical highs and crude oil prices remain as
volatile as ever. The fourth quarter of 2018 saw a 40 percent drop in oil prices down to around $46/Bbl just
after Christmas. Since January 2019, however, oil prices have rebounded and are above $60/Bbl as of May 1,
2019. Although still below the higher prices oil producers received last fall, the increase relieves a lot of
pressure on many oil companies that avoided bankruptcy but remain weighed down by the hangover of high
leverage taken on before the 2015 price crash. Even with the relief in oil prices, some companies remain
financially stressed and may not be able to avoid restructuring their debt through bankruptcy. And some
companies may be heading for Chapter 11 for a second time (“Chapter 22”). Haynes and Boone will continue
to monitor the industry and report periodically on the financial status of its producers.
Our lawyers have played a key role in a number of high-profile E&P, midstream, and oilfield service matters,
including asset sales, refinancings, debt restructurings and Chapter 11 cases, representing debtors, creditors,
energy lenders, and private equity investors.
Haynes and Boone publishes companion reports on oilfield services companies in the Oilfield Services
Bankruptcy Tracker, and for midstream companies in the Midstream Report. For additional information on
the industry, please see these reports and the Haynes and Boone Energy Roundup as indicators of the
impact of market conditions.
