PREAMBLE

Sports, by their very nature, constitute human needs bestowed by


the greatness and majesty of God Almighty. They comprise the basic
elements and are very influential in the spiritual and physical
development of each human being within the framework of the
development of humanity, which are necessary in the
implementation of nation building to pave the way for a healthy and
dignified society. Therefore, it is the right of every human to do and
to participate in sport activities.

Sports in Indonesia are actually a manifestation of real struggle to


express the will, determination and desire of Indonesian people to
achieve unity and oneness. This sport movement in Indonesia has
been a part of the world sports movement intended to achieve world
peace. Therefore, with full awareness and determination, Indonesian
people organize themselves in the Central Sport Organizations,
according to the their type and function, with the ultimate goal of
achieving the ideals of the nation, based on the state philosophy of
Pancasila and on the 1945 Constitution of the Republic of Indonesia.

Give thanks to God the Almighty, for we the people of sports have
enjoyed the opportunity to take part in sports events, and have fully
realized that sports are not merely for our own benefit, but shall also
be carried to the public interests and the interests of the nation and
the state.

Aware of the responsibility toward our nation and country, and of


the condition of the people of Indonesia, of the ultimate goal of
sports in this country, that is to bring out the best in Indonesian
people, who are eager to take part in the national development, in
sports, and in any effort to bring peace to the world, then, by the
grace of God Almighty, the central organization of Indonesian sports
herewith proudly state that we establish the national sports
committee, which is the sole agency responsible for professional
sports and for assisting the government in making national policy in
the management, coaching, and development of professional sport
in the territory of the Republic of Indonesia, with the following
organizational constitution:

CHAPTER I
GENERAL
Section One
Name and Domicile
Article 1

1. The name of this national committee shall be Komite Olahraga


Nasional Indonesia (The National Sports Committee of
Indonesia) or KONI, for short.
2. KONI domiciled in the capital of the Republic of Indonesia.

Section Two
Place and Date of Establishment
Article 2

KONI was founded in Jakarta on December 31, 1966 for an indefinite


period.

Section Three
Principle and Foundation
Article 3

1. KONI is based on Pancasila or the Five Principles.


2. KONI is based on the 1945 Constitution of the Republic of
Indonesia.

Section Four
Status
Article 4

1. KONI is the only national organization of sports with authority


and responsibility to manage, maintain, develop, and
coordinate each and every event of professional sports within
the territory of the Republic of Indonesia.
2. KONI may coordinate with relevant institutions in conducting
activities related to international sports events.
3. KONI is a sports organization not affiliated to any political
power and is non-profit in nature.

Section Five
Objectives, Duties, and Functions
Article 5

1. Objectives
KONI aims at realizing glorious achievement in sports, building
character, raising the dignity and honor of the nation in order
to take part in nurturing national unity and strengthening
national defense.
2. Duties
KONI shall have the following duties:
(a) To assist central and local governments in policy making
related to the management, coaching, and development
of professional sports at both national and local levels;
(b) To coordinate the sports governing bodies, functional
sporting organizations, as well as Provincial and
Regencial/Municipal KONI;
(c) To manage, construct, and develop professional sports
at its sole discretion;
(d) To implement and coordinate the activities of national
and regional sporting weeks;
(e) To assist and support the implementation of single
events or championships organized by members;
(f) To carry out evaluation and monitoring to achieve
consistency between policy and implementation; and
(g) To disseminate the Olympic spirit.
3. Functions
KONI shall perform the following functions:
(a) Improving the quality of Indonesian human resources and
nurturing and strengthening national unity through sports
coaching nationally;
(b) Popularizing professional sports fostered by its members to
achieve optimum performance in sports.

CHAPTER II
EMBLEM, FLAG, MARCH AND HYMN
Section One
Emblem
Article 6

1. KONI emblem depicts Garuda’s wings with five circles above


and three circles below them and white lotus and red flames in
the middle as described in Appendix I, which is an integral and
inseparable part of Constitution, with the following explanation
and meaning:
(a) Garuda’s wings symbolize the strength of the Indonesian
people, drawn in yellow gold with red muscles, intended
to provide the purity and integrity aspects as well as the
dynamics of power.
(b) Three circles that connects the two wings states that the
power will stand strong and lasting if based on the
principles of one nation, one language, and one land,
that is Indonesia.
(c) Red flaming fires depict the eternally lightning spirit in
pursuing the goal of triumphant national sports.
(d) White Lotus depicted in the flaming fire reminds us that
however strong a power is, it will be meaningless
without any sanctity, honesty, and nobility of character
of those who use it. A lotus with five leaves symbolizes
the five principles of Pancasila that serve as the nation's
blueprint for Indonesian society and way of life.
(e) Underneath the Garuda’s wings there is a lettering that
reads “INDONESIA” in a curved form.
(f) Five chained rings of blue, yellow, black, green and red
above the Garuda’s wings borrowed from the
International Olympic Committee (IOC) logo stand for
five continents.
2. KONI’s emblem shall be used for all official events, such as
Sport Meeting, conferences, and Sport Week at National,
Provincial, Regencial/Municipal levels, and appointment of
managers.

Section Two
Flag
Article 7

1. KONI’s flag is white, which symbolizes the nation’s spirit of


sportiveness, with KONI’s emblem, as referred to in Article 6,
printed on the center.
2. The shape, color, and size of KONI’s flag are detailed in
Appendix II, which is an integral and inseparable part of this
constitution.
3. The flag shall be used in all KONI’s events, such as Sport
Meeting, conferences, and Sport Week at National, Provincial,
Regencial/Municipal levels, and appointment of managers.

Section Three
March and Hymn
Article 8

1. KONI’s march entitled “Mars Patriot Olahraga”, composed by


Melky Goeslow, and lyrics by Ichbal Assegaf and Melky
Goeslow.
2. March for National Sports Week entitled “Mars Harapan
Bangsa,” composed by Kamsidi, lyrics by Daljono, and the full
musical score is detailed in Appendix IV, which is an integral
and inseparable part of this constitution.
3. The hymn of KONI entitled “Lagu Pujaan”, composed by Ibu
Sud, lyrics by Dharma, and the full musical score is detailed in
Appendix V, which is an integral and inseparable part of this
constitution.
4. Both the March and Hymn of KONI were sung at official events
of KONI as stipulated in its bylaws.

CHAPTER III
MEMBERSHIP
Section One
Membership
Article 9

1. KONI’s membership is open to every organization of


professional sports that share the objectives as referred to in
its Constitution and Bylaws.
2. The member of KONI consists of:
(a) central organization for sports;
(b) functional sports organization;
(c) provincial KONI
3. Requirements for membership were set out in the Bylaws.

Section Two
Rights and Obligations of Members
Article 10

1. Members have the rights to take part in KONI’s activities and


have the obligations to implement the Constitution and Bylaws
of KONI, as well as the Regulations and decisions stipulated by
KONI.
2. The rights and obligations of members are detailed in the
Bylaws.

Section Three
Loss of Membership Status
Article 11

1. Each member may lose his or her membership status because


of:
(a) resigning;
(b) disbanding; and
(c) dismissed.
2. Losing membership status as stated in paragraph 1 makes
members losing their membership of any level, without any
exception.

CHAPTER IV
ORGANIZATION
Section One
Organization
Article 12

1. The name for KONI at national level shall KONI Pusat, at


provincial level shall be KONI Provinsi, and at
Regencial/Municipal level shall be KONI Kabupaten/Kota,

Appendix VI, which is an integral part of the Constitution and
Bylaws.

Section Two
Working Area
Article 13

1. The working area of Central KONI is the whole territory of the


Republic of Indonesia.
2. The working area of Provincial KONI is the whole territory of
relevant Province/Special Capital Region/Special Region.
3. The working area of Regencial/Municipal KONI is the whole
territory of the concerned Regency/City.
4. The working area of District Coordinator is the whole territory
of the relevant District.

Section Three
Patron
Article 14

1. In carrying out its duties and obligations, KONI Pusat is under


the patronage of the President of the Republic of Indonesia.
2. At provincial level, KONI Provinsi is under the auspice of local
or provincial government.
3. At regencial/municipal level, KONI Kabupaten/Kota is under the
patronage of the Regent or Mayor.

Section Four
Board of Trustees
Article 15

1. To support the implementation of the duties and responsibilities


of the Central KONI, the Board of Trustees is formed whose
members are the Chairman of both public and private
Institutions.
2. Board of Trustees is also established in support for the
implementation of duties and responsibilities of KONI at
provincial, regencial or municipal levels.
3. The provisions as referred to in paragraph 1 and 2 are further
regulated in the Bylaws.

Section Five
Honorary Council
Article 16

1. Honorary Committee is an institution established to provide


consideration to the Chairman in an effort to preserve the
values and philosophy of sport, including sports ethics.
2. Members of Honorary Committee consists of former General
Chairmen, sport personages, and community leaders with their
immense contribution to the development and coaching of both
national and regional sports.
3. In performing its duties, the Honorary Committees an Ad Hoc
committee the membership of which is selected from the
names listed in the Honorary Committee.
4. Honorary Committees were established at national, provincial, and
regencial/municipal levels.
5. The composition and the terms of the Honorary Committee are
further stipulated in the Bylaws.

Section Six
Central Committee of KONI
Article 17

1. Management structure of Central KONI is arranged by the


elected Chairman assisted by the elected formateur based on

the National Sports Council Congress and National Sports
Council Extraordinary Congress.
2. The service period for the manager Central KONI is 4 (four)
years as that of the Chairman’s.
3. A person may serve as Chairman for only two terms.
4. The Central Organizing Committee of KONI consists of:
(a) Leadership
(b) Assistant Head
(c) Implementer
5. The Central Organizing Committee of Indonesian Sports
consists of:
(a) Leadership.
(1) Chairman;
(2) Vice-Chairman:
(3) Secretary-General
(4) General Treasurer
(b) Assistant Head
(1) Deputy Secretary-General
(2) Deputy General Treasurer
(3) Internal Auditor.
(c) Implementer
(1) Head of Division
(2) Deputy Head of Division
(3) Task Force
(d) The elected chairman of central KONI may add deputies,
divisions, and other elements, if necessary.
6. The central organizing committee of KONI shall be obliged to
carry out the duties and functions as specified in the Articles of
its Constitution and Bylaws and to realize every decision of the
National Sports Committee Congress and of Members Meeting
of Central KONI.
7. To carry out the main tasks and functions, the Chairman of
Central KONI can delegate his authority to the executive
director.
8. The details of main tasks and functions of the Central
Organizing Committee of KONI are set forth in its Bylaws.

Section Seven
Committee of Provincial KONI
Article 18

1. The committee of provincial KONI is arranged by the elected


Chairman assisted by the elected formateur based on the
results of Provincial Sports Congress and or Provincial Sports
Extraordinary Congress.
2. Both the Chairman and the Organizing Committee of Provincial
KONI have four years term of office.
3. The Chairman of Provincial KONI can only serve for, at most, 2
terms of office.
4. The Organizing Committee of Provincial KONI consists of:
(a) Leadership
(b) Assistant Head
(c) Implementer
5. The Provincial Organizing Committee of Indonesian Sports
consists of:
(a) Leadership.
(1) Chairman;
(2) Vice-Chairman:
(3) Secretary-General
(4) General Treasurer
(b) Assistant Head
(1) Deputy Secretary-General
(2) Deputy General Treasurer
(3) Internal Auditor.
(c) Implementer
(1) Head of Division
(2) Deputy Head of Division
(3) Task Force
(d) The elected chairman of provincial KONI may add other
elements, if neccessary.
6. The provincial organizing committee of KONI shall be obliged to
carry out the duties and functions as specified in its
Constitution and Bylaws and to realize every decision of the
Provincial Sports Committee Congress and of Members Meeting
of Provincial KONI.

7. The organizing committee of Provincial KONI shall have the
duties and responsibilities to manage its own internal affairs
and sporting activities in its working area, in compliance with
its Constitution and Bylaws, the Decision of National Sports
Committee Congress/ Central KONI Members Meeting / Central
KONI regulations / Decisions of the Chairman of Central KONI,
and the Decision of Provincial Sports Committee Congress /
Provincial KONI Members Meeting.
8. The Organizing Committee of Provincial KONI is arranged in
light of the interests of the concerned region..
9. To carry out the main tasks and functions, the Chairman of
Provincial KONI can delegate his authority to the executive
director.

Section Eight
Regencial/Municipal Committee of KONI
Article 19

1. The committee of Regencial/Municipal KONI is arranged by the


elected Chairman assisted by the elected formateur based on
the results of Regencial/Municipal Sports Congress and or
Regencial/Municipal Sports Extraordinary Conggress.
2. Both the Chairman and the Organizing Committee of
Regencial/Municipal KONI have four years term of office.
3. The Chairman of Regencial/Municipal KONI can only serve for,
at most, 2 terms of office.
4. The Organizing Committee of Regencial/Municipal KONI
consists of:
(a) Leadership
(b) Assistant Head
(c) Implementer
5. The Regencial Organizing Committee of Indonesian Sports
consists of:
(a) Leadership.
(1) Chairman;
(2) Vice-Chairman:
(3) Secretary-General
(4) General Treasurer
(b) Assistant Head

6. The Regencial/Municipal organizing committee of KONI shall be
obliged to carry out the duties and functions as specified in its
Constitution and Bylaws and to realize every decision of the
Regencial/Municipal Sports Committee Congress and of
Members Meeting of Regencial/Municipal KONI.
7. The organizing committee of Regencial/Municipal KONI shall
have the duties and responsibilities to manage its own internal
affairs and sporting activities in its working area, in compliance
with its Constitution and Bylaws, the Decision of National
Sports Committee Congress/ Central KONI Members Meeting /
Central KONI regulations / Decisions of the Chairman of Central
KONI, and the Decision of Provincial Sports Committee
Congress / Provincial KONI Members Meeting, Regulations of
Provincial KONI, Decisions of the Chairman of Provincial KONI,
the decisions of Regencial/Municipal Sports Committee
Congress and Regencial/Municipal KONI member meeting.
8. The Organizing Committee of Regencial/Municipal KONI is
arranged in consideration of the interests of the concerned
region..
9. To carry out the main tasks and functions, the Chairman of
Regencial/Municipal KONI can delegate his authority to the
executive director.

Section Nine
District Coordinator for Sport
Article 20

1. Regencial/Municipal KONI could establish District Coordinator


for Sports in its workiing area.

2. District Coordinators for Sports have their own duties and
functions, and responsible for assisting Regencial/Municipal
KONI in their territory.
3. District Coordinators for Sports are appointed and determined
by Regencial/Municipal KONI.

Section Ten
Committee of Central Organization of Sports and Functional
Sports Body
Members of KONI
Article 21

1. Term of service for the Committee of Central Organization of


Sports and Functional Sports Body, members of KONI is four
(4) years:
2. The Chairman of Central Organization of Sports and Functional
Sport Body, that are members of KONI, is limited to serving
only two full terms.
3. The Committee of Central Organization of Sports and
Functional Sports Body shall be obliged to carry out the main
duties and functions as set forth in the Constitution and Bylaws
of the Committee and Body in question, and all of the decisions
of National Congress and or National Work Meeting.

Section Eleven
Concurrent Position of the Chairman of KONI
Article 22

1. The Chairman, Vice-Chairman, Secretary-General and General


Treasurer of Central KONI are not allowed to hold concurrent
positions in any sport organization, either horizontally or
vertically.
2. The Chairman, Vice-Chairman, Secretary-General and General
Treasurer of Provincial KONI are not allowed to hold concurrent
positions in any sport organization, either horizontally or
vertically.
3. The Chairman, Vice-Chairman, Secretary-General and General
Treasurer of Regencial/Municipal KONI are not allowed to hold

concurrent positions in any sport organization, either
horizontally or vertically.

Section Twelve
Concurrent Position of the Chairman-Member of KONI
Article 23

1. The Chairman, Vice-Chairman, Secretary-General and General


Treasurer of Central Organization of Sport and Functional Sport
Body that are members of Central KONI are not allowed to hold
concurrent positions in any sport organization at provincial
level.
2. The Chairman, Vice-Chairman, Secretary-General and General
Treasurer of Central Organization of Sport and Functional Sport
Body that are members of Central KONI are not allowed to hold
concurrent positions in any sport organization at
regencial/municipal level.

CHAPTER V
CONGRESS AND MEETING
Section One
Congress
Article 24

In KONI organizations, we identify the types and levels of


congresses:

(a) National Sport Committee Congress (Musornas)
(b) Provincial Sport Committee Congress (Musorprov)
(c) Regencial/Municipal Sport Committee Congress

(Musornaslub);
(b) Provincial Sport Committee Extraordinary Congress
(Musorprovlub);

Section Two
National Sport Committe Congress (Musornas)
Article 25

1. Musornas enjoys the supreme power of Central KONI, held


once in four years.
2. Musornas is attended by:
(a) Central Organizing Committee of KONI as a speaker;
(b) Board of Trustees and Honorary Committee;
(c) Representative of each member;
(d) Others
3. Participants, voting rights, legalization, decisions etc,
concerning Musornas and the implementation are set forth in
the Bylaws.
4. Musornas serves to:
(a) establish the rules and the programs;
(b) hold election for the president of the congress by the
participants of Musornas;
(c) select and assign the candidates for the Chairman of
Central KONI;
(d) elect and assign the Chairman of Central KONI, that at
the same time serves as the Leader of Formateur to
prepare the Organizing Committee of Central KONI;
(e) assign two formateurs to advocate the Chairman to
prepare for the Organizing Committee of Central KONI;
(f) elect the leader of BAORI;
(g) authorize the proposal/draft amendments and/or
exceptions to the constitution and bylaws already
approved by Member Conference of Central KONI;
(h) establish the work program and professional sports
coaching for long, medium and short terms;
(i) decide anything relevant to accountability report of
Central Organizing Committe of KONI, both in work report
and financial statement;
(j) propose and establish a venue for the National Sports
Week (PON), six years prior to implementation;

(k) discuss and decide other things deemed necessary in the
light of current needs and development in professional
sports.

Section Three
Provincial Sport Committee Congress (Musorprov)
Article 26

1. Musorprov enjoys the supreme power of Provincial KONI, held


once in four years.
2. Musorprov is attended by:
(a) Central Organizing Committee of KONI as a speaker;
(b) Board of Trustees and Honorary Committee;
(c) Representative of each member in its working area; and
(d) Others
3. Participants, voting rights, legalization, decisions etc,
concerning Musorprov and its implementation are set forth in
the Bylaws.
4. Musorprov serves to:
(a) establish the rules and the programs of Musorprov;
(b) hold election for the president of the congress by the
participants of Musorprov;
(c) elect and assign the Chairman of Provincial KONI, that at
the same time serves as the Leader of Formateur to
prepare the Organizing Committee of Provincial KONI;
(d) assign two formateurs to assist the Chairman to prepare
for the Organizing Committee of Provincial KONI;
(e) establish the work program and professional sports
coaching for long, medium and short terms;
(f) ask and decide anything relevant to accountability report
of Provincial Organizing Committe of KONI, both in work
report and financial statement; and
(g) discuss and decide other things deemed necessary in the
light of current needs and development in professional
sports in provincial KONI.

Regencial/Municipal Sport Committee Congress
(Musorkab/Musorkot)
Article 27

1. Musorkab/kot enjoys the supreme power of


Regencial/Municipal KONI, held once in four years.
2. Musorkab/kot is attended by:
(a) Provincial Organizing Committee of KONI as a speaker;
(b) Board of Trustees and Honorary Committee and the
Organizing Committee of Regencial/Municipal KONI;
(c) Representative of each member in its working area; and
(d) Others
3. Participants, voting rights, legalization, decisions etc,
concerning Musorkab/kot and its implementation are set forth
in the Bylaws.
4. Musorkab/Musorkot serves to:
(a) establish the rules and the programs of
Musorkab/Musorkot;
(b) hold election for the president of the congress by the
participants of Musorkab/Musorkot;
(c) elect and assign the Chairman of Regencial/Municipal
KONI, that at the same time serves as the Leader of
Formateur to prepare the Organizing Committee of
Regencial/Municipal KONI;
(d) assign two formateurs to assist the Chairman to prepare
for the Organizing Committee of Regencial/Municipal
KONI;
(e) establish the work program and professional sports
coaching for long, medium and short terms;

National Sport Committe Extraordinary Congress
(Musornaslub)
Article 28

1. Musornaslub shall be held if the organizing committee of


Central KONI deemed it necessary.
2. Musornaslub can be held upon a written request of at least 2/3
(two thirds) of the members, on condition that the request
mentioned briefly and firmly on the matters to be discussed.
Central Committee of KONI shall organize Musornaslub when
such a request exists.
3. Details of the implementation Musornaslub Procedures shall be
carried out in accordance with the provisions set fort in the
Bylaws.

Section Six
Provincial Sport Committee Extraordinary Congress
(Musorprovlub)
Article 29

1. Musorprovlub shall be held if the organizing committee of


Provincial KONI deemed it necessary.
2. Musorprovlub can be held upon a written request of at least
2/3 (two thirds) of the members, on condition that the request
mentioned briefly and firmly on the matters to be discussed.
Provincial Committee of KONI shall organize Musorprovlub
when such a request exists.

Congress
(Musorkablub/kotlub)
Article 30

1. Musorkablub/kotlub shall be held if the organizing committee of


Regencial/Municipal KONI deemed it necessary.
2. Musorkablub/kotlub can be held upon a written request of at
least 2/3 (two thirds) of the members, on condition that the
request mentioned briefly and firmly on the matters to be
discussed. Regencial/Municipal Committee of KONI shall
organize Musorkablub/kotlub when such a request exists.
3. Details of the implementation Musorkablub/kotlub Procedures
shall be carried out in accordance with the provisions set fort in
the Bylaws.

Meetings
Article 31

1. In KONI’s organizations, we identify types and levels of


meeting:
(a) Member Meeting;
(b) Plenary Meeting;
(c) Management Meeting; and
(d) Coordination and Consultation Meeting.
2. The details on the implementation of Management and Plenary
meetings are set forth in the Bylaws.

Section Nine
Central KONI Member Meeting
Article 32

1. Member Meeting of Central KONI shall be held once a year.


2. The meeting is attended by :
(a) Committee of Central KONI
(b) Member representatives
(c) Other invited participants

exceptions to the provisions of the Constitution and
Bylaws, Rules of Central KONI and or Regulations
concerning National Sports Week;
(b) Request and decide on the report of work program

year;
(c) discuss and decide anything related to Annual Work Plan;
(d) discuss and decide on the issues concerning membership
status;
(e) approve or disprove the application for admission as a
member;
(f) discuss and then verify the draft regulation of National
Sports Week
(g) discuss and then decide on the proposal concerning the
issues related to the terms and procedures of networking,
screening, and selection of candidates for the Chairman of
Central KONI
(h) discuss and then decide on the matters considered as
necessary for the development of professional sport.

Section Ten
Provincial KONI Member Meeting
Article 33

1. Member Meeting of Provincial KONI shall be held once a year.


2. The meeting is attended by :
(a) Committee of Provincial KONI
(b) Member representatives
(c) Other invited participants
3. The member meeting of Provincial KONI is chaired by the
committe of Provincial KONI.

5. Member Meeting of Provincial KONI serves to:

Plan;
(c) discuss and decide on the issues concerning membership
status;
(d) approve or disprove the application for admission as a
member;
(e) discuss and then verify the draft regulation of Provincial
Sports Week (Porprov);
(f) discuss and decide on the venue for the Provincial Sports
Week (Porprov) at least two years prior to the
implementation in case the Provincial Sport Committee
Congress (MusorProv) has not decided yet on this issue;
(g) discuss and decide on the proposal concerning the issues
related to the terms and procedures of networking,
screening, and selection of candidates for the Chairman of
Provincial KONI;
(h) discuss and then decide on the matters considered as
necessary for the development of professional sport.

Section Eleven
Regencial/Municipal KONI Member Meeting
Article 34

1. Regencial/Municipal KONI Member Meeting shall be held once a


year.
2. The meeting is attended by :
(a) Committee of Regencial/Municipal KONI
(b) Member representatives
(c) Other invited participants
3. The member meeting of Regencial/Municipal KONI is chaired
by the committe of Regencial/Municipal KONI.

Coordination and Consultation Meetings
Article 35

1. Coordination and Consultation Meetings are held between KONI


and one or more Members.
2. Coordination and Consultation Meetings can be organized when
the Organizing Committee of KONI and the Board of Trustee
deemed them necessary.

Section One
Sports Week
Article 36

Sports Weeks as coordinated by KONI are as follows:


(a) National Sports Week (Pekan Olahraga Nasional [PON]);
(b) Regional Sports Week (Pekan Olahraga Wilayah [PORWIL]);
(c) Provincial Sports Week (Pekan Olahraga Provinsi [PORPROV]);
(d) Regencial/Municipal Sports Week (Pekan Olahraga Kabupaten/
Kota [PORKAB/PORKOT]); and
(e) Juvenile Sports Week (Pekan Olahraga Nasional Remaja [PON
Remaja])

Section Two
Organizing Other Sport Events
Article 37

1. KONI helps improve the sport achievement of its members by


taking active part in organizing single/multiple events for the
members;
2. Any member who plan to take part/organize single/multiple
events shall coordinate with KONI;
3. Provincial KONI shall coordinate with Central KONI and Central
Organization of Sports in case the former plans to organize
single/multiple events of regional and international standards.

CHAPTER VII
FINANCE
Section One
Finance
Article 38

Organization's financial resources come from:


1. State Budget or Regional Budget;
2. Membership fee;
3. Other voluntary financial contribution;

4. Other legitimate efforts that do not violate the Constitution and
Bylaws as well as applicable government legislation.

Section Two
Assets
Article 39

Organization asset consists of:


1. Cash;
2. Securities;
3. Organizational attribute;
4. Equipment or goods, both movable and immovable.

Intellectual Property Right
Article 40

1. KONI has Intellectual Property Rights.


2. Further provision concerning Intellectual Property Rights will be
set forth in the Bylaws.

CHAPTER VIII
BOARD OF ARBITRATION FOR SPORT
Article 41

1. KONI has established Board of Arbitration for Indonesian


Sports, subsequently abbreviated to BAORI, an institution for
resolving disputes arising from the breach of:
a. Constitution and Bylaws
b. Other regulations stipulated by KONI or its members,
c. Conflict arising from dualism of management
d. Breaches in National Sports Week (as judicature)
e. Other conflicts related to sport organization development.
2. The disputes as referred to in paragraph 1 above are not
allowed to be brought to any court in Indonesia.
3. KONI and its members are bound by the decision of Board
Arbitration for Sport.

Article 42

1. Indonesian Sports Arbitration body is independent in


performing itf function.
2. The term of office for BAORI committee is similar to that of the
Chairman of Central KONI.
3. The leadership of the Indonesian Sport Arbitration body is
decided in Musornas.
4. Recall election within BAORI shall be held when the leader:
a. was permanently incapacitated;
b. resigned; or
c. was unable to perform his or her roles and functions.
5. Recall election as reffered to in paragraph (4) shall be reported
to immediate Central KONI Member Meeting;
6. The Chairman of Central KONI cannot at the same time taking
office as the Chairman of BAORI.
7. The Chairman of Indonesian Sports Arbitration Body shall be
obliged to draw-up and establish the rules of proceedings.
8. The decision of Indonesian Sports Arbitration Body will be final
and binding to the disputed parties in the jurisdiction of the
Republic of Indonesia.

CHAPTER IX
THE BYLAWS
Article 43

a. The Bylaws constitute detailed description and represent the


implementation rules of the Constitution.
b. The matters that insufficiently, or do not yet, regulated in the
Constitution of Association can be set in the Bylaws.
c. The provisions of the Bylaws must not be in conflict with those
of the Constitution of Association.

CHAPTER X
AMENDMENT TO THE CONSTITUTION OF ASSOCIATION
Article 44

1. Amendments and or exceptions to the provisions of the


Constitution can only be authorized by the Musornas and or
Musornaslub.
2. Amendments and or exceptions to the provisions of the
Constitution can only be authorized by the Musornas and or
Musornaslub upon recommendation from the Central KONI
Member Meeting.
3. The amendments and or exceptions can only be authorized by
the Musornas and or Musornaslub if the proposed amendments
and or exceptions approved by at least 2/3 (two thirds) of the
votes present.

CHAPTER XI
DISSOLUTION
Article 45

1. The dissolution of KONI should only be upon approval by Sport


Conference held especially for that purpose.
2. Sport Conference as referred to in paragraph 1 may only be
held upon written request by at least at least 3/4 (three
quarters) of the number of existing members.
3. The Sport Conference as referred to in paragraph 1 is
legitimate if attended by 3/4 (three quarters) of the number of
member representatives, with decisions approved by at least ¾
number of votes present or legitimately represented in the
Conference.

CHAPTER XII
CLOSING
Article 46

1. The first Constitution of KONI has been applicable since its


establishment on December 31, 1966, and such constitution
had been amended and or improved several times.

2. The first amendment or improvement to the Constitution of
KONI had been made by National Sport Conference I in 1967,
held in Jakarta on September 26-30, 1967, in Decision No. 2 of
1967.
3. The second amendment to, or improvement of, the
Constitution of KONI had been made based on the Decision No.
03/MusornasII/1971, of National Sport Conference II in 1971,
held in Jakarta on 17 – 19 December, 1971.
4. The third amendment to, or improvement of, the Constitution
of KONI had been made based upon the Decision of the
Plenary Session of KONI VIII of 1977, approved by the Decree
No. 01/Musornas IV/1981 of National Sport Conference IV in
1981, held in Jakarta on January 19-21, 1981.
5. The fourth amendment or improvement that constitute a
comprehensive amendment to, or improvement of, the
Constitution of KONI had been made based on the Decision No.
02/SPK/1987 of KONI’s Plenary Session XVI, held in Jakarta on
June 27, 1987, upon mandate granted by Decision No.
03/Musornas II/1971 of National Sport Conference V in 1986,
held in Jakarta on March 17-19, 1986.
6. The Fifth Amendment to, or improvement of, the Constitution
of KONI had been made by Improvement Team for KONI’s
Constitution and Bylaws on Wednesday, March 17, 1999 based
on the mandate granted by the Decision No. 04/Musornas/1999
of National Sport Conference VIII 1999, held in Jakarta on
February 22-24, 1999.
7. The sixth amendment to, or improvement of, KONI’s Bylaws
had been prepared by the Team for the Completion of
Constitution and Bylaws of Indonesian National Sports
Committee established by Central KONI for 2003-2007 period,
based on the Decree of the Chairman of Central KONI, No 12.
2004 in conjunction Decree No. 48A of 2004 based on the
mandate granted by Musornaslub 2004, held in Jakarta on
February 18, 2004, based upon the Decree No.
03/MUSORNASLUB/2004, it had been:
(a) discussed and approved by the KONI Member Meeting
2005, held in Jakarta on February 7, 2005, by the
Decision No. 04/RA/2005, February 7, 2005;

(b) discussed and approved by Rapamas KONI XXXI of 2005,
held in Samarinda on February 22, 2005, by the Decision
No. 05/Rapamas/2005, February 22, 2005; and
(c) had been discussed and approved and enacted by KONI’s

2005, held in Samarinda on February 22, 2005, based on
the Decision No. 03/Musomaslub/2005, February 22,
2005.
8. The seventh amendment to, or improvement of, KONI’s
Constitution and Bylaws had been made by Musornaslub in
Jakarta, on Monday, July 30, 2007, based on the Decision of
KONI’s 2007 National Sport Committee Congress No.
05/Musornas/2007, in Jakarta, on February 23, 2007.
9. The eighth amendment to, or improvement of, KONI’s
Constitution and Bylaws had been discussed, approved,
endorsed and enacted by Musornaslub KONI on November 24,
2011, based upon the Decision No. 03/Musornaslub/2011,
November 25, 2011.
10. The ninth amendment to, or improvement of, KONI’s
Constitution and Bylaws had been made in 2013 Musornaslub
KONI in Bandung, on Tuesday, February 19, 2013, based on

INTRODUCTION

This bylaw constitutes the explanation, complimentary, and


guidelines for the implementation of the Constitution of KONI.

CHAPTER I
GENERAL
Section One
Basis
Article 1

The bylaw was prepared on the basis of the Constitution of KONI as


well as the needs and development of the organization.

Section Two
Guidance, Coordination and Supervision
Article 2

1. KONI coaches and coordinates each and every professional


sport activities by planning, managing, fostering and
developing professional sports in Indonesia.
2. In coaching and coordinating as referred to in paragraph 1,
KONI has conducted the following activities:
(a) Guiding and helping each member;
(b) Making decisions and dealing with the problems not yet
resolved by the members;
(c) Serving as manager in planning and organizing Sport
Week;
(d) Lending support for the organizing of international sport
events in Indonesia;
(e) Providing support for members taking part in an
international sport event;
(f) Overseeing all its members from doing activities or actions
that harm the interests of KONI in particular, and of
national sport in general;
(g) Maintaining documentation of each activity of professional
sport appropriately;
(h) Doing measures and or other activities deemed necessary
in view of professional sports development.

3. KONI’s supervisory functions are further stipulated in
organizational regulations validated in Member Meeting.

Foreign Relation
Article 3

1. In carrying out its activities, KONI can build up relationship and


cooperation with international organizations
2. Members of KONI, in carrying out their activities, can build up
relationship and cooperation with international organizations.

Section Four
Providing Assistance to the Government
Article 4

1. To assist the government in formulating, controlling, and


evaluating the policy implementation of professional sports.
2. To foster professional sports in order to raise the dignity of the
nation.

EMBLEM, FLAG, MARCH AND HYMN

Emblem
Article 5

1. KONI’s emblem as detailed in Appendix A has the following


scale:
(a) diameter of main emblem = 8.0 ones.
(b) diameter of Indonesia lettering = 7.0 ones.
(c) distance between main emblem and
Indonesia lettering = 1.0 ones.
2. KONI’s emblem is used on various items, such as:
(a) flag;
(b) signboard;
(c) badge;
(d) epaulet.

3. The use of KONI’s emblem on flags is set forth in Article 8 of
this Bylaws
4. Details on the use of KONI’s emblem as referred to in
paragraph 2 above shall be regulated in the regulation of KONI.

Flag
Article 6

1. The basic color of KONI’s flag is white, with the following


format:
(a) for outdoor : length 300 cm; wide 200 cm.
(b) for indoor : length 135 cm; wide 90 cm.
2. In the center of the flag is KONI’s emblem with the following
format:
(a) for outdoor : length 127 cm; wide 80 cm.
(b) for indoor : length 57 cm; wide 36 cm.
3. The basic color of Provincial and Regencial/Municipal KONI is
white, with KONI’s emblem imbued with lettering that denotes
the respective Province, Regency/Municipality in similar format
as reffered to in paragraph 1 item (a) and (b).
4. The shape and format of Provincial, Regencial/Municipal KONI’s
flag are detailed in Appendices B, C, and D, which are integral
and inseparable parts of this Bylaw.
5. The use of KONI’s flag, member flag, and Regencial/Municipal
KONI’s flag in sport events is further stipulated in the
Organization Regulation.

Section Three
March and Hymn
Article 7

1. The march song is to be sung at the opening and closing


ceremonies of:
(a) Musornas, Musornaslub, and Central KONI Member
Meeting;
(b) Musorprov, Musorprovlub, and Provincial KONI Member
Meeting;
(c) National Conference of KONI Members;

(e) Committee Inauguration.
2. The march song for National Sports Week is to be sung at the

(c) KONI and member anniversary.

Section Four
KONI’s Intellectual Property Rights
Article 8

1. KONI owns intellectual property rights of its emblem, flag,


march, hymn, National Sport Week, and march song for
National Sport Week.
2. Each and every member of KONI is obliged to protect the
intellectual property rights of KONI’s emblem, flag, march,
hymn, National Sport Week, and march for National Sport
Weeks.
3. The right to use of KONI’s emblem, flag, march, hymn,
National Sport Week and march for National Sport Week is
completely belong to KONI, the use of which shall be on
written permission from KONI.
4. All things related to the use of intellectual property rights of
KONI are set forth in the organization regulations.

CHAPTER III
MEMBERSHIP
Section One
Membership
Article 9

1. KONI’s member consists of;


(a) central organization of sports;
(b) functional organization of sports;
(c) provincial KONI.

2. Central organization of sport branches is a sport organization
that coach, develop, and coordinate a branch/type of sport, or
a group of organizations of similar branch or type of sport that
are registered members of their respective international
federation of sport.
3. A functional sport organizations are organizations that manage
sports based expertise, profession, gender, or specialty.
4. Provincial KONIs are organizations whose members are
organization of sports and functional organization of sports at
provincial level, and the Regencial/Municipal KONIs within their
working areas.
5. KONI recognizes only one membership as referred to in
paragraphs 2, 3, and 4.
6. Regencial/Municipal KONIs are organizations whose members
are organizations of sport and functional sport organizations at
Regencial/Municipal level within their respective working areas.

Section Two
Rights and Obligations of Members
Article 10

1. Each member has the right to:


(a) take part in KONI’s activities in compliance with
applicable rules;
(b) take part and to use the right to express opinion in every
Sport Conference and Member Meeting;
(c) elect and to be elected;
(d) ask explanation on KONI’s policies;
(e) use KONI’s emblem and flag;
(f) resign from membership of KONI; and
(g) defend him/herself.
2. Each member is obliged to:
(a) follow each and every provision in the Constitution and
Bylaws, decisions of Sport Congress/Member Meeting,
regulations and decisions of KONI;
(b) support every KONI’s activity;
(c) pay membership fee in amount specified in Member
Meeting;

(d) carry out activities regularly in accord with the
Constitution and Bylaws.;
(e) regularly submit reports on any activity to KONI;
(f) send a representative to partake in Sport Conference,
Member Meeting, and other activities related to the
development of professional sports.
3. Every Central Organization of a Sport Branch is obliged to hold
national sport event of their respective sport branch at least
once a year.
4. Every Provincial KONI is obliged to hold Provincial Sport Week
at least once in four years.

Section Three
Conditions for Membership
Article 11

1. To be accepted as a member, a central organization of a sport


branch must comply with the following conditions:
(a) Having a constitution and bylaws that is not contradictory
with the regulations and provisions in KONI’s;
(b) Having the deed of incorporation, tax ID and valid
secretariat address;
(c) Having members of at least 10 provincial committees,
each of which having at least two regencial/municipal
committees who take active part in sport coaching with
written recommendation from Provincial KONI;
(d) Had constructed and coordinated one sport branch
consisting of one or more types of sport;
(e) Had organized National Events for at least four times in a
row, with the participants of the last 2 National Events
numbered at least 10 members;
(f) Had submitted application for recognition or for becoming
permanent member of International Sports Federation;
and
(g) Had been contested in multiple events recognized by
IOC, OCA and SEAG Federation.
2. Every regencial/municipal committee as referred to in
paragraph 1 item (c) has at least 2
branch/association/camp/dojo/club committees each, complete

with actual function as proved by written recommendation from
Regencial/Municipal KONI’s committee.
3. To be accepted as a member, functional sports organization
must fulfill the requirements as referred to in paragraph 1
items (d), (e), and (f).
4. To be accepted as a member, Provincial KONI must fulfill the
following membership requirements:
(a) Official report of Provincial KONI establishment, attended
by two third of provincial organization of sport branch
and at least 2 (two) Regencial/Municipal KONI
committees;
(b) Recommendation from governor;
(c) Establishment of Provincial, Regencial/Municipal KONI is
stipulated in KONI’s regulations.

Section Four
Application Procedures for Membership
Article 12

1. Prospective members must submit an application to the


Chairman of KONI, with attached documents as stipulated in
Article 11, in accordance with the type of membership
2. The Chairman of KONI is obliged to examine the completeness
of the application. When all the requirements as stipulated in
Article 11 have been met, the applicant athletic organization is
designated as a candidate member.
3. The Chairman of KONI is obliged to notify the applicants
regarding whether or not they are accepted as members no
later than 60 days from the date of receipt of the application.
4. The Chairman must submit prospective members as referred to
in paragraph 2 in the upcoming Member Meetings.

Section Five
Member Admission Procedures
Article 13

1. KONI proposes candidates to be decided in the Member


Meeting;

2. Member meeting decides whether or not the candidates will be
approved as members based on the approval of at least 50% +
1 present members.
3. Member Meeting decision about the approval or disapproval of
candidate members as referred to in paragraph 2 is submitted
in a written form by the Chairman of KONI to the individual
concerned, and the copy is given to
(a) all KONI members;
(b) relevant parties.
4. Regarding the recently approved membership for Provincial
KONI recommended by the concerned Governor, the
ratification procedures refer to the provisions in paragraphs 1,
2, and 3 of this article.

Section Six
Loss of Membership Status
Article 14

1. If the duties and conditions as a members are no longer met as


required in articles 2, 3, and 4, and the condition for
membership as stipulated in article 11 paragraph 1, letters a,
b, c, d, f, and g, then Member Meeting can decide on the loss
of membership following 3 times of written warning notices
from the Chairman of KONI.
2. The loss of membership as referred to in article 1 lead to the
loss of rights and obligations as a member.
3. Termination of membership status based on the Decision of
Member Meeting is officially notified by the Chairman of KONI
to the individual concerned no later than 14 days from the date
of decision, and the copy of the decree is distributed to:
(a) the whole KONI members;
(b) the party concerned.
4. To restore membership status, the individual concerned needs
to fulfill the member admission procedures as regulated in
Article 11 of current Bylaws.

Section Seven
Lay-off
Article 15

1. To members who violate one or more provisions in the


Constitution and Bylaws, KONI has the right to lay them off.
2. The procedure of lay-off as referred to in paragraph 1, include
the warning for three times in written forms.
3. Upon receiving the third warning, the members in question
can, in a period of three months, defend him or herself before
the Plenary Meeting of KONI’s held especially for this purpose.
In case the member in question decided not to use his or her
right to defend, KONI is entitled to issue a lay-off notice.
4. Upon receiving a written request for defense from the member,
if KONI had not held a Plenary Meeting for that purpose in the
period of 3 months, the earlier notice is considered void.
5. The lay-off shall be reported to the upcoming Member Meeting
to be considered and decided upon membership status.
6. The lay-off is valid only for 12 months at most, and in case of
no follow-ups from KONI, the lay-off notice will be
automatically void.

Section Eight
Lay-off Notice Issued by Provincial, Regencial/Municipal
KONI
Article 16

1. Lay-off notice issued by Provincial KONI.


(a) To members who violate one or more provisions in the
Constitution and Bylaws, Provincial KONI has the right to
lay them off;
(b) The procedure of lay-off as referred to in paragraph 1
item (a), include warnings for three times in written
forms;
(c) Upon receiving the third warning, the members in
question can, in a period of three months, defend him or
herself before the Plenary Meeting of Provincial KONI
held especially for that purpose. In case the member in

Section Nine
Defense and Restoration
Article 17

1. A member being laid-off by the Chairman of Central KONI may


file a lay-off self-defense befor the Central KONI Member
Meeting. In case the self-defense is approved, membership
status could be restored.
2. The member being laid-off by the Chairman of Provincial KONI
may request for restoration before the Provincial KONI Member
Meeting. In case the lay-off self-defense is approved,
membership status could be restored.
3. The member being laid-off by the Chairman of
Regencyal/Municipal KONI may request for restoration before
the Regencial/Muncipal KONI Member Meeting. In case the lay-
off self-defense is approved, membership status could be
restored.

CHAPTER IV
ORGANIZATION
Section One
Central KONI’s Board of Trustees
Article 18

1. Members of Central KONI’s Board of Trustees consist of public


officials, community leaders, and national entrepreneurs
considered as capable of significant support, either morally or
materially, for the advancement of sports.
2. Term of office for the members of Central KONI’s Board of
Trustees is four years as that of the Chairman elected and
inaugurated in Musornas (National Sport Congress) and can be
reelected for the next immediate term of office.
3. Minister for people’s welfare, minister for sports, and minister
for education can, ex-officio, become the Chairman and Vice-
Chairman of Central KONI’s Board of Trustees.

4. Secretary General of Central KONI can, ex-officio, become the
Secretary to the Board of Trustees.
5. The chairman, assisted by vice chairman and the secretary,
coordinate every duties and authorities of Central KONI’s Board
of Trustees.
6. Duties and Authority of Central KONI’s Board of Trustees are:
(a) To support the implementation of event and financial
agendas of Central KONI;
(b) To contribute suggestions and considerations to the
committee of Central KONI; and
(c) To help, maintain, and build favorable relationship
between the community, government, and other parties.
7. In carrying out its duties and obligations, the Board of Trustee
is periodically held a coordination and consultation meeting
with the committee of Central KONI.
8. Board of Trustee shall be invited in every official event
organized by Central KONI, such as Musornas and Member
Meeting of Centra KONI.

Section Two
Provincial KONI’s Board of Trustees
Article 19

1. Members of Provincial KONI’s Board of Trustees are elected


and inaugurated in Musorprov for 4 years term of office, as
that of elected Chairman. Those members consist of a
Chairman, Vice-Chairman, and members.
2. Secretary General to Provincial KONI can, ex-officio, become
the Secretary of Provincial Board of Trustees.
3. The chairman, assisted by vice chairman and the secretary,
coordinate every duties and authorities of Provincial KONI’s
Board of Trustees.
4. Members of Board of Trustees can be reelected for the next
term of office.
5. Duties and Authority of Provincial KONI’s Board of Trustees
are:
(a) To support the implementation of event and financial
agendas of provincial KONI;

1. Members of Regencial/Municipal KONI’s Board of Trustees are


elected and inaugurated in Musorkab/Musorkot for 4 years
term of office. Those members consist of a Chairman, Vice-
Chairman, and members.
2. Secretary General to Regencial/municipal KONI can, ex-officio,
become the Secretary of Regencial/Municipal Board of
Trustees.
3. The chairman, assisted by vice chairman and the secretary,
coordinate every duties and authorities of Regencial/Municipal
KONI’s Board of Trustees.
4. Members of Board of Trustees can be reelected for the next
term of office.
5. Duties and Authority of Regencial/Municipal KONI’s Board of
Trustees are:
(a) To support the implementation of event and financial
agendas of regencial/municipal KONI;

the development and construction of both national and regional

2. Membership in Central KONI’s Honorary Committee is, as the
name suggests, honorary in nature, proposed and inaugurated
in Musornas.
3. The membership for former Chairmen of Central KONI is valid
for a life time.
4. Members of Central KONI’s Honorary Committee shall be
invited in any event held by Central KONI, such as Musornas,
Member Meeting, and National Sport Week.
5. Functions and duties of Honorary Committee are determined by
the decision of the Chairman of Central KONI.

Section Five
Provincial KONI’s Honorary Committee
Article 22

1. Chairman
(a) Serving as a person with an utmost responsibility for
leading the KONI organization;
(b) Formulate common policies in coaching and developing
professional sports;
(c) Coordinating the implementation of coaching and
development of professional sports that subsequently
executed by members;
(d) Acting for and on behalf of KONI, both inside and
outside the court;
(e) Responsible for and make sure that all approved
decisions of Sports Conference, Member Meeting,
Plenary Meeting, and Event Agenda are properly
implemented; and
(f) Accountable to Sport Congress for the tasks he had
executed.
2. Deputy Chairman
(a) Assist the Chairman in performing his duties;
(b) Represents the Chairman in the latter's absence;
(c) Perform other related duties assigned by the Chairman;
(d) Accountable to the Chairman for the duties he had
performed.
3. Secretary General
(a) Represents the Chairman and Deputy Chairman in their
absence;
(b) Coordinating, directing, and responsible for, the
activities at KONI Secretariat;

KONI secretariat;
(d) Carry out administrative, personnel development, material
improvement, and KONI’s internal activities;

(g) Preparing and organizing of Sport Conference and
Member Meeting;
(h) Taking part as a mentor and speaker in every Sport
Conference and Member Meeting;

(k) Accountable to the Chairman for the duties

4. Treasurer
(a) Implement general policies and Chairman’s policies in
financial affairs, financial treasury and budget based on
applicable legislation;
(b) Coordinating the implementation of approved income
and expenditure budget;
(c) Responsible for accounting, verification, and expenses in
accordance with applicable regulations
(d) Responsible for the preparation of periodic financial
statements
(e) Taking part as a mentor and speaker in every Sport
Conference and Member Meeting
(f) Assisted by assistant treasurer in carrying out the duties;

5. Division of Sporting Achievement Improvement
(a) Assists the Chairman in sporting achievement
improvement;
(b) Drafting the sporting achievement improvement program,
including toward multi-event international program,
training center, early childhood sport development, and
coaching program for Sport Week events in coordination
with KONI;

program for members;
(d) Executes KONI’s organizational development program;
(e) Monitors and assists the implementation of
organizational development program for members;
(f) Coordinating the implementation of Sport Conference
and Member Meeting;
(g) Providing guidance for the implementation of sport
conference and member meeting;
(h) Periodically preparing report on organizational
development;
(i) Serving as a speaker on a topic of organizational

organization program for members;
(d) Executes education and upgrading program for KONI;
(e) Monitors and assists in the execution of education and
upgrading program for members;
(f) Assists in the execution of education and upgrading
program in training centers;
(g) Provides guidance for education and upgrading in Sport
Week event held by KONI;
(h) Preparing periodical report on education and upgrading

(i) Serving as a speaker on a topic of education and
upgrading division in every sport conference and

and KONI’s Science and Technology, including the
publishing of IPTEK Olahraga Dunia journal, seminar on
IPTEK Olahraga, in collaboration with Sport Science and
Technologi (IPTEK Olahraga) divisions;

KONI’s data, including data collection and processing to
support the procurement, governance, maintenance,
utilization, and inspection of software and hardware in
an effort to optimize the activities implementation to
improve the performance of KONI;
(c) Assists in drafting the data collection and management
program for members;
(d) Executes data collection and management program for
KONI’s data;
(e) Monitors and assists in the execution of data collection
and management program for members;
(f) Periodically preparing report on data collection and

various disciplines appropriate for improvement of sport
achievement;

program for members;
(d) Executes the research and development program for
KONI;
(e) Conducting research on sports in an effort to improve
and develop national sport achievement and,
subsequently, disseminate the results to members;
(f) Monitors and assists in the execution of research and
development program for members;
(g) Periodically preparing report on research and
development;
(h) Serving as a speaker on a topic of research and
development in every sport conference and member
meeting;
(i) Carrying out other tasks assigned by the Chairman;
(j) Get assistance from Deputy Head of Research and
Development division in carrying out the tasks and

11. Division of Program Planning and Budgeting
(a) Assists the Chairman in planning and budgeting;
(b) Drafts the working and budgeting programs for KONI, in
addition to coordination in devising ToR of activities,
KONI’s organizational work plan for short- and long-

budget submitted to relevant government agency;
(c) Assists in planning and budgeting program for members;

budgeting program;
(g) Serving as a speaker on a topic of planning and
budgeting program in every sport conference and
member meeting;
(h) Carrying out other relevant tasks assigned by the
Chairman;
(i) Assisted by Deputy Head of Planning and Budgeting
Division in executing tasks; and
(j) Accountable to the Chairman for the tasks executed.
12. Division of Resource Mobilization
(a) Assist the Chairman in resource mobilization;
(b) Drafting the Resource Mobilization Program for KONI,
identifying agencies, instances, and companies potential
as financing sources, preparing promotional and
marketing programs, exploring the rights to use KONI’s
attribute, and establishing a long term cooperation with
the financial sources;
(c) Assists in the drafting of Resource Mobilization Program
for members;
(d) Executes KONI’s Resource Mobilization Program;
(e) Evaluates staff as resource for the purpose of improving
organizational performance;
(f) Monitors and assists the execution of Resource
Mobilization program for members;
(g) Periodically preparing report on Resource Mobilization
Division;
(h) Serving as a speaker on a topic of Resource Mobilization
in every sport conference and member meeting;
(i) Carrying out other tasks assigned by the Chairman;
(j) Getting assistance from Deputy Head of Resource
Mobilization Division for carrying out tasks and

(a) Assists the Chairman in media and public relations
affairs;

KONI, establish cooperation with various media, both

various communication media, and dissemination of
KONI news periodically;
(c) Assists in drafting media and public relations program
for members;
(d) Executes media and public relation programs related to
KONI;
(e) Monitors and assist in the execution of media and public
relations program for members;
(f) Preparing reports on media and public relations program
periodically;
(g) Serving as a speaker on a topic of media and public
relations in every sport conference and member
meeting;
(h) Performs other related duties as assigned by the
Chairman;
(i) Assisted by Deputy Head of Organizational Development
in carrying out the duties and obligations; and
(j) Accountable to the Chairman for the duties carried out.
14. Division of Welfare for Sport People
(a) Assists the Chairman in any affairs related to welfare for
the people of sports;
(b) Drafting the welfare program for KONI’s sport people,
recommends and coordinates the data collection on high
achievers in sport;
(c) Conducting verification and selection of data on sport
people recommended for awards;
(d) Assists in drafting welfare for sport people program for
members;
(e) Executes the program of welfare for KONI’s sport
people;
(f) Monitors and assists in the execution of welfare for sport
people program for members;

(h) Serves as a speaker on topic of welfare for sport people

15. Division of Sport Law Education
(a) Assists the Chairman in education related to sport law;
(b) Drafting the sport law education program for KONI,
including dispute resolution with parties external to
KONI, provide guidance in writing up a good work
contract, MOU and other legal agreement;
(c) Assists in drafting the sport law education program for
members;
(d) Executes sport law eduction program for KONI;
(e) Monitors and assists in the implementation of sport law
education program for members;
(f) Partakes in Validity Committee in Sport Week event,
organized or coordinated by KONI;
(g) Periodically preparing reports on sport law education;
(h) Serves as a speaker on a topic of sport law education in
every sport conference and member meeting;’
(i) Performs other related tasks assigned by the Chairman;
(j) Get assistance from Deputy Head of Sport Law
Education division in carrying out duties and obligations;
and
(k) Accountable to the Chairman for the tasks executed.
16. Division of General Affairs
(a) Assists the Chairman in general affairs;
(b) Drafting the program for KONI general affairs, including
enforcement, augmentation, utilization, maintenance,
governance, protection and partnership cooperation in
utilizing various assets of KONI in an effort to describe
and implement KONI’s Program and Activities;
(c) Carrying out activities not accommodated by primary
tasks and functions of other division in an effort to
support KONI’s primary tasks and functions;

(d) Assist in drafting the program of general affairs for
members;
(e) Implementing General Affairs Program for KONI;
(f) Monitors and assists in the execution of General Affairs
Program for members;
(g) Periodically preparing reports on general affairs;
(h) Serves as a speaker on the topic of general affairs in
every sport conference and member meeting;
(i) Performs other duties assigned by the Chairman.
(i) Get assistance from Deputy Head of General Affairs
Division in carrying out tasks and obligation; and
(k) Accountable to the Chairman for the tasks executed.
17. Division of Domestic and Overseas Cooperations
(a) Assist the Chairman in domestic and overseas
cooperation;
(b) Drafting the domestic and overseas cooperation program,
including cooperation with domestic and overseas
institutions, agencies and companies, cooperation with
universities, sport organizations in neighboring countries,
domestic and overseas public institution, and
international bodies;
(c) Assists in drafting the program of domestic and overseas
cooperation for members;
(d) Executes domestic and overseas cooperation program;
(e) Monitors and assists in the implementation of domestic
and overseas cooperation program for members;
(f) Preparing reports on domestic and overseas cooperation
periodically;
(g) Serving as a speaker on a topic of domestic and
overseas cooperation in every sport conference and
member meeting;
(h) Executes other relevant tasks assigned by the Chairman.
(i) Gets assistance from Deputy Head of Domestic and
Overseas Cooperation Division in carrying out the duties
and obligations;
(j) Accountable to the Chairman for the completed tasks

18. Internal Auditor
(a) Assists the Chairman of KONI in internal supervision of
all activities related to KONI’s financial affairs, both
revenue and expenditure, or programs financed by
KONI;
(b) In performing his or her duties, the Internal Auditor
must comply with the Indonesian accounting principles
and relevant legislations;
(c) Periodically examine KONI’s financial statements,
monthly and annually, and report them to the Chairman;
(d) Submits report, provides suggestion, and consideration
to KONI’s Chairman on anything related to his/her
duties;
(e) The number of KONI’s internal auditor is determined by
the Chairman;
(f) KONI’s internal auditors are directly accountable to the
Chairman; and
(g) Other things relevant to primary tasks and functions of
internal auditor not covered by this paragraph shall be
decided by the Chairman of KONI.
19. Primary tasks and functions of the Chairman and deputy
chairman as well as those of implementers not yet regulated in
the constitution and bylaws will further be regulated in KONI’s
regulations.

Section Nine
Operational Mechanism of Management Task Execution
Article 26

Operational Mechanism of Management Task Execution is in


pursuant to the rules and or decision of KONI.

Section Ten
The Eligibility Criteria for Chairman and Committee of KONI
Article 27

1. Criteria for Chairman


(a) Having managerial skill, dedication, and sufficient time
to manage sport organization;

(b) Capable of being a protector and a unifying agent of the
whole sport community;
(c) Have a far-reaching vision in developing professional
sports;
(d) Able to collaborate with corporations and relevant
agencies to support the development of professional
sports;
(e) Capable of collaborating with regional and international
sport bodies.
2. Criteria for Committee
(a) Able to collaborate with the Chairman and other
members of committee;
(b) Have the managerial skills, dedication and sufficient time
to manage sports organization;
(c) Able to describe the outline of the Chairman’s policies;
(d) Have the ability and competency in their respective
fields;
(e) Have the knowledge and capable of coordinating for the
purpose of improving the organizational and
administrative system of sports.

Section Eleven
Recall Election
Article 28

1. A committee member may be recalled by the Chairman of KONI


for his or her inability to perform the tasks properly.
2. Recall election in Provincial KONI shall be confirmed by Central
KONI, and Regencial/Municipal KONI shall be confirmed by
Provincial KONI.
3. In the event that the Chairman is permanently unavailable for
his duties, plenary session of the committee may propose the
appointment of acting Chairman of KONI from the Deputy
Chairman for the period until the upcoming Extraordinary
Congress of Sports.

Section Twelve
Acting Official
Article 29

1. The Chairman, for some legitimate reasons, entitled to appoint


a Deputy Chairman as an Acting Official, in this case an Acting
Chairman..
2. The primary duty of an Acting Chairman is to take the over role
of a Chairman.
3. An Acting Chairman, as referred to in paragraphs 1 and 2 of
this article, has a term of office no longer than 6 (six) month
and cannot be extended.
4. When the term of office as referred to in paragraph 3 of this
artice expired, an Extraordinary Congress of Sport must be
held.
5. Further provision concerning Acting Officials is stipulated in
KONI’s Organizational Regulation.

Section Thirteen
Caretaker (Interim Officer)
Article 30

1. An Interim Officer or Caretaker is appointed if:


(a) A member organization of KONI at a central, provincial,
and regencial/municipal level has not been established.
(b) Sport Congress has not been held.
2. The primary task of the interim officer (caretaker) is to hold
Extraordinary Sport Congress.
3. The interim officer is appointed and confirmed by Central KONI
for provincial level, and by Provincial KONI for
Regencial/Municipal level.
4. Further provision concerning Interim Officials (Caretakers) is
stipulated in KONI’s Organizational Regulation.

Section Fourteen
Consolidation and Appointment
Article 31

1. Consolidation and inauguration of members shall be conducted


by the committee (of KONI).
2. Members with terms of office expired in the next six months
and have not been confirmed with a decree, will lose their
membership pursuant to Article 10 paragraph 1 of the current
bylaws.
3. Central organizing committees of sport branch and functional
sport organization are obliged to consolidate the structure of
organizational committee of sport at a provincial level and
functional sport organization at a provincial level after a written
recommendation from the Chairman of Provincial KONI.
4. The organizing committee of sport branch and functional sport
organization at a provincial level are obliged to consolidate the
structure of organizational committee of sport branch and
functional sport organization at a regencial/municipal level after
a written recommendation from the Chairman of
Regencial/Municipal KONI.
5. The procedure for consolidation and inauguration of members
is stipulated in KONI’s regulation.

Section Fifteen
Organizational Sanction
Article 32

1. Committee of central organization of sport branch and


functional sport organization of Provincial KONI whose terms of
office expired more than six months earlier, or have not been
consolidated in pursuant to article 31, lose their right and,
therefore, not allowed to partake in each and every KONI’s
events, such as Musornas, Member Meeting of Central KONI,
and National Sport Week.
2. Organizing Committees of sport branch and functional sport
organization at a provincial level whose term of office expired
more than six months earlier or have not been consolidated,
lose their membership rights and, therefore, not allowed to

take part in each and every events of Provincial KONI, such as
Musorprov, Provincial KONI’s member meeting, and Provincial
Sport Week.
3. Organizing committees of sport branch and functional sport
organization at a regencial/municipal level whose term of office
expired in more than 6 months earlier or have not been
consolidated, lose their membership rights and, therefore, not
allowed to take parti in each and every event of
Regencial/Municipal KONI, such as Musorkab/MNusorkot,
Regencial KONI Member Meeting, and Regencial/Municipal
Sport Week.
4. Organizing Committees of sport branch and functional sport
organization at a provincial level who had already consolidated
by central committee without any recommendation set fort in
article 31, paragraph 2 above, lose their membership rights.
5. Organizing committees of sport branch and functional sport
organization at a regencial/municipal level who had already
consolidated by provincial committee without any
recommendation as stipulated in article 31, paragraph 3, lose
their membership right.
6. Organizing Committees of sport branch and functional sport
organization at a provincial and or regencial/municipal level
who had already consolidated by the central organizing
committee of sport, functional sport organization and or
provincial committee can be inaugurated by provincial and/or
regencial/municipal KONI if appointment has not been made
within six months.
7. Organizational sanctions imposed on central organizing
committee of sport branch and on functional sport organization
have no binding efficacy on provincial and regencial/municipal
organizing committees.
8. Organizational sanctions imposed on provincial organizing
committee of sport branch and on functional sport organization
have no binding efficacy on regencial/municipal organizing
committees in their respective working area.
9. KONI may take over the functions of member committees when
there exist managerial conflicts that interfere with
organizational functions.

Section Sixteen

Organizing Committee
Article 33

KONI’s provincial organizing committee whose term of office expired


more than six (6) months earlier, or has not been inaugurated in
pursuant to article 32, paragraph 2, lose their rights and, therefore,
not allowed to take part in each and every events of Central KONI,
such as Musornas, Central KONI Member Meeting, and National
Sport Week.

Section Seventeen
Organizational Sanctions Imposed on KONI’s Regencial/
Municipal Organizing Committee
Article 34

KONI’s regencial/municipal organizing committees whose term of


office expired more than six (6) months earlier, or have not been
inaugurated in pursuant to article 32, paragraph 2, lose their rights
and, therefore, not allowed to take part in each and every events of
Provincial KONI, such as Musorprov, Provincial KONI Member
Meeting, and Provincial Sport Week.

CHAPTER V
CONGRESS AND MEETING
Section One
Congress
Article 35

1. National Sports Committee Congress (Musornas).


(a) Voting Rights and Number of Representatives:
(i) Each member is entitled to 1 (one) vote in
Musornas;
(ii) Each member is entitled to send representatives in
accordance with the number of commission set fort
by the committee;
(iii) Each member subjected to organizational sanction,
that is lay-off, loses his or her right to speak;

(iv) Every invited agency or organization entitled to send
1 person as an observer who has neither right to
vote nor right to speak;
(v) An outgoing committee of Central KONI has 1 vote.
(b) Place and Notice
(i) Notification concerning Musornas is delivered in a
written form and send, to each member entitled to
take part in Musornas, no later than 30 calendar
days prior to the congress;
(ii) Written materials to be discussed and decided in the
Musornas shall be delivered to each and every
participants entitled to take part, as referred to in
paragraph 1, item (a), no latter than 14 calendar
days prior to Musornas;
(c) Quorum
(i) Musornas obtained a quorum if attended by at least
2/3 of invited members.
(ii) If a quorum as referred to in paragraph 1, item (c),
point (i) above cannot be met, thus Musornas will be
suspended for not less than 60 minutes, to give
opportunity for representative who are late to come.
If, after 60 minute suspension, the quorum is still
not met, Musornas declared valid and can proceed.
(d) Leadership
(i) Musornas is led by a leadership elected by Musornas
participants. The leadership consists of 5 elements:
1 Congress leader, 3 assistant leaders and 1
secretary;
(ii) Musornas Leadership consists of 3 persons: 1
representing central/functional organizing committee
of sport and 2 representing Provincial KONI;
(iii) As long as Musornas leadership as referred to in
paragraph 1, item (d), point (i), has not been
elected, Musornas will temporarily be led by the
Chairman of Central KONI assigned to certify the
rules and regulations and to elect Musornas leader.
(e) Decision
(i) Every Musornas decision is made through
consultation to reach consensus. If consensus has

not been reached, decision is made through voting
and that a decision is legitimate if approved by 50%
+1 of valid votes;
(ii) Voting shall be conducted to achieve a valid decision
(50% + 1 of valid votes).
2. Provincial Sports Committee Congress (Musorprov).
(a) Voting Rights and Number of Representatives:
(i) Each member is entitled to 1 (one) vote in
Musorprov;
(ii) Each member is entitled to send 3 representatives to
take part in Musorprov;
(iii) Each member subjected to organizational sanction,
that is lay-off, loses his or her right to speak;
(iv) Every invited agency or organization entitled to send
1 person as an observer who has neither right to
vote nor right to speak;
(v) An outgoing committee of Central KONI has 1 vote.
(vi) Central KONI has 1 voting right.
(b) Place and Notice
(i) Notification concerning Musorprov is delivered in a
written form and sent to each member entitled to
take part in Musorprov, no later than 21 calendar
days prior to the congress;
(ii) Written materials to be discussed and decided in the
Musorprov shall be delivered to each and every
participants entitled to take part, as referred to in
paragraph 2, item (a), no latter than 14 calendar
days prior to Musorprov;
(c) Quorum
(i) Musorprov obtained a quorum if attended by at least
2/3 of invited members.
(ii) If a quorum as referred to in paragraph 2, item (c),
point (i) above cannot be met, thus Musorprov will
be suspended for not less than 60 minutes, to give
opportunity for representative who are late to come.
If, after 60 minute suspension, the quorum is still

Chairman of Provincial KONI assigned to certify the
rules and regulations and to elect Musorprov leader.
(e) Decision
(i) Every Musorprov decision is made through
consultation to reach consensus. If consensus has
not been reached, decision is made through voting
and that a decision is legitimate if approved by 50%
+1 of valid votes;
(ii) Voting shall be conducted to achieve a valid decision
(50% + 1 of valid votes).
3. Regencial/Municipal Sports Committee Congress
(Musorkab/Musorkot).
(a) Voting Rights and Number of Representatives:
(i) Each member is entitled to 1 (one) vote in
Musorkab/Musorkot;
(ii) Each member is entitled to send 3 representatives to
take part in Musorkab/Musorkot;
(iii) Each member subjected to organizational sanction,
that is lay-off, loses his or her right to speak;
(iv) Every invited agency or organization is entitled to
send 1 person as an observer who has neither right
to vote nor right to speak;
(v) An outgoing committee of Regencial/Municipal KONI
has 1 vote.
(vi) Provincial KONI has 1 voting right.
(b) Place and Notice
(i) Notification concerning Musorkab/Musorkot is
delivered in a written form and sent to each member

entitled to take part in Musorkab/Musorkot, no later
than 14 calendar days prior to the congress;
(ii) Written materials to be discussed and decided in the
Musorkab/Mursokot shall be delivered to each and
every participants entitled to take part, as referred

7 calendar days prior to Musorkab/Musorkot;
(c) Quorum
(i) Musorkab/Musorkot obtained a quorum if attended
by at least 2/3 of invited members.
(ii) If a quorum as referred to in paragraph 3, item (c),
point (i) above cannot be met, thus
Musorkab/Musorkot will be suspended for not less
than 60 minutes, to give opportunity for
representative who are late to come. If, after 60
minute suspension, the quorum is still not met,
Musorkab/Musorkot declared valid and can proceed.
(d) Leadership
(i) Musorkab/Musorkot is led by a leadership elected by
Musorkab/Musorkot participants. The leadership
consists of 5 elements: 1 Congress leader, 3
assistant leaders and 1 secretary;
(ii) Musorkab/Musorkot Leadership consists of 3
persons: 1 representing regencial organizing
committee of sport and 2 representing
Regencial/Municipal KONI;
(iii) As long as Musorkab/Musorkot leadership as
referred to in paragraph 3, item (d), point (i), has
not been elected, Musornas will temporarily be led
by the Chairman of Regencial/Municipal KONI
assigned to certify the rules and regulations and to
elect Musorkab/Musorkot leader.
(e) Decision
(i) Every Musorkab/Musorkot decision is made through
consultation to reach consensus. If consensus has
not been reached, decision is made through voting
and that a decision is legitimate if approved by 50%
+1 of valid votes;

4. If the year of Sport Conference is in coincidence with the event
of Sport Week, the Conference can be suspended for no later
than 3 months after the event.

Section Two
Extraordinary Congress
Article 36

1. Extraordinary National Sport Congress (Musornaslub)


(a) Musornaslub can be held if:
(i) It is mandated by Musornas or Member Meeting;
(ii) The Chairman is permanently unavailable;
(iii) Central KONI deem it necessary by explicitly and
concisely stated the reasons to hold the
Musornaslub;
(iv) On a written request from at least 2/3 of total
members.
(b) Musornaslub is organized by central organizing
committee of KONI;
(c) If within the next 30 days the Central KONI did not hold
the Musornaslub as referred to in item (a) (iv), the
proposing Members can hold the Musornaslub;
(d) The voting right in Musornaslub is similar to that of
Musornas as referred to in Article 35, paragraph 1, item
(a) above;
(e) The number of representative is adapted to the agenda
and the needs of Musornaslub;
(f) Musornaslub whose agenda is not to discuss managerial
issues is led by central organizing committee of KONI
and member of KONI that consist of 5 persons: 1
Leader, 3 Deputy Leader, and 1 Secretary;
(g) As long as Musornaslub Leader as referred to in
paragraph 1, item (f) above has not been elected, the
Musornaslub is temporarily led by the Chairman of
Central KONI assigned to certify the rule and regulations
and the Event, as well as to elect the leader of
Musornaslub; and

(h) Provision concerning the procedure for quorum
announcement and decision making are similar to those
for Musornas as stipulated in Article 35, paragraph 1,
items (b), (c) and (e).
2. Extraordinary Provincial Sport Congress (Musorprovlub)

(i) It is mandated by Musorprovlub or Provincial KONI
Member Meeting;
(ii) The Chairman is permanently unavailable;
(iii) Provincial KONI deem it necessary by explicitly and
concisely stated the reasons to hold the
Musorprovlub;
(iv) On a written request from at least 2/3 of total
members.
(b) Musorprovlub is organized by provincial organizing
committee of KONI;
(c) If within the next 30 days the Provincial KONI did not
hold the Musorprovlub as referred to in item (a) (iv), the
proposing Members can hold the Musorprovlub;
(d) The voting right in Musorprovlub is similar to that of
Musorprov as referred to in Article 35, paragraph 2,
item (a) above;
(e) The number of representative is adapted to the agenda
and the needs of Musorprovlub;
(f) Musorprovlub whose agenda is not to discuss managerial
issues is led by provincial organizing committee of KONI
and member of KONI that consist of 5 persons: 1
Leader, 3 Deputy Leaders, and 1 Secretary;
(g) As far as Musornaslub Leader as referred to in
paragraph 2, item (f) above has not been elected, the
Musorprovlub is temporarily led by the Chairman of
Provincial KONI assigned to certify the rule and
regulations and the Event, as well as to elect the leader
of Musorprovlub; and
(h) Provision concerning the procedure for quorum
announcement and decision making are similar to those
for Musorprov as stipulated in Article 35, paragraph 2,
items (b), (c) and (e).

3. Extraordinary Regencial/Municipal Sport Congress
(Musorkablub/Musorkotlub)
(a) Musorkablub/Musorkotlub can be held if:
(i) It is mandated by Musorkab/Musorkot or
Regencial/Municipal KONI Member Meeting;
(ii) The Chairman is permanently unavailable;
(iii) Regencial/Municipal KONI deem it necessary by
explicitly and concisely stated the reasons to hold
the Musorkablub/Musorkotlub;
(iv) On a written request from at least 2/3 of total
members.
(b) Musorkablub/Musorkotlub is organized by
Regencial/municipal organizing committee of KONI;
(c) If within the next 30 days the Regencial/Municipal KONI
did not hold the Musorkablub/Musorkotlub as referred to
in item (a) (iv), the proposing Members can hold the
Musorkablub/Musorkotlub;
(d) The Regencial/Municipal organizing committee of KONI
is obliged to hold Musorkablub/Musorkotlub on a
request;
(e) The number of representative is adapted to the agenda
and the needs of Musorkablub/Musorkotlub;
(f) Musorkablub/Musorkotlub whose agenda is not to
discuss managerial issues is led by regencial/municipal
organizing committee of KONI and member of KONI that
consist of 5 persons: 1 Leader, 3 Deputy Leaders, and 1
Secretary;
(g) As far as Musornaslub Leader as referred to in
paragraph 3, item (f) above has not been elected, the
Musorkablub/Musorkotlub is temporarily led by the
Chairman of Regencial/Municipal KONI assigned to
certify the rule and regulations and the Event, as well as
to elect the leader of Musorkablub/Musorkotlub; and
(h) Provision concerning the procedure for quorum
announcement and decision making are similar to those
for Musorkablub/Musorkotlub as stipulated in Article 35,
paragraph 3, items (b), (c) and (e).

Section Three
Meetings
Article 37

1. The following are types of meeting held within the ranks of


KONI:
(a) Member Meeting;
(b) Plenary Meeting;
(c) Leadership Meeting; and
(d) Coordination and Consultation Meeting;
2. Procedure for meetings as referred to in paragraph 1 is further
stipulated in KONI’s regulations.
3. Central KONI Member Meeting
(a) Voting Rights and Number of Representatives:
(i) Each member is entitled to 1 (one) vote in Central
KONI’ Member Meeting;
(ii) Each member is entitled to send representatives in
accordance with the number of commission in
Central KONI’s Member Meeting;
(iii) Each member subjected to organizational sanction,
that is lay-off, loses his or her right to speak;
(iv) Every invited participant to Central KONI’s Member
Meeting with a status as observer has the right to
speak by permission of chairman of the meeting;
(b) Place and Notice
(i) Notification concerning Central KONI’s Member
Meeting is delivered in a written form and send to
each member entitled to take part in this meeting,
no later than 14 calendar days prior to the Central
KONI’s Member Meeting;
(ii) Written materials to be discussed and decided in
Central KONI’s Member Meeting shall be distributed
to each and every participants entitled to take part,
as referred to in paragraph 3, item (b), point (i) no
latter than 7 calendar days prior to the Meeting;
(c) Quorum
(i) Central KONI’s Member Meeting obtained a quorum
if attended by at least 2/3 of invited members.

(ii) If a quorum as referred to in paragraph 3, item (c),
point (i) above cannot be met, Central KONI’s
Member Meeting will be suspended for not less than
60 minutes, to give opportunity for representative
who are late to come. If the quorum is still not met

Meeting shall be declared valid and can proceed.
(d) Leadership
Central KONI’s Member Meeting is led by the Chairman
of Central KONI, assisted by a speaker for that meeting.
If the Chairman is unavailable, the Deputy Chairman or
the Secretary General shall act as the chairman of the
meeting.
(e) Decision
(i) Every Central KONI’s Member Meeting decision is
made through consultation to reach consensus. If
consensus has not been reached, decision is made
through voting and that a decision is legitimate if
approved by 50% +1 of valid votes;
(ii) Voting shall be conducted to achieve a valid decision
(50% + 1 of valid votes).
4. Provincial KONI’s Member Meeting.
(a) Voting Rights and Number of Representatives:
(i) Each member is entitled to 1 (one) vote in Provincial
KONI’s Member Meeting;
(ii) Each member is entitled to send representatives in
accordance with the number of commission in
Provincial KONI’s Member Meeting;
(iii) Each member subjected to organizational sanction,
that is lay-off, loses his or her right to speak;
(iv) Every invited participant to Provincial KONI’s
Member Meeting with a status as observer has the
right to speak by permission of chairman of the
meeting;
(b) Place and Notice
(i) Notification concerning Provincial KONI’s Member
Meeting is distributed in a written form and send to
each member entitled to take part in this meeting,

no later than 14 calendar days prior to the Provincial
KONI’s Member Meeting;
(ii) Written materials to be discussed and decided in
Provincial KONI’s Member Meeting shall be
distributed to each and every participants entitled to
take part, as referred to in paragraph 3, item (b),
point (i) no latter than 7 calendar days prior to the
Meeting;
(c) Quorum
(i) Provincial KONI’s Member Meeting obtained a
quorum if attended by at least 2/3 of invited
members.
(ii) If a quorum as referred to in paragraph 4, item (c),
point (i) above cannot be met, Provincial KONI’s
Member Meeting will be suspended for not less than
60 minutes, to give opportunity for representative
who are late to come. If the quorum is still not met
after 60 minute suspension, Provincial KONI’s
Member Meeting shall be declared valid and can
proceed.
(d) Leadership
Provincial KONI’s Member Meeting is led by the
Chairman of Provincial KONI, assisted by a speaker for
that meeting. If the Chairman is unavailable, the Deputy
Chairman or the Secretary General shall act as the
chairman of the meeting.
(e) Decision
(i) Every Provincial KONI’s Member Meeting decision is
made through consultation to reach consensus. If
consensus has not been reached, decision is made
through voting and that a decision is legitimate if
approved by 50% +1 of valid votes;
(ii) Voting shall be conducted to achieve a valid decision
(50% + 1 of valid votes).
5. Regencial/Municipal KONI’s Member Meeting.
(a) Voting Rights and Number of Representatives:
(i) Each member is entitled to 1 (one) vote in
Regencial/Municipal KONI’s Member Meeting;

(ii) Each member is entitled to send representatives in
accordance with the number of commission in
Regencial/Municipal KONI’s Member Meeting;
(iii) Each member subjected to organizational sanction,
that is lay-off, loses his or her right to speak;
(iv) Every invited participant to Regencial/Municipal
KONI’s Member Meeting with a status as observer
has the right to speak by permission of chairman of
the meeting;
(b) Place and Notice
(i) Notification concerning Regencial/Municipal KONI’s
Member Meeting is distributed in a written form and
send to each member entitled to take part in this
meeting, no later than 14 calendar days prior to the
Regencial/Municipal KONI’s Member Meeting;
(ii) Written materials to be discussed and decided in
Regencial/Municipal KONI’s Member Meeting shall be
distributed to each and every participants entitled to
take part, as referred to in paragraph 5, item (b),
point (i) no latter than 7 calendar days prior to the
Meeting;
(c) Quorum
(i) Regencial/Municipal KONI’s Member Meeting

(e) Decision
(i) Every Regencial/Municipal KONI’s Member Meeting

6. Plenary Meeting
(a) KONI’s Plenary Meeting is attended by all committees of
KONI.
(b) KONI’s Plenary Meeting is organize to discuss working
program and other relevant matters such as:
(i) Preparation for KONI’s events;
(ii) Preparation for Sport Conference, Member Meeting,
and Sport Week;
(iii) Participation in multiple international events;
(iv) Admission to membership, lay-off, and
organizational sanction imposed to members;
(v) KONI’s asset disposal plan, either movable or non-
movable, including cash;
(vi) KONI’s plan to raise funds, either in the form of
loans, maintenance, or preparation/participation in
the capital markets; and
(vii) To decide whether or not Conference needs to hold
(c) A plenary meeting deem valid and legitimate to make
decision provided that it was attended by at least 50 %
+ 1 on the number of committee. In case the quorum
has not been achieved, the meeting can be suspended
for 60 minutes.
(d) A plenary meeting is hold at least once in a year.
7. Leadership Meeting
(a) Leadership meeting is attended by Chairman, Deputy
Chairman, Secretary General/Secretary, General
Treasurer/Treasurer;
(b) The meeting is held to discuss and decide upon matters
relevant to tasks and obligations, especially those
related regulations and policies;

(c) Leadership meeting may invite deputy leaders and
implementers, as necessary;
(d) It shall be organized at least once in two weeks.
8. Coordination and Consultation Meetings
(a) A coordination meeting is attended by organizing
committee of KONI and the members, held at least once
a year;
(b) A consultation meeting is organized anytime by the
organizing committee of KONI with one or more
members.
9. Provincial and Regencial/Municipal KONI’s Meetings
The organizing committee of Provincial and Regencial/Municipal
KONI organize held Executive Board Meeting, Plenary Session,
and Coordination and Consultation Meeting in pursuant to
paragraphs 1, 6, 7, and 8 in consideration of condition and
status of their respective work areas.

CHAPTER VI
SPORT WEEK
Article 38

1. Participants
(a) National Sport Week is attended by participants
representing provincial KONI;
(b) Regional Sport Week is attended by participant
representing Provincial KONIs in that region;
(c) Provincial Sport Week is attended by participants
representing Regencial/Municipal KONIs;
(d) Regencial/Municipal Sport Week is attended by
participants or contestants representing Districts in that
Regencial/Municipal KONI’s work area;
2. Selection of Candidate Provinces to Hold National Sport Week
(a) The selection of candidate provinces to hold National
Sport Week is conducted in KONI’s
Musornas/Musornaslub;
(b) The selection is to be hold 6 years prior to the National
Sport Week in question;

(c) Detailed procedure concerning selection of candidate
province to hol Sport Week is stipulated in KONI’s
regulation.
3. Host Province Designation for National Sport Week
(a) Candidate host provinces selected by Selection Team
established by Central KONI shall be proposed to
Musornas/Musornaslub;
(b) Prospective candidate provinces to host the National
Sport Week (PON) shall be selected by members of
Central KONI as members of PON;
(c) Results of Musornas/Musornaslub of Central KONI that
selected prospective province to host the PON shall be
submitted by Central KONI to the minister of sports to
be designated as the Host Province for National Sport
Week;
(d) Detailed procedure concerning designation of host
province for National Sport Week is stipulated in KONI’s
regulation.
4. Responsibility for Implementation
(a) The party responsible for execution of National Sports
Week is Central KONI, the implementation of which is
delegated to Provincial Government designated through
Musornas/Musornaslub of Central KONI;
(b) The party responsible for Regional Sports Week is
Provincial KONI, the implementation of which is
delegated to the Provincial Government designated by
Inter Provincial KONI Meeting within the same area;
(c) The party responsible for Provincial Sport Week
execution is Provincial KONI, the implementation of
which is delegated to the Regencial/Municipal
Government designated by Musorprov/Musorprovlub of
Provincial KONI.
(d) The party responsible for Regencial/Municipal Sport
Week event is the Regencial/Municipal KONI, the
implementation of which is delegated to
Regencial/Municipal government, assigned by
Musorkab/Musorkot/Musorkablub/Musorkotlum of
Regencial/Municipal KONI.

5. Number of sport branches contested in National Sport Week is
minimally 28, the procedure of which is stipulated in KONI’s
regulations.
6. Intellectual Property Rights
(a) KONI owns intellectual property rights of its National
Sport Week (PON);
(b) The Intellectual Property Rights as referred to in item (a)
above includes:
i. PON (National Sport Week), PON Remaja (Junior
National Sport Week), and PEPARNAS (National
Paralympics Week)
ii. Management of National Sport Week System.
iii. Radio and Television Broadcasting Rights for the
above mentioned events.
iv. Marketing and Sponsorship Management
(c) KONI’s Attributes as has been established and stipulated
in KONI’s regulations.
(d) The province designated to host PON must be charge for
the use of Central KONI’s Intellectual Property Right, the
rights and obligations of which are stipulated in the
regulation concerning PON.

CHAPTER VII
FINANCE
Section One
Accounting
Article 39

1. Financial accounting for KONI and members is conducted in


pursuant to the Accounting Principle of Indonesian Adaptation
and applicable rules.
2. The accounting year begins on January 1 and ends on
December 31.

1. KONI’s Central Organizing Committee delivers annual financial


statement before Central KONI’ Member Meeting and financial
accountability before Musornas, following the audit by public
accountants.
2. KONI’s Provincial Organizing Committee delivers annual
financial statement before Provincal KONI’ Member Meeting
and periodic financial accountability before Musorprov,
following the audit by public accountants.
3. KONI’ Regencial/Municipal Organizing Committee delivers
annual financial statement before Regencial/Municipal KONI’
Member Meeting and periodic financial accountability before
Musorkab/Musorkot, following the audit by public accountants

CHAPTER VIII
MISCELLANEOUS
Section One
Amendment/Exception to Bylaws
Article 41

1. Proposed amendment and/or exception to provisions in the


Bylaws shall be ratified only by Musornas, provided that the
amendment or exception has been approved by Central KONI’s
Member Meeting in the first place.
2. Amendment and/or exception may be ratified by Musornas if
the proposed amendment and/or exception have been
approved by at least 2/3 of the effective votes of the member
present or legitimately represented in the meeting.
3. Amendment and/or exception to the provisions of Bylaws may
only be ratified by Musornas in a way referred to in paragraphs
1 and 2 or other procedures approved by Musornas.

Section Two
Organizational Decision/Regulation
Article 42

1. Anything that left unregulated or has been insufficiently


regulated in the Bylaws will further be regulated in the
organizational decision or regulation of KONI.
2. Organizational decision and/or regulation of KONI, as referred
to iniparagraph 1 shall not be in conflict with any regulation in
the Constitution and Bylaws or any Decisions of Sport
Conference/Member Meeting.

CHAPTER IX
VALIDITY PERIOD AND TRANSITIONAL RULES
Section One
Validity Period
Article 43

1. The first Bylaw of KONI has been valid since the establishment
of KONI on December 31, 1966, and it has undergone several
amendments or improvements.
2. The first amendment or improvement to Bylaw of KONI has
been approved by National Sport Congress I in 1967, held in
Jakarta on September 26-30, 1967, as materialized in Decree.
No. 2 of 1867
3. The second amendment or improvement to the Bylaw of KONI
had been approved by National Sport Congress II in 1971, held
in Jakarta on December 17-19, 1971, as materialized in Decree
No. 03/Musornas/II/1971, December 19. 1971.
4. The third amendment or improvement to the Bylaw of KONI
had been approved by KONI’s Plenary Session VII of 1971, and
ratified by in National Sport Congress IV of 1981, held in
Jakarta on January 19-21, 1981, as materialized in Decree No.
01/Musornas IV/1981, January 21, 1981.
5. The fourth amendment or improvement to the Bylaw of KONI
had been made in pursuant to Decree No. 02/SPK/1987 of
KONI’s Plenary Session XVI held in Jakarta on June 17, 1987,
based upon the mandate of Decree No. 01/Musornas/1986, of

National Sport Congress V of 1986, held in Jakarta on March
17-19, 1986.
6. The Fifth Amendment or improvement to the Bylaw of KONI
had been made by Improvement Team for Constitution and
Bylaw of KONI, on Wednesday, March 17, 1999, based on the
mandate from National Sport Congress VIII in 1999, held in
Jakarta on February 22-24, 1999, as materialized in Decree No.
04/MUSORNAS/1999.
7. The sixth amendment or improvement to the Bylaw of KONI
had been prepared by Completion Team for Constitution and
Bylaw of KONI, established by Central KONI in 2003-2007 term
of office, based upon the Decree of the Chairman of Central
KONI No.12 of 2004 in ccnjunction with Decree No. 49A of
2004 based on the mandate of Musornaslub 2004, held in
Jakarta on February 18, 2004, as materialized in Decree No.
03/MUSORNASLUB/2004:
(a) Discussed and approved by KONI’s Member Meeting
2005, held in Jakarta on February 7, 2005, based upon
the Decree No. 05/RA/2005, February 7, 2005;
(b) Discussed and then approved by KONI’s Raparnas XXXI
2005, held in Samarinda on February 22, 2005, based
upon Decree No. 05/Raparnas/2005, February 2005; and
(c) Discussed, approved, and then enacted by National
Sport Extraordinary Congress of KONI 2005, held in
Samarinda on February 22, 2005, based upon Decree
No. 03/Musornaslub/2005, February 2005.
8. The seventh amendment and or improvement to the
Constitution of KONI had been made by Musornaslub in
Jakarta, on Monday, July 30, 2007, based on the Decision of
National Sport Congress X of KONI in 2007
No.05/Musornas/2007, held in Jakarta on February 23, 2007.
9. The eighth amendment and or improvement to the Constitution
of KONI had been made by Musornaslub in Jakarta, on Friday,
November 25, 2011, based upon the Decree No.
03/Musornaslub/2011, November 25, 2011.
10. The ninth amendment and improvement to the Bylaw of KONI
had been made by Musornaslub KONI in 2014, in Jakarta, on
Sunday, March 9, 2014, based upon the Decree
No.03/Musornaslub/2014, March 9, 2014.

Section Two
Transitional Rules
Article 44

1. Each and every current members, within the validity period of


this Bylaw, no later than the end of the term of office,
members of KONI are obliged to comply with the amended
Constitution and Bylaw.
2. Each and every current member, within the validity period of
this Bylaw, are obliged to meet all membership conditions as
stipulated in article 11 of this bylaw.
