RE: Notice of Exclusion

Dear Mr. Tsimerman,

On April 8, 2019, you engaged in unacceptable behavior in the Seattle City Council Chambers while
attending the City Council meeting. Your conduct while attending the City Council meeting was in violation
of the City of Seattle Rules of Conduct that apply to City-owned and -occupied buildings, sections 5.2.8 and
5.2.17 (see attached FAS building rules). Your interaction and language in the exchange, captured at 18:22
to 18:35 in video of the meeting, were deemed threatening and harassing.1

You have been previously excluded from City buildings based on violations of the building rules, including
your threatening and harassing behavior directed at City staff, guests and elected officials.

Due to your continued inappropriate behavior, this letter is to inform you that, under Section 10.1 of
the rules of conduct, you are excluded from Seattle City Hall and the Seattle Municipal Tower for a
period of one year, beginning May 2, 2019. You may enter these two buildings only with a specific
written invitation from a City official to attend a meeting on the premises. With such an invitation,
you may arrive up to 10 minutes prior to the meeting, show your invitation to the building security
desk, proceed to your meeting and immediately leave the premises at the conclusion of your
meeting. if you fail to comply with this exclusion notice, you will be subject to arrest for criminal
trespass (SMC 12A.08.040).

Under Section 11.1, a person who receives a notice of exclusion for a period greater than five days-
may, within 14 business days of issuance and receipt of the notice, submit a written request for an
administrative review. You should include in the request any written documentation you seek to have
considered in the review process. The individual(s) who issued the admonishment may also submit
information. Once this information is received, the review officer will then consider all the
information and make a decision regarding the admonishment. Please note that during this process
the notice of exclusion remains in effect pending administrative review.

request along with any and all documentation of the incident you want to be considered by the
review officer to the following address within 14 business days.
