PURPOSE OF TESTIMONY
JUDICIAL AFFIDAVIT
The following questions were asked of me, which I answer in the manner
provided below:
Q1: You stated a while ago that your name is JESSIE C. BARANGAN.
Are you the same JESSIE C. BARANGAN, the petitioner in Cadastral Case
No. 16 in relation to the Re-Issuance of a Second Owner’s Duplicate Copy
of Original Certificate of Title No. (25078) O-1988?
A2: I am one of the vendees of the parcel of land covered by Original Certificate
of Title No. (25078) O-1988, which we bought from GASBAMEL B.
YPARRAGUIRE, and verbally appointed as the person in-charge to
facilitate and process the transfer of said certificate of title under the name
of all the vendees.
A3: She is the vendor and the sole legal heir of spouses
CRESENCIO J. BARANGAN and MARGARITA A. BARANGAN, sir.
A4: They appear to be the registered owners of the parcel of land designated as
Lot 2217 situated in Barrio Balatong (40), Laoag City, described and covered
under Original Certificate of Title No. (25078) O-1988
Q5: What will prove that you indeed bought this lot covered by Original
Certificate of Title No. (25078) O-1988 from GASBAMEL B.
YPARRAGUIRE?
A5: The Extrajudicial Settlement with Deed of Absolute Sale of the Estate of the
Deceased Spouses CRESENCIO J. BARANGAN and MARGARITA A.

A9: I have always carried the owners’ duplicate copy and other relevant
documents so as to inquire and determine the tax due on the estates of the
deceased registered owners and the sale, however, sometime on
12 September 2017, while I am preparing to go to the Bureau of Internal
Revenue – Laoag District Office, I perused the aforesaid documents and
I discovered that the owners’ duplicate copy of the title was missing.
Q10: What did you do next after learning that the owners’ duplicate copy of the
title was missing, if any?
A10: I visited all the offices I transacted with to inquire if I left therein said
owners’ duplicate copy of the title, but I received a negative answer.
A11: I also exerted all efforts and diligence to locate the title in our residence but
the same resulted in futility, thus, I executed an Affidavit of Loss.
Q12: I am showing to you this copy of the Affidavit of Loss. What is its relation
to the affidavit you executed?
Q13: Do you authenticate and confirm my act of marking this Affidavit of Loss
as Exhibit “B”?
Q14: After executing the affidavit, what did you do next, if any?
A14: I had it registered with the Registry of Deeds of Ilocos Norte, Laoag City, as
shown by the stamp of said office and the Entry on the page of the
encumbrance of the title, sir.
Q15: Do you authenticate and confirm the previous marking of Entry No.
2017001381 as Exhibit “B-1” as proof of the registration of the Affidavit of
Loss with the Registry of Deeds of Laoag City?
A16: That will prove that I have registered the Affidavit of Loss I executed with
the Registry of Deeds Ilocos Norte, Laoag City, sir.
Q17: Do you authenticate and confirm my act of marking the electronic copy of
OCT No. O-1988 and its Entry No. 2017001381 as Exhibits “C” and “C-1”,
respectively?
Q18: To your knowledge, kindly tell if there is any existing lien or encumbrance,
or judgment award affecting the title and the lot?
A18: None, sir. There is no lien or encumbrance, of any nature, existing against
the lot.
Q19: Now, what legal reliefs do you seek unto this Honorable Court in this
present petition?
A19: I am requesting that another owners’ copy of the title will be issued, sir.
