AN ORDINANCE AMENDING SECTION 5(A) OF ORDINANCE NO. 1997-31, KNOWN


AS THE MARKET CODE OF THE CITY OF LIPA

WHEREAS, the City of Lipa has an existing ordinance known as Ordinance No.
1997-31, known as the Market Code of the City of Lipa;

WHEREAS, the Sangguniang Panlungsod of the City of Lipa, acknowledges the


need to amend the provision of the Market Code of the City of Lipa, more specifically
Section 5(A) of Ordinance No. 1997-31;

WHEREAS, the fundamental essence of the proposed amendment is to reduce


the rental fees for all the stalls in Building I, II and Wet Market Section of the Candido B.
Lopez Memorial Public Market by 20%;

WHEREAS, the Sangguniang Panlungsod recognizes the fact that the City of Lipa
has already finished its monetary obligations to a private banking institution for the loan
acquired that was used for construction of the said public market of the city of Lipa;

WHEREAS, amending Section 5(A) of the said ordinance (Rental Fees) will
essentially alleviate the daily burden of the vendors of the CBL Memorial Public Market
pursuant to the duty of the Sanggunian to ordain measures for the welfare and furtherance
of the people of the City of Lipa.

NOW THEREFORE BE IT ORDAINED, by the Sangguniang Panlungsod of


Lipa City, through the initiative of Councilor Merlo P. Silva that:

Section 1. TITLE. This ordinance shall be known as “AN ORDINANCE


AMENDING SECTION 5(A) OF ORDINANCE NO. 1997-31, KNOWN AS THE
MARKET CODE OF THE CITY OF LIPA.”

Section 2. PURPOSE OF ORDINANCE. The proposed amendment to the


provision of the Market Code of the City of Lipa, more particularly Section 5(A) of
Ordinance No. 1997-31, intends to reduce the rental fees for the different stalls in
Building I, II and Wet Market Section of the CBL Memorial Public Market by twenty
percent (20%).
Section 3. SECTION 5 (A) OF ORDINANCE NO. 1997-31. The provision of the
ordinance subject to amendment provides the imposition of the rental fees for the
different stalls in Building I and II of the new CBL Memorial Public Market computed
on a daily basis.

Section 4. Amendatory Provision. This ordinance amends the SECTION 5(A)


OF ORDINANCE NO. 1997-31 by reducing the rental fees for the different stalls
in Building I and II including the Wet Market Section of the CBL Memorial Public
Market by twenty percent (20%). Therefore, the Rates/Sq./Per Stall
Classification/Day as provided for in the said provision will be reduced by twenty
percent (20%) and to be applied on all the stalls on Building I, II and Wet Market
Section of the CBL Memorial Public Market of the City of Lipa, whereas,
section 5(A) shall be amended as follows:

Section 5. REPEALING CLAUSE. All other Ordinances or parts thereof which are
inconsistent with the provision of this Ordinance are hereby repealed, amended
and/or modified accordingly.

Section 6. SEPARABILITY CLAUSE. Should any provision of this Ordinance be


subsequently declared unconstitutional or invalid, the other provisions not affected
by such declaration shall remain in full force and effect.

Section 7. EFFECTIVITY. This Ordinance shall take effect immediately upon its
approval.
