MANIFESTATION

Plaintiff, thru the undersigned council and to this Honorable

Court, respectfully states:

1. That the Respondent and Complainant entered into an Amicable

Settlement whereby Respondent agreed to pay the Capital Gains
Tax and Documentary Stamp Tax inclusive of interest and
surcharges to both;

2. That Complainant (BIR) computed the following amount:

a) Fifty-Three Thousand Eight Hundred Eighty-Five Pesos and
Fourteen Centavos (Php 53, 885. 14) as Capital Gains Tax
inclusive of interest and surcharges;
b) Thirteen Thousand Two Hundred Twenty-Four and Ninety-Six
Centavos (Php 13, 224.96) as Documentary Stamp Tax
inclusive of interest and surcharges;

3. That herein Respondent actually paid the abovementioned amount

as computed to herein Complainant (BIR) through the latter’s PNB
Account. Copies of payment slips are hereto respectively attached
and marked as Annexes “A”-“A1” and “B”-“B1”;

4. In view hereof, Respondent prays to the Investigating prosecutor to

dismiss the instant case on ground as discussed above.

PRAYER

WHEREFORE, premises duly considered, it is respectfully prayed to

the Honorable Office for the dismissal of the case against the
Respondent.

 Other relief, just and equitable under the premises are likewise
prayed for.
