EXPLANATORY NOTE

AN ORDINANCE ADOPTING THE CITY OF BAGUIO ORDINANCE NUMBER 44 (SERIES OF 2018)


OTHERWISE KNOWN AS DECLARING IT’S UNLAWFUL FOR ANY PERSON TO MAKE OR CAUSE
EXCESSIVE UNNECESSARY, UNUSUALLY LOUD SOUNDS FROM AUDIO DEVICES WITHIN
RESIDENTIAL AREAS AND PUBLIC STREETS IN THE CITY OF BAGUIO, AND FOR OTHER
PURPOSES PROVIDING GUIDELINES FOR ITS EFFECTIVE IMPLEMENTATION IN THE BARANGAY
UPPER ROCK QUARRY, BAGUIO CITY.

WHEREAS, People look forward to going home after a hard day’s work or after school and
expect an evening of rest, a blissful night, and/or good night’s sleep in the cool climate of the
City of Baguio;

WHEREAS, At times, people are deprived of the well-deserved peace because of rowdy, noisy
parties or gatherings in the neighborhood by neighbors and strangers who take for granted the
well-being of others and who only think of their own enjoyment. More often than not, disputes
stem from these events which may result to violence, injury and damage to property, thus a
need to address said basic community concern;

NOW, THEREFORE, on motion of Hon. Olowan, Hon Avila and Hon Bomogao, seconded by Hon.
Yangot, Hon Allad-iw, Hon. Farinas, Hon. Alangsab, Hon Ortega VI, and Hon Lawana.

BE IT ORDAINED AS IT IS HEREBY ORDAINED BY THE SANGGUNIANG BARANGAY, UPPER ROCK QUARRY ,


IN SESSION DULY ASSEMBLED, THAT:

SECTION 1. DEFINITION OF TERMS – As used in this Ordinance, the following are defined as
follows:

(a) AUDIO DEVICES include karaokes, videokes, amplifiers and musical instrument, among
others.
(b) UNREASONABLY LOUD NOISE is operating, playing or permitting the operation or
playing of any radio, CD player, television set, amplified musical instrument, drums,
loudspeaker, videoke or karaoke system, or other sound producing device in such
manner or with such volume so as to annoy the quiet and comfort of a reasonable
person of normal sensitivities in any dwelling or residence; or with louder volume than
is necessary for convenient hearing of the persons who are in the place in which such
device is operated. A sound would also be considered too loud if it is plainly audible at a
distance of fifty (50) feet from its origin.

SECTION 3. PROHIBITED ACTS. Effective upon the approval of this Ordinance

(a) It is unlawful for any person to make or cause excessive, unnecessary or unusually loud
sound from audio devices within residential areas, subdivisions, and public streets in
the City of Baguio from 10:00 pm to 5:00 am
(b) Using videokes or karaokes, a favorite local pastime may be allowed until 12 o’clock
midnight provided that resident concerned would secure permit from the Punong
Barangay five (5) days before the intended use and commit to keep their volume to
acceptable levels.
(c) Loud sounds, music, or noises shall not be tolerated in places within 200 meters from
schools, places of worship, and hospitals.

SECTION 4. EXEMPTIONS. The provisions of the Ordinance shall not apply to the following:

(a) During the Christmas Holiday Season, provided that schools have declared their
respective Christmas Holiday or from 16 December of the year to 02 January of the
following year.
(b) During the All Saints Day and all Souls Day Celebration and other holidays defined as
national or local holiday
(c) During the Baguio Flower Festival or Panagbenga Celebration.
(d) During wakes, provided that the provision of Section 3 shall be complied with
(e) Such other occasions as may be deemed by the Punong Barangay as applicable if, the
provisions of Section 3 shall be complied with.

SECTION 5. IMPLEMENTING BODY. The Ordinance shall be implemented by the Punong


Barangay in coordination with the Chairman of the Peace and Order Council of the
Barangay. In its implementation, the said officials may call on the Baguio City Police Office
to assist them in the same and/or cause the arrest of violators thereof.

SECTION 6. PENALTIES. A violation of the Ordinance shall be imposed as follows:


An initial verbal warning/order to tone down noise shall be given to violators
However, if the violation is deemed excessive,
 1st Offense  A fine of 1,000 or imprisonment of up to six months, or both shall be
imposed

2 Offense A fine of 3,000 or imprisonment of up to six months, or both shall be
imposed

 A fine of 5,000 or imprisonment of up to six months, or both shall be


 3rd Offense imposed

SECTION 7. SEPARABILITY CLAUSE. If any provision or section of this Ordinance, or the


application thereof to any person or circumstance is held invalid, the other provision or section
of this Ordinance and the application of such circumstance shall not be affected thereby.

SECTION 8. REPEALING CLAUSE. All prior Ordinances, Executive Orders, Administration Orders,
Rules and Regulations, or part/s thereof that are inconsistent with the provisions of this
Ordinance are hereby repealed or modified accordingly.

SECTION 9. EFFECTIVITY CLAUSE. This Ordinance shall take effect in accordance with the Local
Government Code of 1991, as amended
