Philippine Criminal Justice System (CRI-C102)

1. Explain the importance of studying and understanding our criminal justice


system.
- For me, as a criminology student, it is very important for me because
someday I will be a police officer that help and protect the people in my
society. It is important for me to study and understand the criminal justice
system here in our country, because this will be the guide for me to use my
authority on handling the suspects. As a police officer you need to give the
rights of a suspect, because it is their right. Studying and understanding our
criminal justice system is an advantage, because it may helps us in case we
are in situation wherein we are going to defend ourselves in the other people
especially in the people who are more knowledgeable on us. So we must
study and understand our criminal justice system, so that we can protect
ourselves or the other people especially we are future law enforcement, so
that it’s better to study and understand our criminal justice system in the very
early time.

2. Define crime control and the due process. Give each an example.

- Crime control is the ability to control the crime in the society, wherein the law
enforcers are doing their best in their job to prevent crimes, to suppress those
criminals and, to retain the peaceful in the society. We cannot obtain the
peace in our society if our law enforcers does not have unity to enforce the
law and also if they are relying on their fellow law enforcer. They must do their
job with so much effort so it may turn their job into easy one. For an example
in the case of war on drug of Duterte’s Administration. PDEA or Philippine
Drug Enforcement Agency and PNP or Philippine National Police are doing
their job with so much effort to suppress drug pusher and drug. If we look on
the result of their effort, we can say that it is possible to overcome those
society problem if we have unity while doing our job.
Due process is the process wherein criminals are presumed innocent until
judgement in the criminal court. The authorities must give all of the rights of
any suspects and there must be a limits placed on the police authority or
powers. For an example, if one person committed a crime the police officer
must give the offender a Miranda Doctrine or the speech from law enforcer
where he can get an attorney to defend him or her, and if the offender can’t
afford it, one will be appointed to him or her. And he will bring to prosecutor if
offender truly commit a crime and will also identify if there’s a probable cause.
After that, if there is probable cause, he or she will bring to the court for trial
and to give a punishment. After the trial, the criminal will bring to correction to
rehabilitate. After the criminal paid her or his committed crime he will
reintegrate with the society.

3. Describe the importance of discretion and ethics throughout the justice system.

- The importance of discretion and ethics in justice system will provide fair and
clean processing of justice. All of the members of the justice system must
have a dedication on their job so that they will do it in the right way. Having a
good decision making to ourselves we can make a good action that will
benefit not only us but also the other people. For me as a future law enforcer,
I must do what is my duty and my authority to enforce the law. Law enforcers
must have a good discretion so that they will not stepped on the rights of
every person and treat them like they’re relatives.
With ethical standards while doing job especially in justice system, it is hard to
believe that there is a corruption or bias judgement in that organization.
Members of justice system from lower to higher position, they must have an
ethical standards so that they performed their duty to give fairness in
processing justice. They must do what the government put in their shoulder
and give their effort while doing their job. So that we will achieved what is
really for us and give the true justice for those who are innocent.
