OUTLINE FOR TENATIVE AGREEMENT

Louisville Metro youth have never been part of the State Department of Juvenile Justice (DJJ) system
until the youth are committed. Starting January 1, 2020, Louisville Metro’s Youth Detention Center
(LMYDC) will be closed and the DJJ system will absorb the youth in the Louisville Metro system. This will
include the youth in detention, community and those involved in the juvenile court system.

After careful review of the data concerning Jefferson County youth in detention, DJJ has proposed a
hybrid detention center at the DJJ Audubon Campus located in Jefferson County. The 10-bed hybrid
would operate in the following manner:

• Youth in Jefferson County who have been arrested, a CDW (Court Designated Worker) or court
approved for pre-arraignment detention would be transported and stay overnight at the
Audubon Campus hybrid until his/her arraignment.
• Youth will not return to the Audubon Campus hybrid from court.
• Youth detained from Jefferson Juvenile Court will be assigned a detention bed in one of the
seven DJJ catchment detention centers.
• Given the uniqueness of having a hybrid campus, Louisville Metro Government would provide
financial support to operate the hybrid detention center at the Audubon Campus at an agreed
upon amount.

It is the intent of the parties to minimize travel and DJJ will work with the Administrative Office of the
Courts (AOC) to recognize those situations where a return to the hybrid facility from court may be
warranted.

DJJ will be responsible for all alternative placement services including the home incarceration program
as of Jan 1, 2020 and will make best efforts to expand current community partner relationships such as
with YMCA Safe Place, Home of the Innocents and Our Lady of Peace.

In addition to the hybrid detention center, DJJ will be expanding services in Louisville Metro to address
the youth and their families that find themselves involved in the Juvenile Justice Court system.

Currently, Louisville Metro has a male group home and a Day Treatment Center but does not have a
Youth Development Center. DJJ is exploring a Youth Development Center (YDC) that will include all the
youth in Louisville Metro at the first opportunity they enter the court system. The YDC could potentially
include programs designed for the youth and their parent(s); vocational opportunities, certification
programs, educational programs, mental health counseling, job placement and soft skills training.

Currently, the Louisville Metro youth committed to the community who violate the conditions of their
commitment are detained and displaced throughout the Commonwealth in DJJ facilities. It is the desire
of the partners that the joinder of Louisville Metro to the state system will reduce the number of youth
displaced away from their communities and families and improve the level of services and care DJJ can
provide.

It will be the responsibility of the arresting officer to take the youth to a designated location in Louisville
Metro to meet the CDW and remain with that youth until an assessment is complete and a court
determination about pre-arraignment detention is made. The arresting officers and the court will make

every effort to have the arraignment and initial detention hearing at the same time and at the next
court session.

The existing state and metro policy regarding medical stability will remain in effect.

Louisville Metro will develop a unit to serve, process and transport pre-adjudicated youth This unit will
also be responsible for records and will bring the local system into the NCIC system.

The Sheriff will be responsible for transportation of post-adjudicated youth.

DJJ will explore the possibility of video conferencing for family visits and attorney conferences.

DJJ and LMG will be working with the existing staff on alternative employment opportunities with the
state, LMG and the Sheriff’s office.

DJJ and LMG will be meeting with current contractors in regards to the continuation of the relationship.
