named as “Bhaguvaru” admeasuring 1-56-00 (H-Ares-Sq.mt)

situated in Mouje Village: Dayapar, Taluka: Lakhpat and

Registration District: Kachchh, State : Gujarat.

GENERAL POWER OF ATTORNEY

I, the Principal hereby declares:

( i ) That We The Principal and Attorney are the joint owner(s) of


the Schedule mentioned property and is in absolute possession,
occupation and enjoyment of the Schedule mentioned property and
none else have got right, title, power and interest in the
propertyhereby conveyed.

(ii) That I am not in a position to personally attend to various


formalities relating to Sale and development of the property
described in the Schedule hereunder deemed it fit and necessary to
appoint an agent.

(iii) That BE IT KNOWN TO ALL MEN to whom it may concern


that I above named (hereinafter called the principal) Do hereby
nominate, constitute, appoint, empower and authorize the above
named Attorney (hereinafter called the Attorney) to the following
acts and deeds on my behalf:
AND WEHEREAS my said Attorney(s) shall act on my behalf to do all
acts, deeds and things hereinafter mentioned to.

1. That to work, manage, control and supervise the management


of all and administer the schedule property now or hereafter
belonging to me and to develop the same.
2. To cultivate all agricultural lands belonging to my estate, open
and work quarries, mines and minerals and to enter into
contract, covenant and arrangement of any kind whatsoever
in relation thereto and to modify, revoke and cancel the same
as he shall think fit and proper without making me liable for
any loss on that account.
3. That to let out and/or otherwise settle all and any land or
building or any part or parts thereof belonging to my estate on
rent on monthly tenancy basis or lease and to realise all rents,
issues and profits thereof and to accept ,surrender of leases
and tenancies and to evict all trespassers and other
unauthorized occupiers.
4. That to sign and give notice or notices to any tenant or
tenants and other occupiers of the lands and buildings
belonging to my estate, to quit and vacate or to repair any
damage or to abate any nuisance or to remedy a breach of
covenant or contract or for any other purpose or purposes
whatsoever and to avail of and enforce all remedies open to
me in respect thereof and to enter into any such property or
properties with a view to inspecting the same or excercising
any right vested in me.
5. That effect mutation or separation of holding in the Revenue
and/or Municipal Records and sign all applications or
objections. To appear for and represent me before the Board
of Revenue, Collector of any district, sub-divisional officer, any
magistrate, judges, and in all government offices, panchayat
offices, commissioners of any division in all matters and things
relating to my estate or its affiars.
6. That to apply for approvals/revised
approvals/sanctions/permits or renewals thereof for
construction of any building/s on the land described in the
Schedule hereunder and to apply for revisions, regularizations
etc., to the Local bodies and file necessary applications,
indemnities, declarations, documents and papers and pay
necessary fees and get the buildings constructed regularized
as per procedure.
7. That to borrow monies from individual, financial institution of
private or public in nature either pledging the documents in
whole, or in part, in divided or undivided shares, in respect of
the entire property and repay the loans with interest and
obtain discharge certificates;
8. That the attorney shall keep all accounts relating to all
monies received and render the same as and when required
by the Principal.
9. That to represent me before the concerned office/authority of
any Central/State Government or local body having jurisdiction
at that time which are connected and/or concerned with my
said property which is allotted to me in any manner,
Whatsoever and to make any statement, application,
affidavit, undertaking, etc, for and on my behalf and in my
name, in respect thereof and/or any matter incidental
thereto, and to have the possession thereof on my behalf.
10. That to enter upon and take possession of the Land and to
develop the Land for any Project and to carry out all necessary
building, engineering and other operations on the Land to
construct and complete the any Project Building in accordance
with the planning permission, building plan approval and any
other licences, approvals or permits issued by any relevant
competent authorities.

11. That to get water/sewer/electricity connection any other


services in the said property, if not provided, and for the
purpose to do acts, deeds and things on my behalf.

12. That to negotiate, agree and to sell, dispose of or transfer or


create charge, lien, mortgage or transfer by way of exchange,
lease.(whether permanent, for long or short period), the entire
property, or any part thereof, on such terms as my said
Attorney at his sole discretion deem fit and with any
person/body corporate/ Financial Instruction/ bank, etc,
whatever, and to enter any agreement with the intended
Purchaser or mortgage or any other person whatsoever, to
receive earnest money, final amount in his/her own name and
to issue receipts thereof.

13. That to apply for and get permission from the office of the
said Competent Authority, for the sale/transfer of my rights,
interests, liens and titles in the said property, in favour of the
intended purchaser (s) on his/her/their nominee(s).

14. That to execute sign and present for registration, before the
proper Registering Authority, sale/Conveyance Deed, for
conveying my right, interest and title in the said property and
the land beneath the same, or any part thereof, in favour of
the intended purchaser(s) and for the purpose of conveying
the same, absolutely and forever in favour of the intended
purchaser(s) or his/her/their nominee, i.e, to receive the
consideration and to admit the receipt thereof, and to deliver
the possession to the said purchaser(s) or his/her/their
nominee, either physical or constructive, as may be feasible
and appropriate.

15. That to institute/execute/sign file/defend all kinds of suits,


writs, complains, petitions, revisions, written statement,
appeals, vakalatnama, etc. In courts of law, i.e. Civil, criminal,
revenue tribunal or authorities and to present proceeding
before courts arbitrator or any other authority in my name and
on my behalf in any manner concerning my said property and/
or any matter incidental thereto and to engage or appoint any
advocate, pleader, attorney, etc., and to make any statement,
application, affidavit, apply to the court for obtaining certified
copies, undertaking, etc., on my behalf under my name.

16. That to execute a rectification deed of any deed (s) in respect


of the said property and to get the same registered before the
office of the sub-registrar.

17. That to appoint any other person (s) as my attorney


authorizing him/her to do all any of above acts, or any other
acts, which have not been specifically mentioned herein,
above and in the opinion of my said attorney ought to be
done, executed or performed, in respect of the said property,
or any matter incidental thereto, and to cancel, withdraw or
revoke the powers conferred upon the said attorney/such
other person.

AND I, the executant, do hereby specifically confirm that the acts,

deeds and things done or got to be done by my attorney by virtue

of this power of Attorney in respect or my said property be

construed as acts, deeds and things done by me and this power of

Attorney is (revocable) and conditional for all times to come.
