Based upon the following facts and information, there is probable cause to believe that on Wednesday, September 18, 2019, in the City of Westfield, Vadym (AKA Vadim) MISIRUK (DOB 4/25/2000) did unkawfully assault and beat (== cee ith an intent to Kill Neem with deliberate premeditation, andlor extreme atrocity or cruelty, each with malice, and by such assault and beating did kill QegeeeEa violation of G.L. ¢.265/s.1 - murder. 2. The information contained in this affidavit is based upon personal involvement in this investigation, training and experience, review of documents, and information provited by other law enforcement officers currently assisting with this investigation. This is a summary of facts to establish probable cause and does not include all facts and information that are known to investigators. 3. On Thursday, September 19, 2019, at approximately 3:19 PM, the Westfield Police Department was dispatched to Stanley Park, gate #4 for a report of a deceased person. Patrol officers arrived on scene, located a deceased male subject, and requested the assistance of the Westfield Police Detective Bureau and the State Police Detective Unif* * a 4. The decedent victim was identified as Siii=eamme=seeenat Southwick. He was located lying on. his back in a wooded area of Stanley Park in close proximity to the chain link fence that runs along Kensington. The decedent victim was fully clothed. The decedent victim had a gaping neck wound that peared to hi ; ave been caused by a cutting instrument, and a ‘significant pool of apparent blood was observed on the round at his , eck area. There was also a cut portion from the right pant leg of the decedent, and a gaping slice 2 skin was observed missing from the decedent's right leg, A razor blade type cutting instrument was located in proximity to the primary crime scene. 5. Witnesses who are known to investigators were identified and interviewed. Two witnesses reported that on the evening of September 18, 2019, they were with the victim and Vadym MISIRIUK, in a vehicle at Stanley Park in Westfield near gate #4. Witnesses reported’ ed MISIRIUK had been arguing and yelling at each other and ‘Wesstcalled MISIRUK a “nigger.” Witnesses reported that that @==™mgot out of the car and went into the woods to get his bike, and MISIRUK got out of the car and followed @gitsnto the woods. 6. Witnesses reported hearing noises coming from the woods, including the victim yelling, "Yo — what the fuck!" A short time after that, MISIRUK reportedly came out of the woods and approached one witness with a large razor blade in his hand and blood on his hand and wrist. One witness reported seeing MISIRUK in possession of a razor blade in the car before the incident. MISIRUK was located by investigators and interviewed at the Westfield Police Department by Trooper Noah Pack and Detective Brian Freeman after waiving his Miranda rights. MISIRUK ultimately admitted that he had been at the park at that time with the other involved persons, that he had been arguing witheagazagmand had been called a “nigger”. MISIRUK further admitted that he had gone into the woods after @Eismaband come out of the woods ‘with a knife in his hand and blood on his hands that was not there before he wentinto the woods. MISIRUK reported that he took steps to conceal/destroy evidence by discarding his clothing and shoes, which had blood on them: 8. MISIRUK further reported that he went back to the victim the following day on September 19, 2019, and sliced a piece of meat out of the victim's leg. MISIRUK gave multiple explanations for why he did this. When asked directly why he assaulted S599 the woods and cut his throat, MISIRUK also gave several explanations, including: initially denying it and later stating that he “blacked out” or “snapped”. 9. MISIRUK was placed under arrest and charged with C.265/S.1 Murder. He was booked at the Westfield Police Department and held pending his arraignment in Westfield District Court on September 20, 2019. Surveillance videos and forensic evidence have been collected and the investigation remains active.
