18-1852

BY THE CITY COUNCIL: BERNT, BORTON, CAVENER,


LITTLE ROBERTS, MILAM, PALMER

AN ORDINANCE ADDING MERIDIAN CITY CODE SECTION 7-1-14, PROHIBITING THE


USE OF HANDHELD ELECTRONIC MOBILE DEVICES WHILE OPERATING A
VEHICLE; ADOPTING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, distracted driving adversely impacts public safety by contributing to traffic


accidents, injuries, and fatalities;

WHEREAS, the use of handheld electronic mobile devices while operating a vehicle is a cause
of distracted driving; and,

WHEREAS, an ordinance prohibiting the use of handheld electronic mobile devices while
operating a vehicle would reduce distracted driving and enhance public safety;

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE


CITY OF MERIDIAN, IDAHO:

Section 1. That section 7-1-14 is added to the Meridian City Code as follows:

7-1-14: USE OF HANDHELD ELECTRONIC MOBILE DEVICES:

A. For purposes of this section, the following terms shall be defined as follows:

1. Handheld Mobile Electronic Device. Any handheld or portable electronic device capable of
receiving, producing, displaying, or providing wireless data or voice communication,
including a cellular telephone; broadband personal communication device; two-way
messaging device; text messaging device; pager; personal digital assistant; laptop computer;
computer tablet; stand-alone computer; portable computing device; mobile device with a
touchscreen display that is designed to be worn; electronic games; equipment that is
capable of playing a video, taking photographs, capturing images or recording or
transmitting video; and any similar device that is readily removable from a vehicle and may
be used to write, send or read text or data or capture images or video through manual input.
“Handheld mobile electronic device” shall not include a radio designed for the citizens
band service or the amateur radio service of the Federal Communications Commission or a
commercial two-way radio communications device.

2. Operate. Driving or occupying the driver’s position of a vehicle in motion upon a public
road, street, or highway.

3. Parked. The standing of a vehicle, whether occupied or not, other than temporarily for the
purpose of and while actually engaged in loading or unloading property or passengers.
“Parked” shall not include a vehicle stopped in a lane of traffic due to a traffic control
device, traffic congestion, or conditions on the roadway.

4. Standing. The halting of a vehicle, whether occupied or not, other than temporarily for the

purpose of and while actually engaged in receiving or discharging passengers. “Standing”
shall not include a vehicle stopped in a lane of traffic due to a traffic control device, traffic
congestion, or conditions on the roadway.

5. Vehicle. Any vehicle as defined in Idaho Code title 49, chapter 1.

B. It shall be unlawful to operate a vehicle within the city while using a handheld mobile
electronic device. This provision shall not apply to:

1. Use of a handheld mobile electronic device in a voice-operated or hands-free mode, where


the operator of the vehicle does not hold or manually operate the device, except to activate
or deactivate the voice-operated function of the device.
2. Use of a navigation feature on a handheld mobile electronic device, provided that the
operator of the vehicle does not hold or manually enter information into the device, except
to activate or deactivate the navigation feature on the device.

3. Use of a handheld mobile electronic device to report an emergency to a law enforcement


agency, fire department, health care provider, or other emergency services provider.

4. An operator of a vehicle that is parked or standing.


5. A peace officer, firefighter, paramedic, emergency medical technician, or other public
safety first responder during the performance of that person’s official duties.

6. A public utility employee or contractor acting within the scope of that person’s employment
while responding to a public utility emergency.

Section 2. That all ordinances, resolutions, orders, or parts thereof or in conflict with this
ordinance are hereby voided.

Section 3. That this ordinance shall be effective immediately upon its passage and publication.

An ordinance adding Meridian City Code section 7-1-14, prohibiting the use of handheld electronic

Meridian, Idaho. This ordinance shall be effective upon its passage and publication.
