Chemists and Druggists spread throughout the country. The main activity comprises of
protecting our members interests, educate them through seminars and workshop, to act as
an interface between industry, government and trade. We represent the grievances of our
members before the government, industrial bodies and seek the redressal of their grievances.
We also support and supplement the government’s role in healthcare sector by ensuring
availability of medicines in the nook & corner of the country.
This is with reference to proposed regulation, we are submitting following suggestions,
objections, and communicating certain alarming hazard to society due to proposed e-
pharmacy.

We would like to bring to your kind notice that, if proposed regulation is finalised as Rule,
the so called E-Pharmacy will pose ethical, legal and quality challenges amounting to
endanger life of many citizens and there by irreparable harm to the society.
An important safeguard in health care is patient examination by the physician; licensed
pharmacist reviews the prescription and guide patient on medication. This approach i.e.
right medicine to right patient from right Registered Medical Practitioner (Prescriber) and
right Registered Pharmacist (Dispenser) will break this noble way of treatment of patient
.The e- pharmacy is looking towards this profession as business.
If e-pharmacy is brought in picture, the patient will miss the services of two professionals
i.e. Doctor and Pharmacist who inform patients of proper administration of drugs, dangerous
side effects, and drug interactions.
As per Rule 67-1 (f) The words and expressions used herein and not defined in this PART
but defined in the Drugs and Cosmetics Act, 1940 and rules made there under shall have
the same meaning assigned to them in that Act or rules, respectively. As per condition of
registration inform 21 AA -The registration holder shall comply with the provisions of the
Drugs and Cosmetics Act, 1940 and the Rules made there under amended from time to
time. This means all the provisions of present Act and Rules are applicable to E-Pharmacy
registration holder.
In draft, however, there is lacks clarity on various issues and proposed provisions are violating
various provisions of present Drugs and Cosmetics Act and Rule such as Section 18(C),
Rule 65(2), 65(9), 65(11) as well as provisions under pharmacy act.
The E-Pharmacy is an off-shoot of modern technology. The benefits of internet pharmacies
propagated are convenience; allow the door delivery of drugs at low cost, but on perusing
following submission, it will be seen that it is not true. The picture presented is misleading
and hiding the facts. The proposed regulation will endanger life of citizens and will
have alarming hazard to society as elaborated follows.
1. Dangers of self-diagnosis and self-medication.
Self-diagnosis and self-medication will lead to health hazard to society. e.g. High
Temperature to human body is due to various diseases, but patients will order drug like
paracetamol via E-Pharmacy. Disease will cross, hazard or fatal level and cannot be
controlled after some stage. Therefore timely opinion of physician and intervention of
pharmacist is imperative and inevitable. This is missing in E-Pharmacy concept as
OTC drugs don’t require prescription of doctor. Even indiscriminate use of OTC drugs
has many side effects. E.g. paracetamol causes a severe liver dysfunction if consumed
indiscriminately. If present formatted E-Pharmacy is brought in picture, consumers can
purchase OTC drugs without ever speaking to a pharmacist or physician, uncontrolled
indiscriminate self-medication will be visible in coming years.

2. Misuse of Prescription Drugs.
Government is proposing following provisions in regulation, 67-1. Definitions. - In
this part unless the context otherwise requires,-
(a) “e-pharmacy” means business of distribution or sale, stock, exhibit or offer for
sale of drugs through web portal or any other electronic mode;
(b) “e-pharmacy portal” means a web or electronic portal or any other electronic mode
established and maintained by the e-pharmacy registration holder to conduct
business of e-pharmacy;
(d) “Prescription” means an instruction from a Registered Medical Practitioner to a
patient, written by hand or in any electronic mode duly signed, to dispense a drug
and quantity of drug to a patient;
(e) “Sale by way of e-pharmacy” means a sale whether to a hospital, or dispensary, or
a medical, educational or research institute or to any other person through e-
pharmacy by way of retail sale;”
67P. Procedure for distribution or sale, of drugs through e-Pharmacy,
(1) On receipt of prescription, through e-pharmacy portal, the registered pharmacist
on behalf of the epharmacy registration holder shall verify the details of the patient,
Registered Medical Practitioner and arrange for the dispense of the drugs as per
the instructions of the Registered Medical Practitioner, if not already found
dispensed;
(2) The e-pharmacy registration holder who has received prescription in sub-rule (1)
shall dispense and made arrangements for supply of drugs from any retailer or
wholesaler licensed premises under the Drugs and Cosmetics Act, 1940 and rules
made there under;
(3) The details of the drugs dispensed including the patient details shall be maintained
on the epharmacy portal.
(4) In case of e-prescription, the prescription shall be uploaded on the e-pharmacy
portal and shall be kept in record by the dispenser
On perusing proposed provisions in proposed Rule it is seen that said proposed rules
contradict with present law and’ may attract misuse of prescriptions as elaborated below,
I. It is seen that vide this regulation Govt. is intended to permit distribution or sale of
even prescription drugs on e -pharmacy, this is very serious.
II. In case of prescription drugs, dangers are especially significant; drugs will be dispensed
without a valid prescription. Repeated purchase with same prescription. Prescription
of one patient may be used for other for similar sign and symptoms; alarming thing is
that in spite of every possibility of different diseases. At the same time, there is a risk

e-pharmacies. This is an alarm red flag.
III. Indiscriminate use of drugs like antibiotics will lead to drugs resistance like MDR
tuberculosis case.
IV. Another area of concern involves the prescribing-physician’s credentials. The cyber
doctor’s qualifications and his experience.
V. Illegal Purchase of schedule drugs, Habit forming drugs, potent drugs like abortion
(MTP) kit is alarming issue observed severely in past also.
VI. Forgery of prescription/bogus prescription is easily possible in present methodology
amounting to cyber - crime.
VII. The Sale or distribution of an adulterated or misbranded, counterfeit and spurious
drugs control on it will be beyond imagination. There is no strong mechanism available
to check the medicines.
VIII. Ethical issues - In an anarchic world over the Internet, nobody can be sure of what
happens to this information. Large information losses once a security breach has
occurred. Cyber -pharmacies not keeping privacy and confidentiality promises have
also been reported.
IX. It is pertinent to note that in many countries Purchase of prescription drug on e-
pharmacy is strictly prohibited.
X. As per proposed regulation pharmacist of e-pharmacy is supposed to verify the details
of the patient, Registered Medical Practitioner and arrange for the dispense of the
drugs as per the instructions of the Registered Medical Practitioner, if not already
found dispensed. But there is no provision how this will be done. Even consumer and
regulator also will be unable to verify presence of pharmacist.
XI. There is no provision of linkage of doctors and patient with strong unique identity
for specific prescription which will lead to misuse of prescriptions.
XII. As per proposed regulation pharmacist is expected to verify that drugs are not
dispensed on said prescription, this is just impossible as prescription will be scan
copy.
3. Inadequate Regulatory machinery and supervision:
Looking into nature and quantum of e-transaction there will be lack of proper regulatory
checks and balances for exercising regulatory controls on e-pharmacy. Drug sale is
regulated by state licensing authorities, which is feasible for brick and mortar stores.
Present brick and mortar medical stores are approachable to the consumers who reside
within the vicinity of the location of the stores However; such a model of regulation
may not be feasible for E-pharmacies in as much as an online market place is accessible
from any location or state, without there being any checks or control on cross border
sales etc.

Also for consumer there will be jurisdiction issues which lead to difficulty in assess
for justice if required by common people.
4. Storage and transportation:
Absence of a framework or guidelines ensuring the protection of the drugs and medicines
at the time of storage and transportation. There is a possibility of pilferage, loss of
potency and degradation of drugs and medicines during transportation to the consumer’s
house/place. Especially if they are being transported over long distances or are of certain
specification that requires safe handling, cold storage etc.
5. Violation of provision of Pharmacy Act and Regulations 2015.
There will be violation of pharmacy Act provisions as absence of any physical interface
between the consumer and a pharmacist; concerns arise as to the compliance with the
obligation of the provisions of Pharmacy Act and the regulations made there under on
part of the E-pharmacies. Section 42 of the Pharmacy Act provides that no person other
than a registered pharmacist shall compound, prepare, mix, or dispense any medicine
on the prescription of a medical practitioner. At the same time, the Pharmacy Council
of India has framed the Pharmacy Practice Regulations, 2015 which inter alia, prescribe
the obligations and duties of the pharmacists in connection with the preparation and
dispensation of drugs, maintenance of records, patient care, patient secrecy and patient
counseling. As per the provisions under section 2 of Drugs and Cosmetics Act i.e.
application of either laws not barred .- The provisions of this Act shall be in addition to
and not in derogation of, the Dangerous Drugs Act, 1930 (2 of 1930), and any other law
for the time being in force, is self-explanatory. Proposed law is grossly violating this
provision. Therefore liable to set aside.
6. Violation of various provision of D&C Act and rules itself by proposed regulation.
I. There will be two definition ‘prescription’ under same regulation, under present
Rule 65(10) and proposed 67-L (d). As per above mentioned provisions present
definition is also applicable to epharmacy. This is nothing but non application of
mind and arbitrary regulation.
II. As per proposed regulation wholesalers are also permitted to sale/deliver the
drugs to the patient, as per present regulation (Rule 2(g)) Wholesalers cannot
sale drugs to consumer this proposed provision in draft is in contradictory
with the present regulation. The presence of registered pharmacist is also in
question (7).
III. As per Rule 65(1) Any drug shall, if compounded or made in the licensee’s
premises be compounded or made by or under the direct and personal supervision
of a registered Pharmacist.

IV. As per Rule 65 (2) the supply, otherwise than by way of wholesale dealing, of
any drug supplied on the prescription of a Registered Medical Practitioner shall
be affected only by or under the personal supervision of a registered Pharmacist.
E pharmacy will violate these clauses as E-pharmacy pharmacist will not be able
to supervise drug dispensing.
V. As per E- pharmacy regulation online prescription (scan copy) will be forwarded
to brick and mortar medical/pharmacy and they are supposed to dispense the
same. This is violation of Rule 65(2) and 65(11) (C), as per these provisions
original prescription is required to be dispensed and marked as ‘dispensed’. E-
Pharmacy transaction will violate this provision . If it is permitted then such
other prescriptions coming to such licensee will be dispensed by such medical
amounting permission to violate present provision. This will create havoc in
medical field.
VI. Rule 65 (3) (g) provides that sale bill must be signed by the Registered Pharmacist.
Rule 65 (9) provides that drugs specified in Schedule H, H-1 and X shall be sold
on prescription of the Registered Medical Practitioner. Proposed regulation violates
these provisions.
VII. There may be two bills one by actual seller and one bye-pharmacy for the same
transaction, which is valid and legal bill?
VIII.The term prescription is defined under Rule 65(10) of the Drugs and Cosmetics
Rules, 1945. Plain reading of the said definition clearly shows that it does not
recognize prescription in electronic form or scanned copy or photocopy or
prescription forwarded through mobileapps. The practices followed by the illegally
run online pharmacies are clearly in violation of the existing provision of the
D&C Act & Rules.
IX. Auditing of portal is impossible as data is in hand and custody of e-pharmacy
holder. There is not at all provision of audit trail and 21 CFR part 11 compliance
to avoid tampering of data.
X. There is no provision of linkage of data to Govt. portal contemporaneously,
attributed to patient, doctor and prescription so that data cannot be manipulated
by the e-pharmacy.
7. Doctor’s identity cannot be traced also there is no provision for authentic digital sign
and control of regulation like 21 CFR part 11 in order to avoid bogus prescription.
Registration details of all doctors (RMP) is not online therefore it is difficult to link
prescription of particular RMP on this ground as well as there is no digital signature
standardization I validation this will lead to fake prescription and will be one loose end
or syphoning counterfeit and spurious drugs.

8. The main object of the Act is required to be kept in mind. The Act of 1940 is brought
into force with clear Intention to prevent entry of sub standards Drugs for maintaining
High standards of medical treatment. That would certainly be defeated if the necessary
concomitant or the medical or surgical treatments were to enter uncontrolled into the
system and the purpose of the act will get diluted. The very evil which the Act intends
to eradicate would continue to exist. That is what is held by Supreme Court in the
judgment report in AIR 1963 SC 665. So also, in another judgment of Division Bench
of Bombay High Court between State of Maharashtra v/s Laxmichand Varchomal
Chugani reported in 1988 (1) FAC 1984. It is held that the basic object and the essence
of the provisions of the Act is that no sub-standard drugs should be sold in market and
no one should sell even a genuine drug without license.
9. In the present setup the license is issued for manufacturing, stock for sale, exhibit for
sale, sell or distribute from a particular premises only. The sale, stock, manufacture or
distribution from outside the licensed premises amounts to an offence, and will be
treated as sale in contravention of Act of 1940. In the proposed setup, when the retailers
sell the goods, the agreement to sell and the delivery is effected Simultaneously, and it
is affected in the licensed premises, while following the provisions of the Act and
Rules. While allowing medicines to be sold bye-pharmacy or online, there will be
absolutely no control of the Drug control Department and there will be chances of
fabricating the prescriptions to cover the fake sales and thereby entire objective of
formation of the Act 1940 and Rules there under will be defeated, hence cannot be
allowed.
10. E-pharmacy business will create lots of questions, one of these, is conditions to be
satisfied regarding stock & sales. Suppose a drug leaves a licensed premises and is in
transit of delivery, whether that will be treated as stock with the licensee and how the
same will be verified, what will be the actual delivery to consumer and what will happen
on the date of delivery, if the drug got expired.
11. Do’s and Don’ts for consumers using online pharmacies are not listed and popularized.
Digital data protection of patient information? There is no precaution mentioned.
12. We must examine the purpose and the aim of the formation of the act. Sale of medicines
online involves risk for the patients rather than the convenience it will provide. In
context to present D&C act & rules and information technology act. It seems that the
online transaction in scheduled drugs is totally violating the act and rules. It is also
particularly to note that; this will lead to a danger to a health of common man.
13. While we think or propose online transactions in the field of drugs, we must observe the
international scenario along with the reason for not allowing the online/internet
transaction in countries like China, Japan, Italy, Ireland, Korea, Spain, Thailand, Turkey,
and Russia Federal where online pharmacy is not permitted.

14. We should also learn from the bad experiences and difficulties observed by the countries
which allowed the online/internet pharmacy in country. In recent past many cases of
illegal sale of abortion kit was unearth. We have recently observed that in Mumbai IT
student consumed 200 plus sleeping pill for suicide. E pharmacy will open Pandora
box for such unfortunate incidents. Youth of the country may be on stake.
15. Accountability: The accountability of e-pharmacy is not spelled out in regulation if
anything goes wrong, such as of a wrong medicine is dispensed or substandard medicine
is dispensed.
16. Statutory Compliance Clarity: It is not clear whether an e-pharmacy owner can operate
an e-pharmacy if the owner also owns a brick-n-mortar pharmacy within the same state
or can show a license of any pharmacy in any state where they intend to sell the drugs.
17. Delivery by courier is not prohibited? Dispensing of final handing of the medicines
must be done by pharmacist only. How can this be ascertained in case of an internet
pharmacy? Do they do only packaging of dispensed medicines? How presence of
pharmacist at e-pharmacy portal assured .
18. The controversies gained media attention after the anthrax cases in 2001 which saw
people ordering ciprofloxacin without a prescription. Use of “cyber doctors,” the
dispensing of drugs without prescriptions, and the import of prescription medications
are just the tip of the iceberg.
19. “Cyber doctors” evaluate patients through questionnaires and checklists and prescribe
medication based on this communication . These online consultations forgo the detailed
patient evaluation and physical evaluation that is considered necessary before providing
treatment. Recently Mumbai high court permitted filing of FIR against such doctor.
20. In addition, illegal websites may disappear without trace, at as lightest hint of a regulatory
action.
21. The US Food and Drug Administration (FDA) with INTERPOL and 200 law
enforcement agencies around the world conducted a global action against online
pharmacies, in the year 2014, wherein 237 people were arrested and more than 10,600
illicit websites were shut down. The pharmaceutical crime program supported by major
pharmaceutical companies in 2013 helped crackdown on illicit sites.
22. In India too, the Maharashtra FDA have approached the Drugs Controller General of
India to curb the illegal online sale of medicines.
23. Role of Consumers awareness is the key to curb such fraudulent practices; consumers
need to be educated about the need to verify the authenticity of the service provider as
well as the product and to avoid sites that sell drugs without a legal prescription .

24. Registration details of all doctors (RMP) is not online therefore it is difficult to link
prescription of particular RMP on this ground as well as there is no digital signature
standardization / validation hence, this will lead to fake prescription and will be one
loose end or syphoning counterfeit and spurious drug.
25. Though proposed draft prohibit sale of drug falling under NDPS Act and Rule but it is
observation that such drugs are purchased illegally through e-pharmacy. FDA
Maharashtra unearthed cases in recent past, sleeping pills and abortion kit misuse.
Hazard of habit forming drugs and addiction of young population is big threat.
26. It seems that Govt. is under pressure of Rich and corporate lobby to make such Rules
which will finish the well-established noble profession , i.e. right medicine to right
patient from right Registered Medical Practitioner (Prescriber) and right Registered
Pharmacist (Dispenser) and will take away noble way of treatment of patient.
27. There is lack of administrative strength again Government own study report support
that we are lacking lots in regulatory setups.
28. It will attract major impact on small timers and shops based at villages and small towns.
29. It will also give economical set back to 8 lac chemists and 40 lac workers and their
families .
30. It will also impact on dream of our Prime Minister - Shri. Narendraji Modi that “Sabke
Saath Sabka Vikas”
31. Though proposed Regulation speak about data to be stored in India but how access of
the data from outside India can be prevented. What is check and control points for the
same?
32. As per proposed Regulation, e-pharmacy registration holder shall have a facility for
customer support and grievance redressal of all stakeholders but this facility is through
customer help line supported by registered pharmacist. There is no guarantee or assurance
that person online will be a pharmacist.
33. In provision, Rule 67(5) there is Prohibition of advertisement of drugs through e-
pharmacy. However in the provision of proposed Rule 67(V) it is proposed that the e-
pharmacy registration holder shall maintain and update, from time to time, the
information regarding the drugs availability, types of drugs offered for sale, supply
channels or vendors lists, details of registered pharmacist, registered medical practitioner
(If any) and any other requirements of the Drugs and Cosmetic Act and Rule there
under on e-pharmacy portal. There is contradiction in these provisions itself.
34. There is no mention of whether e-pharmacy registration holder will require brick and
mortar license under Rule 64 and there is no provision for premises requirement if, it is
not required then same is violation of Section 18C as license is required for offer for
sale.

35. As per proposed Regulation licensing Authority is Central Government this is against
de-centralization of authority as per policy of Central Government. There will be dual
control of Central and State Government. It is well known fact that dual control always
fails . Why State is not licensing Authority is unfold paranoma.
36. Success of the proposed e-pharmacy model is impossible in shaky and cloudy regulatory.
US-FDA has recently sent warning letters to companies illegally selling drugs. US-
FDA is in process of removing violated websites.
37. In view of this proposed regulation which also violates present many laws like ...
a) Supply of medicines not made as per quantity in prescriptions and denial of cut /
loose strips and quantity.
b) Huge discounts beyond the available margins are giving out of pocket by burning
own capital will attract irrational competition. It may create risk for entry of spurious
medicines in the market.
c) Advertisements to attract the peoples which are today also illegally shown; many
of them are violating the present act and rules.
d) Lack of man power to inspect the e-pharmacies.
e) It is very suspicious act i.e. in public notice and proposed notification draft that;
License / Registration - why it is not kept state-wise as it prevails in public notice
38. Keeping in mind all the above reasons and the legal positions, we strongly oppose the
move of entry to online sale of medicines via E-Portal in this Nobel profession. Which
is nothing but business module. It is also very important to note that, Drug is life saving
and not general merchandise commodity.
We also reserve our right to comment, suggest, and object and to go far an available remedy
to protect our interest and also the larger public interest and request you to please allow us
to present our views in person.
