CRIMINAL COMPLAINT

The undersigned PDEA Agent of the Philippine Drug Enforcement

Agency, Regional Office Cordillera Administrative Region, Camp Bago Dangwa,
La Trinidad, Benguet, under and in accordance with law hereby accuses
Antonio Montana y Lopez a.k.a “Tony”, a resident of Abatan, Buguias, Benguet
for violation of Sections 5 and 11, Article II of R.A. 9165, otherwise known as
the Comprehensive Dangerous Drug Act of 2002, as amended, committed as
follows:

“That on or about 7:00 o’clock in the evening of August 4, 2019 in the

city of Baguio, Philippines and within the jurisdiction of this Honorable Office,
the above-named accused, Antonio Montana y Lopez a.k.a “Tony”, without
authority, did then and there willfully, unlawfully, feloniously and knowingly
possess, sell and deliver one (1) heat sealed transparent plastic sachet
containing white crystalline substance scientifically called as
methamphetamine hydrochloride and commonly known as “SHABU”,
weighing approximately 5.1 grams, more or less, and in consideration of the
amount of Three Thousand and Five Hundred (Php 3,500.00) pesos, to Agent
Josie A. Limagto, a PDEA agent who posed as a poseur buyer of the
aforesaid dangerous drugs which resulted to the apprehension of the accused
and the confiscation from his possession, control and custody of the following:
(a) a previously marked one (1) Five Hundred peso bill with Serial No.
RS39564 used buy-bust money; (b) previously marked three (3) One
Thousand peso bills with Serial Nos. YA955624, EN570668, and WP042022
used as buy-bust money; and another two (2) pieces of heat sealed
transparent plastic sachet containing shabu weighing .3590 grams and .2811
grams respectively.
