2. Statement of the Problem
- How can the Philippines strengthen enforcement of its duty to uphold the dignity of
women inmates in the area of personal health?
3. Research Objectives
- Discuss the standards, practices, and policy recommendations set forth in the
Bangkok Rules, and other instruments, with regard to the issue of addressing
the personal hygiene needs of women inmates;
- Analyze the guidelines, memoranda, of the BuCor with regard to the issue of
personal hygiene;
- Analyze the situation of BJMP Female Inmates as to whether the Bangkok
Rules standards and other international body of standards, and the BuCor
guidelines are being complied with; and
- To be able to provide policy enactment to address the issue
4. Scope and Limitations
- The study will focus on the issue of personal hygiene in the Correctional Institute for
Women (CIW) in relation to Bangkok Rules.
- The researcher narrowed down the subject of the study to the CIW 1 in order to obtain
credible data.

II. Chapter Two: Review of Related Literature


1. The 1987 Constitution: Right to Health under the 1987 Constitution in relation
to the Penal System of the Philippines which may fully materialize its purpose
a. Article 2 Sec. 11 The State values the dignity of every human person and
guarantees full respect for human rights.
b. Article 13 Sec. 19(2) The employment of physical, psychological, or
degrading punishment against any prisoner or detainee or the use of
substandard or inadequate penal facilities under subhuman conditions shall
be dealt with by law.
c. Penal System in the Philippines – The challenges in penal institutions like
the are of resourcing, staffing, overcrowding and lack of rehabilitative

data to be gathered from CIW is ample to meet the objective of the study. However, the researcher recognizes
that the objectives of the study may be further met if additional penal institutions would be made subject of
the study, and may thus be considered.

III. Chapter Three: Methodology


1. Research Design
- Non-Doctrinal: research into relationship of law with other behavioral
sciences.”3 The inquiry in a non-doctrinal research addresses the extent of how
legal rules work or have worked on its intended subjects.4.
2. Methodology
- Document Analysis: looking at statutes, international instruments, and other
scholarly articles to support the main thesis topic
- Interview: The information shall be collected through the use of pre-
determined questions for the respondent. The pre-determined questions shall
be outlined based on the operational procedure of the institution to be studied,
which is the Correctional Institution for Women (CIW), and the international
standards set out by the Bangkok Rules, the ICCPR and the SMR.

- Final output would be a complete proposal of the law to strengthen compliance
with Bangkok Rules and fully appreciate the local and international mandates to
uphold the rights of female inmate in relation to personal hygiene
