MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Agreement made and entered into this 16th day of July 2018, by and between

SAINT GILBERT MYRA ACADEME, INC., duly represented by its


President, MYRA MIRAFLOR and its Corporate Secretary, AGRIPINA
MIRAFLOR, with office address at Block 6 Lot 4-6, Bella Vista Homes,
Brgy. Santiago, Gen. Trias, Cavite hereinafter referred to as the SCHOOL,
- and –

_____________________, of legal age and a resident of


___________________________ hereinafter referred to as the
PARENT/GUARDIAN.

WITNESSETH THAT:

WHEREAS, SAINT GILBERT MYRA ACADEME INC., is an educational institution


engaged in the operation of Preparatory and Elementary School under the supervision and
regulation of Department of Education;

WHEREAS, the PARENT/GUARDIAN is the one responsible for payment of tuition fees,
books, uniform, miscellaneous fees and other school fees of his/her child/dependent who is a
student of the SCHOOL for the school year 2018 to 2019 ;

NOW THEREFORE, for and in consideration of the foregoing premises and in


accordance with the stipulations herein set forth, the parties have agreed as follows:

A. TUITION, MISCELLANEOUS AND OTHER SCHOOL FEES

(1.) Tuition, miscellaneous and other school fees shall be paid in accordance
with the schedule of payments;

(2.) Tuition, miscellaneous and other school fees for the entire school year
shall be deemed incurred upon enrollment. A student may only begin classes
upon payment of school fees and upon the presentation of the Admission Card;

(3.) Student withdrawal or transfer for any reason shall be charged the
following penalty/ surcharge based on the Tuition Fee for the entire year:

(3.1) 10% of the total tuition fee, if withdrawal/transfer is made within one week
from the start of classes;

(3.2) 20% of the total tuition fee, if withdrawal/transfer is made within two
weeks from the start of classes;

(4.) Reservation and Miscellaneous Fees are not re-fundable and non-
transferable;

(5.) Increase in tuition, miscellaneous and other school fees may be


implemented within the school year upon the DepEd approval of school
application for increase in fees for the current school year and depending on the
government’s mandate for wage hikes;
(6.) All books given or issued to learners must be PAID IN FULL, if
parent/guardian of the learner decides to transfer the learner to other school or
to stop schooling in this institution anytime within the school year.

B. LATE PAYMENTS

(1.) Surcharge/penalty for late payment is 4% per month or a fraction thereof


but not Less than Php 100.00

(2.) Dishonored/ Returned check payments shall be charged wih a penalty of


Php150.00 per check, regardless of amount and in addition to late payment
penalty under paragraph 1 above;

(3.) Dishonored/ Returned check payments shall be replaced with cash. Second
endorsement will not be accepted.

C. EXAMINATIONS
(1.) An Examination Permit is required for the quarter tests. The Cashier shall issue
the Examination Permit only if the student has no outstanding financial obligation/s;

(2.) Special Examinations shall be given only within five (5) school days after
regular examination/s. A fee of Php 50.00 per subject shall be charged for special
examinations.

D. INJURIES

1. The school and its officers, employees and agents shall not be responsible/liable
for injuries suffered by the student, through accident and without negligence or
fault in its part;

2. The parent shall be answerable for all damages and injuries caused by the
learners. In case of injury, authorization is hereby given for the learners to be
brought to any physician/hospital for emergency treatment. The cost of treatment,
medicine and other related expenses shall be for the parents concerned.

E. SCHOOL RECORDS

The release of school records of a student may be refused by reason of disciplinary


action, financial obligation and liability and in absence of Clearance.

F. EFFECTIVITY

This agreement shall only become effective upon the signing of this contract by herein
parties.

G. ENTIRE AGREEMENT. This CONTRACT constitutes and embodies the entire and
complete agreement between the parties and no other terms and conditions, verbal or
otherwise, not herein expressly contained, shall change, modify, be added to, or in any
manner, alter the provisions herein agreed upon unless such change, modification,
addition or alteration are embodied in a written agreement duly signed by the parties
and duly notarized.

H. SEPARABILITY CLAUSE. In the event that any provision of this CONTRACT shall be
declared invalid, illegal or unenforceable in respect by any competent court, the entire
CONTRACT shall be deemed canceled and/or terminated.
