PETITION

PETITIONER, through the undersigned counsel unto, this Honorable Court, most
respectfully states that:

1. PETITIONER is of legal age, Filipino citizen, and a resident of Danao

St., Davao City.

2. Whereas RESPONDENT - Civil registrar as Public officer is in-charge of

the registration and cancellation/ correction of entries in Civil Registrar
Office where the fact of birth of the said PETITIONER was registered,
which registrar is located at the Local Civil Registry Office of the City
Hall Compound, City of Davao, Province of Masbate, where it can be
served with summons and other processes of this Honorable Court;

3. PETITIONER, in truth, is the son of Papa Vega PITO and Vilma Santos,
which fact of birth was registered before the Office of the Civil Registrar
of the City of Masbate.

Copy of the Certificate of Live Birth with Registry No. 123 is attached as
ANNEX “A”.
4. Respondent’s parents Papa Vega PITO and Vilma santos had been living
together for few years as man and wife without the benefit of marriage but
finally celebrated their marriage on March 21, 2003 before the Municipal
Trial Court in Cities in Ormoc City, seven years after the birth of their son
Bryan, the herein respondent.

Copy of the Certificate of Marriage with registry No. 2003-321 is attached

as ANNEX “B”.

5. Early this year, 2019, the respondent was able to secure a copy of his
Certificate of Live Birth from the Philippine Statistics Office, however to
his dismay the following data appeared to wit;

5.1 The respondents name is Pedro Penduko

5.2 Respondent’s father is one Raul Baul.
5.3 Vilma santos and Papa Pipo married on March 31, 1995 in
Cainta Rizal

Copy of the Certificate of Live Birth with Registry No. 2000-2000 is

attached as ANNEX “C”.

6. The respondent’s mother never entered into marriage with one Raul Baul
nor did the petitioner know the person of the latter or his whereabouts. In
fact, there was not even an acknowledgement of filiation at the back of his
Certificate of Live Birth. Hence, a clear case of erroneous entry to the
disadvantage of the Petitioner.

7. In fact, the Petitioner was baptized at St. Giles Cathedral on December 21,
1996, six months after his birth, as BRYAN RYAN , reflecting his father’s
surname.

Copy of the Baptismal Certificate is attached as ANNEX “D”.

8. The PETITIONER has ever since used the surname of his father (PITO) in
all his school records and identification cards. In fact all his personal
records would show and bear PITO as his surname.

ANNEX “E series”

Copy of Petitioner’s Progress Report Card (DepEd Form 138-E) in Cogon

Elementary School from school year 2004-2005 is attached as ANNEX
“F”.

dated 1 September 2016 issued to Bryan V. PITO having completed
Elementary Level is attached as ANNEX “I”

Copy the Petitioner’s High School Diploma from New Ormoc City
national High Scholl is attached as ANNEX “J”.

Copy the Petitioner’s Bachelor’s Degree diploma from University of Rizal

System is attached as ANNEX “K”.

Copy of the Petitioner’s Official Transcript of Records from University of

Rizal System is attached as ANNEX “L”.

9. That having stayed in the Province of Rizal for five years, the Petitioner
was able to register as a qualified voter and later on was issued Voter
Certification with his true name PITO, RYAN.

Copy of the Voter’s Certification is attached as ANNEX “M”

Communications Corporation is attached as ANNEX “N”.

10.PETITIONER is likewise submitting herein as proofs of his identity,

namely, National Police Clearance, National Bureau of Investigation
Clearance, Barangay Clearance, Community Tax Certificate and Unified
Multi-purpose ID, all bearing the name PEDRO PENDUKO, to show and
prove his identity hereto attached as ANNEXES “O” “P”, “Q”, “R” and
“S”, respectively.

11. Furthermore, the Petitioner is submitting herein proofs of his parents

identity, to wit:

12. All told, the Petitioner’s true name is PEDRO PENDUKO and his
biological and true father is PAPA PITO, and this correct information
should be the one reflecting in his Certificate of Live Birth.

13.In order to correct or straighten out the aforementioned misinformation and

erroneous entries in his Certificate of Live Birth, Petitioner hereto files the
instant petition pursuant to Rule 108 of the Revised Rules of Court.

PRAYER
 WHEREFORE, premises considered, it is most respectfully prayed of this
Honorable Court that the order be issued directing the herein Respondent- Civil
Registrar of the City of Masbate, and the Office the Philippine Statistics Authority
and the Office of the General Civil Registrar’s Office of the Philippines to Correct
the wrong information data supplied on entry per “REGISTRY NO. 2000-
2000”, particularly the printed surname, from PUTO to PITO and the
father’s name from RAUL BAUL to PAPA PITO in the Certificate of Live Birth
of Said Petitioner.
