Direct JP Concepcion

On July 28, 2013 at about 4:30 o’clock in the afternoon their office received information that a
certain “Aaron” was selling drugs at Marisol Subdivision, Angeles City. Thereafter, their
commander, P/INSP Maniego conducted a briefing for the buy-bust operation against “Aaron”.
PO1 Concepcion was designated as the poseur buyer. He marked the P500 bill that was handed
to him by P/INSP Maniego.

He was the poseur-buyer in the buy-bust operation.

Photocopy of the marked money was identified. At about 7:45 in the evening, they proceeded
at 1st Street, Barangay Marisol, Angeles City. He stayed with the civilian informant while other
members of the team positioned at a distance. After about five (5) minutes Espiritu arrived in a
Nissan Frontier pick up. He approached the civilian asset. The civilian asset informed him that
they willshabu. He asked how much. Then, the civilian asset told him worth P500 shabu. Espiritu
handed the shabu to the civilian asset and then the civilian asset handed over the P500.

He was beside them when the transaction took place. Right after the transaction, he announced
that he is a police officer. Then, he executed the pre-arranged signal by raising his left hand for
his back-up to respond. The civilian asset handed to him the transparent sachet of shabu and
kept it inside his pocket. Immediately, the buy-bust team back-up went into the scene and
arrested the suspect. Particularly, it was PO3 Genaro David was the one who arrested the
accused. He handcuffed and searched the accused. PO3 Genaro David was able to recover the
P500 peso bill from the accused. Afterwards, the buy bust team conducted the inventory at the
place of the arrest.

Thereafter, they proceeded to the police station and prepared the Request for Technical
Analysis. Then, together with PO3 Genaro David, he delivered the specimento the Crime
Laboratory for examination. The result turn out positive for Methamphetamine Hydrochloride.
The investigator in charged for this case was PO2 J-sie Velasco.

TSN dated May 14, 2015 – Cross Concepcion

On July 28, 2013, a confidential informant went to their office to report a certain “Aron”, who
was involved in an illegal drug activity. They conducted a test buy before the actual buy-bust
operation. There was no barangay representative participated in the inventory. The DOJ
representative signed the inventory at his house while the Media representative signed it at the
police station. There was no photograph taken during the inventory and at the time they signed
the inventory report. It was after the arrest that the shabu was turned over to him by the
civilian informant. However, he do not know what happened to the drug at the time he was
conducting the arrest.

PO3 Genaro David (PO3 David) serves as one of the back-up in the buy-bust operation against
Espiritu. He was the one who arrested the accused.
