ADVERSE CLAIM

I, PEDRO B. BANTOLINO, of legal age, Filipino citizen, married, and a


resident of Nueva, Sta. Marcela, Apayao, under oath, hereby depose and state that:

FEDERICO BANTOLINO, married to FLORENCIA BELMONTE, appears to


the be registered owner of a parcel of land designated as Lot No. 141, described and
covered under Original Certificate of Title No. P-28181, more particularly described
as follows, to wit:

Lot No. 141, Gss-509

Beginning at a point marked “1” of Lot 141, Gss-506, being


S. 86-15 W., 472.04 m. from B.B.M. No. 25, Cad-272, thence
N. 37-00 E., 214.26 m. to point 2; S. 67-21 E., 303.65 m. to point 3;
S. 40-21 W., 20.65 m. to point 4; S. 30-52 E., 42.77 m. to point 5;
S. 53-26 W., 56-69 m. to point 6; S. 54-00 E., 35.00 m. to point 7;
S. 77-08 W., 30.00 m. to point 8; S. 57-44 W., 70.00 m. to point 9;
S. 39-29 E., 64.43 m. to point 10; N. 67-28 W., 382.18 m. to point 1;
point of beginning.
Containing an area of SIXTY NINE THOUSAND AND TWENTY EIGHT
(69,028) SQUARE METERS.

Said registered owner is already dead, without any will and debts, leaving
PEDRO B. BANTOLINO, the undersigned, and my mother, FLORENCIA
BELMONTE BANTOLINO as his compulsory heirs, being the legitimate
descendant of the deceased and his widow, respectively. Machine copy of my Birth
Certificate and my Marriage Contract are hereto attached and made integral part
hereof as Annexes “A” and “B”, respectively.

Being part of the conjugal property of FEDERICO BANTOLINO and


FLORENCIA BELMONTE, FEDERICO’s share over the said land consists of one-
half (1/2) thereof, or more particularly THIRTY FOUR THOUSAND FIVE
HUNDRED FOURTEEN (34, 514) SQUARE METERS.

Upon the death of FEDERICO BANTOLINO, I, therefore, inherited the said


one-half (1/2) portion of Lot No. 141 pursuant to the rules of intestate succession
under the New Civil Code of the Philippines, to the exclusion of my mother under
Article 978 of the same Code.

Recently, it has come to my knowledge that my mother, FLORENCIA
BELMONTE BANTOLINO and her relatives are appropriating, claiming and
arrogating as her/their own, the WHOLE of Lot No. 141, thereby disregarding my
clear and unequivocal hereditary right in the inheritance left by my father.

Under Article 978 of the New Civil Code, it crystal clear that the order of
intestate succession pertains, in the first place, to the direct descending line.

Obviously, my mother, FLORENCIA BELMONTE and her cohorts, do not


have any authority to sell, encumber or otherwise dispose of my just share in the
said land without my consent thereto.

Verily, unless an adverse claim is annotated at the back of the Original


Certificate of Title No. P-28181, my hereditary rights as the legitimate heir of the
registered owner, FEDERICO BANTOLINO, are in danger and I am at risk of being
deprived thereof.

Accordingly, I am executing this Affidavit to attest to the truth of the


foregoing statements, and to support the Register of Deeds of the Province of
Cagayan to annotate this Affidavit of Adverse Claim as an encumbrance of
Original Certificate of Title No. P-28181 covering the above-described parcel of
land, in order to protect my hereditary rights and for whatever legal purpose or
purposes it may serve.
