CONTRACT TO SELL

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT TO SELL, made and executed this ____ day of October
2019 by and between:

(NAME OF SELLER), of legal age, single/married, Australian, and with


residence and postal address at (Address), hereinafter referred to as
the "SELLER"; and

(NAME OF BUYER), Filipino and with residence and postal address at


(Address), hereinafter referred to as the "BUYER".

WITNESSETH, that;

WHEREAS, the SELLER is the absolute and registered owner of a parcel of


land consisting of THREE HUNDRED SQUARE METERS (300 SQ. M.), more or less,
located at # 109 Mt. Fairweather, Filinvest I, Quezon City and covered by Tax
declaration No. E-139-05480 and Transfer Certificate of Title (TCT) No. T-211787
issued by the Registry of Deeds of Quezon City and more particularly described as
follows, to wit;

A parcel of land (Lot 10, Block 34, of the cons. subd. plan (LRC) Pcs-
16631, being a portion of the cons. of Lots 28, 29 and 30, all described
on plan Psu-32606, L.R.C. Record No. 1037) situated in Capitol Dist.,
Quezon City, Bounded on the NE., points 4 to 5 by Lot 11, on the SE.,
points 5 to 1 by Lot 46; points 1 to 2 by Lot 47; on the SW., points 2
to 3 by Lot 9, all of Block 34; and on the NW., points 3 to 4 by Road
Lot 13, all of the cons. subd. plan. Beginning at a point marked “1” on
plan, being S. 43 deg. 40’ W., 7851.83m. from B.L.L.M. No. 1, Mun. of
Montalban, Rizal; thence S. 75 deg. 27’ E., 4.84 m. to pt. 2; thence N.
14 deg. 33’ W., 25.00 m. to pt.3; thence N. 75 deg. 27’ E., 12.00 m.
to point 4; thence S. 14 deg. 33’ e., 25.00 m. to point 5; thence S. 45
deg. 27’ W., 7.16 m. to the point of beginning; containing area of
THREE HUNDRED (300) SQUARE METERS, more or less. All points
referred to are indicated on the plan and are marked on the ground by
PS cyl. Conc. Mons. 15X60 cm., bearings true; date of the original
survey, not available and that of the cons.-subd. survey, executed by
Claudino R. Galingan, Geodetic Engineer, on Sept. 15-Dec. 20, 1973. -
x-x-x-x-x.

WHEREAS, the BUYER has offered to buy and the SELLER has agreed to sell
the above mentioned property under the terms and conditions herein below set
forth;

NOW THEREFORE, for and in consideration of the total sum of (AMOUNT IN


WORDS) (Php 000,000.00) Philippine Currency, payable in the manner herein
expressed, the SELLER has agreed to sell unto the BUYER, and the BUYER has
agreed to buy from the SELLER the said property, subject to the following terms and
conditions:

1. The BUYER agreed to pay the SELLER upon the execution of this Contract the
sum of (AMOUNT IN WORDS) (Php_____________________), as down
payment on account of the purchase price and agree to pay the balance of

(AMOUNT IN WORDS) (Php_____________________) within ___ months from
the date of this contract and upon delivery of the Title in the name of the BUYER

2. Capital Gains Tax and Real Estate Tax, shall be for the account of the SELLER;

3. Documentary Stamps Tax, Registration Fee, registration expenses, and all


other miscellaneous fees and expenses shall be to the account of the BUYER;

4. Possession to the subject property shall be delivered by the SELLER to


the BUYER upon full payment of the total consideration;

5. Upon full payment of the total price, the SELLER shall sign and execute
a DEED OF ABSOLUTE SALE in favor of the BUYER. The SELLER shall likewise
execute and/or deliver any and all documents, including but not limited to the
original copy of Transfer Certificate of Title, Tax Declaration and all other documents
necessary for the transfer of ownership from SELLER to the BUYER.

6. This Contract shall be binding and obligatory upon the heirs, successors,
administrators, and assigns of the respective parties.

IN WITNESS WHEREOF, the parties have hereunto affix their signatures,
