What intervention is for

Government procurement is one of the main economic drivers for the growth of a country's
internal wealth, because the State carries out a complicated administrative work, it finds it
costly and difficult to develop and build its own works of infrastructure, so it resorts to the
use of contractors who do the works for them, but that same deficiency to build their own
works, creates gaps in the control of those contracts, then resorts to another figure in this
case in the form of consultancy, to help coordinate, control, monitor and verify contracts,
this figure is currently called Interventory. Bibliographic information has been reviewed on
the functions of the controller and how he should perform his duties, and discrepancies
have been found between those expected and what is really happening, this situation has
led us to have to evaluate the present and this figure in Colombian public procurement,
through the research question, what is the point of the Interventory?
"The intervention is a consultancy service, so that on behalf of and on behalf of the owner
of the work, it exercises control and surveillance functions, over the acts necessary for the
execution of the work, aimed at ensuring that it is executed in accordance with plans,
documents, specifications, studies, costs and deadlines set, within the parameters of
compliance, quality and economy." (Torres, 2019)
The service that provides an intervention is simply to ensure that the deadlines, the quality
of our projects are developed in the stipulated time, of course you have unaffected none of
the factors of the triple restriction (Tempo, Costs, Quality) beyond the stipulated in the
planning and that in view of this there is no significant change within the initial plans, this
verification and monitoring function emanates from the faculty of management and control
over the execution of the procurement and the principle of liability, referred to in Articles 4
and 26 of Law 80 of 1993.
It is necessary to clarify that the intervention includes a function that goes beyond control
and surveillance and is to help for the fulfillment of the monitored contracted object, this
control co-aid process is carried out by the controller, which is considered specialized
management partner for the development of verification activities and to achieve
compliance with the object of the contract.
"what does an Interventor do? An Interventor carries out technical and scientific activities
to verify, measure and verify that the goods and services delivered by the contractor comply
with the specifications written in the contract; continuously monitors the technical, financial

and administrative activities of the contract; prepares management and results

chronological reports for the contractor; develops receipt certifications, payment
authorizations to the contractor; draws up minutes of commencement of execution, receipt
and final liquidation of the contract; mandatory delivery in writing to the contractor and
they must be framed within the terms of the respective contract."(Parra, 2014)
Among the functions that the controller does is to keep a strict control of the work
developing reports of progress of the same, checks that the quality of the materials is that
required by the project, also helps to that the fulfillment of the deadlines stipulated within
of the project are developed normally and in the best way, all framed within a respective
contract, and by the fact of having these functions they lead us to define their bone
responsibilities to assume the consequences of all those acts performed, such as:
Administrative responsibility enshrined in Article 90 of the political constitution "The State
shall be financially liable for the anti-legal damages attributable to it, caused by the action
or omission of the authorities. In the event of being sentenced to the patrimonial reparation
of one of these damages, which has been the result of the willful or seriously culpable
conduct of an agent of his, he must repeat against him". (colombia, 1981)It is based on the
anti-jurisprective damage caused by the action or omission of its agents, also including the
patrimonial responsibility of both pre-contractual and contractual status, making it
responsible for all the facts committed by omission of its work; within the functions that an
intervenor must perform we have:
"Control: This objective is the most important and is achieved through inspection, advisory,
monitoring, verification and evaluation, planned and carried out on a permanent basis on
the stages of contract development if the execution is in accordance with the agreed."
(FFMM, 2018)
When we talk about monitoring we can refer to the monitoring process that all the
contracted work is carried out within the quality framework requested by the contractor this
work must be kept immersed in all stages either post-contractual, contractual or pre-
contractual since the work of the intervener and on his behalf of the intervener should not
end when work on the work is finished as there plays a very important role in relation to the
guarantees of the materials acquired
"Request: This power materializes when the intervener asks the Contractor in a timely
manner, to remedy immediately, inaccuracies, that do not affect the validity of the contract
or the execution of the contract. This power is exercised when it seeks the imposition of a

penalty on contractual grounds, or issues its concept based on the feasibility of extension,
modification or contractual addition, among other matters" (FFMM, 2018)
This faculty is the one that has presented the person of the controller as "the bad guy of the
walk" since he is the person who analyzes the work carried out and if they present some
kind of erro, or pose a risk to the execution of the project, the intervenor must request his
c immediate timing as this could lead to contractual sanctions, another of the functions that
the intervener performs require with each of the agreements agreed within the contract
such as compliance with deadlines, execution of activities, personnel contracts etc.
But despite all the functions of an intervener, its simple existence does not guarantee or
guarantee the quality of the works so it could be assumed that the same concept has failed
for example in Colombia there are many cases of irregularities in contracts , where it has
been shown that the work of the intervention is wrong or simply not done. in the article of
Juan Manuel González and Leonardo Barón, FOR WHAT IS THE INTERVENTORY OF PUBLIC
WORKS IN COLOMBIA?, 2011, some of them are mentioned, and also detail the causes of
such failures, which are included in Lack of presence in the works , "cooperation with
contractors" which makes them highly permissive, and lack of support on the part of the
contractor due to "holes" in contracts.
Thus, the figure of the intervention should be present from the moment of planning thus
guaranteeing an active participation in the development of the same and thus be able to
participate in the decision-making that influences the execution of the same, although in
most the cases the figure of the intervener appears at the time of starting works there are
already other about its development that have been discussed are usually unknown to the
intervener, thus delaying the development of the contracted object.
But given all the events related to the process of intervention, a doubt arises, if the
intervention works?"The Interventory is defined as the set of functions performed by a
natural or legal person, to control, follow and support the development of a contract; ensure
its proper execution and compliance, within the terms set out in the current rules on the
matter and in the clauses stipulated by the contract" (castro, 2018)
By putting the previous concept of Engineer Carlos could assume the intervention as "The
Police of the Works" took into account that almost all definitions give or give the same
meaning a few more complete as others when adding competencies and functions, ETC, but
making a non-detailed Cruze about what is the intervention and what is expected of it we
find an abysmal gap within its meaning and its reality.

We can conclude that intervention is yet another contract and that as such it needs a
complete contract, which needs to be monitored, but curiously does not need an
intervention because the main engine of this is "trust".
