Good afternoon Mr. Cates,

Ray Nyhuis is still in office. He was originally appointed at the July 12, 2016 meeting. It was recently learned that Mr.
Nyhuis was not a registered voter at the time of his appointment; therefore, after he confirmed he became a registered
voter he was re-appointed at the May 9th meeting and all prior motions he voted on were ratified. Attached please find
a copy of Resolution 2017-1, which memorializes his appointment.

A RESOLUTION OF THE VILLAGE COUNCIL OF THE

VILLAGE OF LAZY LAKE, FLORIDA* APPOINTING RAY
NYHUIS AS A COUNCIL MEMBER OF THE: VILLAGE OF
LAZY LAKE TO SERVE UNTIL THE NEXT GENERAL
ELECTION IN NOVEMBER OF 2018; • PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERAfittiTY; PROVIDING
FOR AN EFFECTIVE DATE.

i^flEREAS, in accordance with Section 3 of the Charter of the Village of Lazy

Lake (the “Charter”), the Village Council shall fill the vacancy on the Council by a
majority vote of remaining members and select a duly qualified citizen to fill said
vacancy until the next general election in November of 2018; and

NOW; THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL

OF TRi VILLAGE OF LAZY LAKE, FLORIDA THAT:

SECTION 1. The foregoing "WHEREAS" clauses are true and correct and
hereby ratified and confirmed by the Village Council. All exhibits hereto are
hereby incorporated herein.

||ECTION 2. The Village Council of the Village of Lazy Lake, Florida hereby
appoints Ray Nyuis to the Village Council to serve until the next general election in
November of 2018.

SECTION 3. The appropriate Village officers are authorized and directed to

execute the necessary documents to comply with this Resolution.

SECTION 4. All Resolutions or parts of Resolutions in conflict herewith, be

and the same are repealed to the extent of such conflict

 SECTION 5. If any clause, section or other part of this Resolution shall be
held by any court of competent jurisdiction to be unconstitutional or invalid, such
unconstitutional or invalid part shall be considered eliminated and will in no way affect
the validity of the other provisions of this Resolution.

SECTION 6. This Resolution shall become effective immediately upon its

passage and adoption.
