I. Natne of the Proiect:-
In the teference lst read above, the Executive Engineer, Drainage Division,
Bhimavaiam submitted requisition for acquisition of land for Modernization
of
Gonteru Drain duly enclosing L.p. Schedules.
After verification of alignment, the Tahsildar, Narsapur Mandal has
proposed and initiated larld acquisition proposals for acquisition
of land

scrutiny, P.N. proposals have been submitted to the District Collector. W.c.
Eluru U/s.1 l(l) of the L.A. Act 2013.
2. Preliminary Notilication:-

The Preliminary Notification U/s.11{1) of the L.A. Act providing


with lS(2)
enquiry was approved by the collector, west codavari,
Eruru in E ofr. comp. No.
DTCL- 17021(31)/238/2015- supdt G(w@)/c2, Dt: 28.04.2015 for an extent of Ac. 5-53
cents covered by R.S. Nos. 144 etc., of K.Betapudi
Village of Narsapur Mandal.
The said notilication was published as provided
under Act.
Consequent on the publication of the preliminary Notification,
Form-VIB

to t}Ie land owners/ interested persons to lile objections if any and to attend
enquiry on 7-7-2015 at Sub-Collectors oilice, Narsapur. In response to the
Sec.15(2) notice, some of the land owners have filed objections against the
acquisition.

After obtaining field remarks from the Executive Dngineer, Drainage


Division, Bhimavaram, the remarks were reported to the Collector, W.G., and
after examination of all the facts, the Collector, W.G., issued Final orders vide E
Off. Comp. No. 526212015/c2t Dt: 11.08.2015 informing to the tand owners that the
objections of the farmers deserve no consideration and hence rejected the
objections and directed the LAO and Revenue Divisional Oificer, Narsapur to
serve these orders on the landowners concerned and to send Declaration in t}!e
LA matter. The orders were since served.

3; Declaration:-
Thereupon Declaration proposals were submitted to the Collector, W.C., for
approval for an extent of Ac.S-58 cents. The Declaration U/s. 19(1) of the L.A.
Act was approved by the Collector, WG., in
E Off. Comp. No. 5262lZOLSlc2, Dt:
28.8.2015. This notification was also got published as provided under Act.

4 (a) True Area:-


The Mandal Surveyor, Narcapur after due issue of notice U/s. 6 of the
Survey & Boundaries Act measured the land and prepared the sub_division
record for the lands under acquisition. The Divisional Deputy Inspector
of
Survey, Narsapur has pre-scrutinized the Sub-Division Record. The pre-
scrutinized extents as shown below are adopted in tl1e Declaration issued
U/s.

5. Uarket value:-
The Tahsildar, Narsapur has obtained registrauon sa,e
transactions on the sares taken
place for a period of 3 years preceding
the date of publication of preliminary
Notjfication. As per SRO Records, since there are
no sales taken place in K. Bethapudi Village for
the preceding three years from the date of preliminary
Notification (i.e.) from 28.04.2012 to
24.U.2015, the sale b-ansactjons taken ptace in the nearby
village of
Serepatem Mllage of
Mogalthur Mandal have been gathered.

As seen from the Registration Statistics for the preceding 3 years from the date of
publication of P.N. in these cases (i.e from 28.04.2012 to 28.04.2015), there are altogether S sale
transactions reportedly held during the three years crucial period (i.e.,) 2 sales in 2013 and 3 sales
in 2014 and no sales in 2012 & 2015 in the relevant period. Only sale deeds have been taken for
fixation of market value.

According to Section 26 of Right to Fair compensation and


Transparency in Land
Acquisition, Rehabilitation & Resettlement Act,Z013 (N0.30
of 2013) r,,ihich came in to force w,e.f
1.1.2014 following is the criterra in assessing and
determining the market varue of the lands
namely:-
a. the market value, if any, specifildrin tie Indian Stamp Ac! 1899 for the
reqistration of sale deeds or agreements to sell, as
the case may be, in the area,
where the land is situated; or
b. the average sale price for similar type of land situated in
the nearest vi age or
nearest vicinity area; or
c. Consented amount of compensation as agreed upon
under sub_ section (2) of
section 2 in case of acquisition of lands for pivate companies
or for public
private partnership projeds; whichever
is higher.

All the sale transactions taken place in the nearest


vicinity area situated in Serepalem
Village of Mogaltur Mandal, fetched a rate
of Rs. 4,O0,OOO/- per acre. Hence the averaqe sate price
is Rs. 4,00,000/- per acre.

In this instant case, the basic value of land under acquisition coyered by
R.S. Nos. 1441L etc., of K. Bethapudi Village of Narsapur Mandal as on the date of
Preliminary Notification is Rs. 5,00,000/- per acre, which is the higher value
when compared with (a) & (b) categories. The (c) category is not applicable in tiis
LA matter.
In view of ttre above, I have fixed the land value for the lands under
acquisition covered by R.S.Nos. 144/1 etc., of K. Bethapudi Village is
Rs.5,00,000/- per acre excluding statutory benefits and the same may be
approved.
Valuation of Trees & Structures:-
The Assistant Diredor, Horticulture, Jangareddigudem got assessed $te value of tO9
coconut trees at Rs. 1,21,294/- @ Rs. 1153.32 for bearing trees and @ Rs. 270.30 for pre_bearing
trees, The Forest Range Omcer, Territorial, Eluru has assessed the forest trees (ie) neem trees at
Rs. 1344/-.
There are no permanent structures are involved in the land covered by acquisition.

7I AWARD ENOUIRY:.
NoticesU/s. 2l&22 ol the L.A. Act have been published in the manner
prescribed directing the persons interested in the land to put-forth their
respective interest duly adducing documentary evidence for such interest within
a period of 3O days from the date of publication of the notice and also served to
the known interested persons with a similar request besides attending before the
Land Acquisition Ofhcer ald Revenue Divisional Officer, Narsapur for award
enquiry on 29-9-2015 and to give their Award enquiry statements. In pursuance
of the said notice, the land owners have attended to t}le Award Enquiry and
established their ownership on the notitjed land except the land owners covered
by R.S.No.205/ 1C Ac. O.2l cents.

8, CoraDensation:-
(a) Market Value:- The basic value of Rs. 5,O0,OOO/- per acre as on the date of
Preliminarr Notification has been frxed towdrds market varue of the rands covered
by acquisition. '

The land owner is entitled to get


the benefit of multiplication factor oI 1.2S
on the M.V. fixed as per the provisions of Schedule I of Act 30 of 2013 i.e., .The
Right to Fa.ir Compensation and Transparency in Land Acquisition,
Rehabilitation
and Resettlement Act, 2013,, read with Rule 2g of the "A.p. Right to Fair
Compensation and Transparency in Land Acquisition, Rehabilitation
and
Resettlement Rules, 2O 14".

lcl Solatiun:-
The land owners are entitled to get IOO% Solatium on the land value
arrived after multiplication as per para 7{b) above U/s.30 of the Right to Fair
Compensation and Transparency in Land Acquisition, Rehabilitation and
Resettlement Act, 2013.

(d) Additioral Market Vatue:-


The land owner is entitled to get Additional Market Value as per the
provisions of Section 30(3) of the Right to Fair Compensation and Transparency
in Land Acquisition, Rehabilitation and Resettlement Act, 2013 at @ ],2o/o per
annum on the market value fixed U /Sec. 26 from the date of the publication of
Preliminary notilication (3.S.201S) till the date of Award.
