Modes of Compliance with the Balanced Housing Requirement of UDHA of 1992

1. Participate in Community Mortgage Program (CMP). The developer of a main


subdivision project shall finance the acquisition and development of an identified CMP
project duly accredited by the NHMFC.
2. Joint venture between a developer of a main subdivision project and a developer of
socialized housing projects for the development of new socialized housing projects or
production of new socialized housing units. However, the developer of the socialized
housing project which is a party to such JV must first be accredited by HLURB.

Qualifications for General Accreditation:

If the developer of socialized housing project possesses the all of the following
qualifications:

2.1 It must be engaged in the development of socialized housing projects.


2.2 It must have produced at least five hundred (500) units.
2.3 It must have no pending cease and desist order (CDO) or suspension of license to
sell (LS) issued by any of the Regional Field Offices (RFO) of HLURB against it for
any of its projects.
2.4 It must have no unpaid fees, fine, penalties imposed by any RFOs against it for any
of its projects.

Qualifications for Limited Accreditation:

If the developer of socialized housing project do not qualify under general accreditation,
it may apply and qualify for limited accreditation in the following instances:

2.5 If more than fifty percent (50%) of the voting stock of the developer of the socialized
housing project is owned by the developer of the main subdivision project with
which the former will enter into a JV to be utilized as compliance with the balanced
housing requirement of UDHA; or
2.6 If more than fifty percent (50%) of the voting stock of the developer of the socialized
housing project and if more than fifty percent (50%) of the voting stock of the
developer of the main subdivision project, with which the former will enter into a JV
to be utilized as compliance with the balanced housing requirement of UDHA, are
owned by the same corporation

Application and Documentary Requirements

The developer of socialized housing project shall submit the following documents to the
RFO which has jurisdiction over the region where the principal office of the applicant is
located:
i. Sworn Application for Accreditation. The developer of the socialized housing
project must specify the name/s of the developer of main subdivisions with
which it may enter into JVs.
ii. Copy of the JV agreement with the developer of main subdivision project
stating that the socialized housing project shall be credited to a future
housing project.
iii. Certified True Copies of SEC Certificate of Registration, AOI, By-Laws
including amendments thereto and latest GIS submitted to SEC
iv. Copy of latest Audited FS and ITR
v. Proof of completion of the required number of units produced, i.e., either the
certified true copies of the COCs of the socialized housing project where the
required total number of produced units are located or a certification from
any of the RFOs stating the completion of the required number of socialized
housing units produced , if applicable.
vi. Certification from each RFO that the developer has no pending CDO, unpaid
fees, fines or penalties imposed by it against the developer on any of its
projects
vii. Copy of the official receipt of accreditation fee

3. Slum Upgrading. Development, upgrading and improvement of a slum or blighted area


to be certified by the NHA of the local government unit concerned.
4. Purchased of socialized housing bonds in HGC. (Is this still available?)
