Legal Services
About NALSA
Article 39A of the Constitution of India
provides for free legal aid to the poor and
weaker sections of the society and ensures
justice for all. Articles 14 and 22(1) of the
Constitution also make it obligatory for the
State to ensure equality before law and a
legal system which promotes justice on the
basis of equal opportunity to all. In 1987, the
Legal Services Authorities Act was enacted
by the Parliament which came into force on
9th November, 1995 to establish a nationwide
uniform network for providing free and
competent legal services to the weaker
sections of the society on the basis of equal
opportunity. The National Legal Services
Authority (NALSA) was thereafter constituted
at the National level.

To legally empower the marginalized and
excluded groups of the society by
providing effective legal representation,

To strengthen the system of LokAdalats
and other Alternate Dispute Resolution
mechanisms in order to provide for
informal, quick and inexpensive
resolution of disputes to the indigent and
underprivileged sections of the society
and minimize the burden of adjudication
on the overburdened judiciary.
Constitution of NALSA & SLSAs
At the national level, the Chief Justice of India
is the Patron-in Chief of NALSA. The Senior
Most Judge of the Supreme Court is the
Executive Chairman. The Central
Government in consultation with the Chief
Justice of India has also appointed a person
as the Member Secretary of NALSA.
Supreme Court Legal Services Committee
has been constituted to administer and
implement the legal services programme
insofar as it relates to the Supreme Court of
India.
In every State, a State Legal Services
Authority (SLSA) has been constituted with
the Chief Justice of the High Court as the
Patron-in-Chief and the Senior Most Judge of
the High Court as the Executive Chairman.
There is a Member Secretary for each SLSA.
In every High Court, a High Court Legal
Services Committee has been constituted
with a Judicial Officer as the Secretary.
At the District level, District Legal Services
Authorities have been constituted with the
District Judge as the Chairman of the District
Legal Services Authority and a Senior Judicial
Officer as the Secretary of the District Legal
Services Authority.
Similarly, at the Taluka Level, Taluka Legal
Services Committees have been constituted
to give effect to the policies and directions of
NALSA.

Functioning of Legal Services Institutions
NALSA lays down policies, principles,
guidelines and frames effective and
economical schemes for the State Legal
Services Authorities to implement
throughout the country.
Primarily, the State Legal Services
Authorities, District Legal Services
Authorities, Taluka Legal Services
Committees, etc. are mandated to discharge
the following main functions:
I To provide Free and Competent Legal
Services to eligible persons;
II To organize Lok Adalats for amicable
settlement of disputes;
III To create legal awareness about the
rights of the weaker and marginalized
sections of the society;
IV To implement the Schemes and policy
directions of NALSA through strategic
and preventive Legal Services
Programmes.
WHAT IS DELHI STATE LEGAL SERVICES
AUTHORITY
Delhi State Legal Services Authority was
constituted on 14.02.1996. The Hon'ble Chief
Justice of Delhi High Court is Patron-in-chief
and the next senior most Judge of the Delhi
High Court is the Chairperson of the Authority.
DSLSA has setup District Legal Services
Authorities in all Districts and an officer of the
Delhi Judicial Services is its Full-time
Secretary. The District Legal Services
Authorities are located at each Court complex
to make legal services easily accessible to
the litigants and residents of the area. At the
High Court level, High Court Legal Services
Committee has been constituted to provide
legal services.

Persons Eligible for Getting Free Legal
Services :

A member of Scheduled Caste or
Scheduled Tribe.

A woman or a child.
l
An industrial workman.
l
A person in custody, including a child in
protective home and a mentally ill
person in a psychiatric hospital or
nursing home.
l
A victim of trafficking in human beings or
beggar.
l
A person with disability such as
suffering from blindness, locomotor
disability, hearing impairment, mental
illness or retardation or leprosy cured.
l
A victim of mass disaster, ethnic
violence, caste atrocity, flood, drought,
earthquake or industrial disaster.
l
A Transgender with an annual income of
less than Rs. 2,00,000/-.
l
Senior Citizen with an annual income of
less than Rs.2,00,000/-.
l
A person with an annual income of less
than Rs.1,00,000/-.
Free Legal Services:
Free legal services entail the provision of free
legal aid in civil and criminal matters for those
poor and marginalized people who cannot
afford the services of a lawyer for the conduct
of a case or a legal proceeding in any court,
tribunal or before an authority. Legal Services
are provided in all cases of civil nature such
as property disputes, matrimonial and child
custody matters, labour or service law
matters, compensation in motor accident
cases, consumer disputes etc., cases
involving criminal offence, cases involving
violation of fundamental rights guaranteed by
the Constitution of India and cases of great
importance.

Provision of free legal aid may include:
a Representation by an Advocate in legal
proceedings.
b Preparation of pleadings, memo of
appeal, paper book including printing
and translation of documents in legal
proceedings;
c Drafting of legal documents, special
leave petition etc.
d Rendering of any service in the conduct
of any case or other legal proceeding
before any court or other Authority or
tribunal and;
e Giving advice on any legal matter.
Free Legal Services also include provision of
aid and advice to the beneficiaries to access
the benefits under the welfare statutes and
schemes framed by the Central Government
or the State Government and to ensure
access to justice in any other manner.
How to apply for legal aid?
l
A person in need of free legal services
can approach the concerned authority
or committee through an application
which could either be sent in writing or
by filling up the form prescribed by the
Authorities stating in brief the reasons
for seeking legal aid or the grievance.
l
If the applicant is illiterate or is not in a
position to write, the Member Secretary
or any officer of the legal services
Authority/Committee shall record his
verbal submission and obtain his thumb
impression/signature on the record and
such record will be treated as his
application. A para legal volunteer can
also assist the person while filling the
application form.
l
The applicant shall be required to verify
the eligibility criteria for seeking legal
services.

When can legal services be withdrawn?
When the aided person is possessed of
sufficient means.
l
Where the aided person obtained legal
services by misrepresentation or fraud.
l
Where the person engages a legal
practitioner other than the one
assigned by the Legal Services
Authority/ Committee.
l
In the event of death of the aided person
except in the case of civil proceedings
where the right or liability survives.
l
Where the application for legal services
or the matter in question is found to be
an abuse of the process of law or of
legal services.
Whether and where appeal can be filed for
denial of legal services?
Yes, appeal can be made to the Chairperson
of the Authority/Committee on denial of grant
of legal services within a reasonable time.
Whether and where complaints or
suggestions can be filed?
Yes, Complaints/Suggestions are welcome
for improvement in the provision of free legal
aid and services.
Complaints/suggestions can be sent by post
or email addressed to the Member
Secretary/Secretaries or deposited in the
complaint boxes placed at the Legal Services
Clinics or Front Offices for this purpose.
Lok Adalats:
Lok Adalat is an important Alternative
Disputes Resolution Mechanism available to

a common person. It is a forum where the
disputes/cases pending in the court of law or
at pre-litigation stage are settled/
compromised amicably. Under the Legal
Services Authority Act, 1987 an award made
by a Lok Adalat is deemed to be a decree of a
civil court and is final and binding on all parties
and no appeal lies against thereto before any
court.
Lok Adalats are being organized by the Legal
Services Authorities/Committees for
settlement of cases pending before courts u/s
19 of the Legal Services Authorities Act, 1987
and also for matters at pre-litigative stage.

Chapter VI-A had been inserted in the Legal
Services Authorities Act, 1987 in the year
2002, with a view to provide compulsory pre-
litigative mechanism for conciliation and
settlement of disputes relating to Public Utility
Services ('PUS'). PUS are those relating to
transport service,postal, telegraph or
telephone service, supply of power, light or
water to the public, system of public
conservancy or sanitation, service in hospital
or dispensary or insurance service. Pursuant
to this, Permanent Lok Adalats have been set
up in most states.
Legal Awareness Programmes:
The Legal Services Institutions are mandated
to conduct legal literacy and awareness
programmes about the rights of the weaker
and marginalized sections of the
society.These awareness & legal literacy
programmes are organized not only in cities &
towns but also in rural and remote areas.
Legal literacy clubs and clinics have also
been set up in schools and colleges.
The legal awareness programmes cover
issues such as Child Rights, Rights of Senior
Citizens, Unorganised Workers,
Transgenders,Jail Inmates, Mentally ill and
Persons with Disability, Disaster Victims and

Citizens) Scheme, 2016.
Delhi Witness Protection Scheme 2015
With the avowed objective of ensuring that
witnesses are able to depose and testify in
courts without fear and taking a holistic
approach to witness protection, the Delhi
Witness Protection Scheme, 2015 was rolled
out which finds no parallel in the rest of the
country. Delhi State Legal Services Authority
is the competent authority for the
implementation of the Scheme.
The scheme lays down steps to protect the
identity of witnesses like: prohibiting the
publication or revealing, in any manner,
directly or indirectly, the name, address and
other particulars which may lead to the
identification of a witness; changing the
identity of a witness; relocating the person,
facility for in-camera proceedings and 'live
link', in which a witness can depose without
coming to court, ensuring that witness and
accused do not come face to face during
investigation and trial.
The witness has to apply for protection
following which DSLSA will seek a threat
analysis report from Delhi Police. Depending
upon the urgency in the matter owing to
imminent threat, orders can be passed even
for the interim protection of the witness and/
or his family.
Delhi Victims Compensation Scheme,
2015
An essential aspect of securing Access to
Justice for All is ensuring that nobody is
deprived of an opportunity to seek justice
merely for want of funds. Moreover, victims
also need to be compensated for loss or injury
suffered as a result of the crime. With this
objective the Delhi Victim Compensation
Scheme, 2011 was brought out which
provides for compensation to the victims or
their dependents who have suffered loss or

injury as a result of the crime and who require
rehabilitation. The Scheme has now been
revised and Delhi Victim Compensation
Scheme, 2015 has become effective from
23.12.2016. The latter lays down higher limits
of compensation which can be granted to
victim of crimes. The Scheme is administered
throught the Delhi State Legal Services
Authority.
The Scheme provides compensation for loss
of life, victims of rape (including gang rape),
victims of unnatural sexual assault, loss of
limb, burn victims, victims of human
trafficking, victims of grievous injury,
miscarriage, acid attack victims. The
compensation is provided between the range
of Rs. 50,000 to Rs.10 lakhs. The Delhi State
Legal Services Authority can also order for
interim relief (including medical or monetary
compensation) to alleviate suffering of the
victim.
An application for award of interim/final
compensation can be filed by the Victims and/
or their dependents or the SHO of the area
along with a copy of First Information Report
(FIR), medical report, death certificate, if
available, copy of judgment,
recommendation made by a Court before any
of the District Legal Services Authority for
disposal.
Comprehensive Standard Operating
Procedure (SOP) for “One Stop Centres in
Delhi”
Delhi State Legal Services Authority has
brought out a comprehensive Standard
Operating Procedure (SOP) for “One Stop
Centres in Delhi which provides for setting up
One Stop Centres at three places, one in the
hospitals, second in the District Court
complexes and third at police stations.
One Stop Centres (OSC) are intended to
support women facing any kind of violence
due to attempted sexual harassment, sexual
assault, domestic violence, trafficking,
honour related crimes, acid attacks or witch-
hunting, irrespective of their age, class, caste,

Scheme for Financial Sustenance,
Education & Welfare of Children, 2013
Taking up the issue of providing financial
sustenance, education and welfare of
children who are left to their own resources on
incarceration of one or both surviving parents,
the Scheme for Financial Sustenance,
Education and Welfare of Children, 2014 was
brought out.
The objective of the scheme is to provide
financial assistance to such children so that
their growth shall not be hindered and they
shall develop into physically fit, mentally alert,
morally healthy educated citizens.
Assistance may include financial assistance,
provision for free education for children by
treating them as Economically Weaker
Section, provision for protective environment
and welfare measures for the child including
medical treatment and provision of free legal
aid for interaction with incarcerated parents.
The parents of should be ordinarily living in
Delhi for the last 5 years and period of
incarceration should not be less than 30 days.
