ORDINANCE No. 5, series of 2006


“AN ORDINANCE PRESCRIBING GUIDELINES AND REGULATIONS IN THE
OPERATION AND SERVICES OF INTERNET CAFES, STATIONS AND CENTERS
IN THE CITY OF KORONADAL AND FOR OTHER PURPOSES

Internet stations/centers/establishments shall follow the following guidelines;

4.1 Internet stations/centers/establishments shall secure a Business Permit and other


licenses from the Local Government Unit.

4.2 Internet stations/centers/establishments which offer a combination of other services


as defined in Section 2.2 of this Ordinance shall declare in their business permit
other lines of business other than internet services.

4.3 Internet stations/centers/establishments should not allow students to stay in the


premises of the establishment during their class hours unless for specific
educational or study purposes such as data research or statistical gathering
provided that they can present CONSENT CARD duly signed by their parents/
guardians and school principal or authorized representative.

The school shall design and provide for free the CONSENT CARD which shall
contain at least the following information among others; Name of students, Name
of School, Purpose, Date- time- period sanctioned by both parents/ guardians
and school principal/ authorized representative for the use of computer.
Written name and signatures of parents/ guardians and school principal/
authorized representative.

It shall further be the duty of the owners, operators or person- in- charge thereof
to validate the information and authenticate the signatures of both of parents/
guardians and school principal/ authorized representative in the consent card.

4.4 Internet stations/centers/establishments shall not offer online and network gaming
services during class hours to students. Furthermore, owners shall prohibit students
from playing computer games even during holidays, weekdays and weekends
beyond ten (10:00) PM.

4.5 Prohibited drugs, intoxicating drinks, selling of cigarettes and smoking are prohibited
inside Internet stations/centers/establishments.

4.6 Selling of food and meals are allowed only when Internet
stations/centers/establishments have declared in their original permits or the permit
of their businesses.

4.7 Internet stations/centers/establishments shall not allow internet hackers or cause


computer hacking to be practiced in the premises.

4.8 Internet stations/centers/establishments must post in conspicuous places within the


establishment a warning sign against accessing pornographic, satanic, rebellious
and violent sites and playing of games by students during class hours on school
days.

4.9 Internet stations/centers/establishments must be well lighted and properly


ventilated.
4.10 Internet stations/centers/establishments offering a combination of services such as
research and games shall either provide head phones for every unit being used for
gaming or reduce the volume of the gaming unit so as to prevent excessive sound
that could disturb other users. Such establishments may play music at a moderate
volume.

4.11 Internet stations/centers/establishments must not use or construct fully enclosed


cubicle for every computer. Only division in between the sides of computer unit be
allowed. If the owner opts to construct a half closed cubicle, it should be
transparent and the same shall not be draped with curtains and or blinds.

4.12 Internet stations/centers/establishments offering the use of web cameras or web


cams must not allow its users to use it for obscenity and lewd designs.

4.13 Internet stations/centers/establishments shall install a filtering software or


computer- blocking program that would prevent access to websites offering
pornographic information or materials offering pornographic information and
violent games.

4.14 Internet stations/centers/establishments shall not tolerate or promote indecent,


lewd and immoral behavior inside the establishment.

4.16 Internet stations/centers/establishments must be accredited by the Board.

Violators of this Ordinance shall be subjected to the following fines and penalties;

A. STUDENT – any student found guilty violating this Ordinance shall be apprehended
and confined immediately at the City Social Welfare and Development Office
(CSWDO) for not less than two (2) hours but not more than four (4). Thereupon, the
CSWDO shall conduct orientation to the student so apprehended on proper values.

B. INTERNET CAFÉ/ STATION OWNERS, MANAGERS AND/OR


ADMINISTRATORS:

1st Offense – P2, 000.00 fine & 5 days suspension of business operation
2nd Offense -- P4, 000.00 fine & 2 weeks suspension of business operation
3rd Offense - P5, 000.00 fine & revocation of business permit
