AGREEMENT OF

THE ABC RESIDENCY RESIDENTS ASSOCIATION


THIS AGREEMENT OF ASSOCIATION OF PERSONS is made at Surat this 26th day of January
in the Christian year Two Thousand Fourteen.

The owners of individual flats of The ABC Residency, VIP road, Vesu, Surat 395007 (herein after
called the members) who are the signatories at the bottom of this deed, have consented to from
an association of persons (AOP) in the name and style of The ABC Residency Residents
Association, (herein after referred to as ‘AOP’), for the purpose of smooth and efficient functioning
of the common facilities and amenities provided in The ABC Residency as well as to properly and
efficiently address their common issues related to The ABC Residency.

Owners shall hereinafter include their Power of Attorney Holders, legal heirs, etc.

Members of the AOP has consented to adopt 08 Bye-Laws mentioned as hereunder. The
members have also consented to follow an honor the same in totality from January 26th 2014.

The Bye-laws mentioned hereunder are subject to revision from time to time as deemed fit by the
executive committee appointed by the members of the AOP through resolution passed in the
general body meetings.

All honorable members (the owner of individual flats or their representative on their behalf or
tenants as the case may be) shall ensure that they have read these Bye-Laws and understood
them fully and as a token of acceptance of the same they have put in their signatures on the last
of this document and individual pages initialized by the President/ Vice President/
Secretary/Treasurer.

1. Bye-law no. 1: Constitution of the executive committee and its Functioning-

i. Constitution of the Committee


Every year in the month of January, a General Body Meeting shall be called to
appoint Executive Committee of AOP. The Committee shall be appointed mainly
by consensus of majority of members and only in case of disputes, secret voting
shall be carried out. If found suitable and necessary, there can be more than two
persons for each portfolio in the joint capacity.

ii. Tenure of the committee:


The tenure of the committee thus appointed shall be of one year, only extendable
up to 6 months. The same persons can be re-appointed with the consent of
majority of members of AOP. If more than 50% of the members decide to change
the tenure of the committee, then the general body shall call an emergency
meeting of the members and appoint a new executive committee with consensus
of majority of members and only in case of disputes, secret voting shall be carried
out.

iii. The office bearers and functioning of the Executive Committee:


The Executive committee shall have the right to take any common decision from
time to time on behalf of AOP on any issue common in nature. The decision shall
be binding on all the owners of The Apartment unless the same is overruled by
the decision taken in the General Body Meeting called from time to time, The
members will have the right to call for the General Body Meetings at any time
provided minimum 1/3rd of the members gives written consent for the same. The
executive committee shall consist of 15 members and shall have the following
office bearers amongst the selected or elected members as the case may be by
way of nomination or if required by way of secret voting.

2) Vice President
3) Secretary
4) Treasurer

The entire maintenance fund generated for the maintenance of the Flats shall be
deposited in the reputed banks and shall be operated by the President/Vice-
President/General Secretary and Treasurer jointly. Signature of minimum two
persons, out of which one must be Treasurer shall be required for the withdrawal
of money from bank.

2. Bye-Law no. 2: Deposition of Maintenance charges:


Necessary Amount as a Maintenance charges shall be collected from every individual
owner of the Flats. This amount shall be fixed by the the executive committee or as
decided by the general body meetings. All the flat owners are bound to pay the
maintenance charges as it shall be collected for the upkeep of the apartment.

3. Bye-Law no.3: Removal of Tenants-


The executive committee shall have the right to ask the Flats Owner to remove the tenant
(if any) in case of any extreme condition, for which the committee shall provide objective
evidences that the tenant is creating nuisance in The Apartment which is not good in the
overall interest of the inmates of Apartment.

4. Bye-Law no. 4: Registration of a Service Society:


AOP through its executive body shall work towards forming a registered service society
for the upkeep, general administration, legal administration, etc. of the The ABC
Residency Appartment, VIP Road, Vesu, Surat

5. Bye-Law no. 5: No Direct Instructions


In normal circumstances no direct instructions shall be given to any service provider of the
appartment. Only in case of emergency and for the sake of common interest a member
can give any direct instruction. However such instruction shall be timely informed to the
executive committee members.

6. Bye-Law no. 6: Outsider movement-


All individual flat owners shall take due care for not allowing/ encouraging/ insisting for
bringing any outsider unknown to the members inside the Flats in order to have proper
security of the Flats inmates. Any vendors/hawkers other than Newspaper hawker/milk
hawker are not allowed inside the Flats from the security point of view.
7. Bye-Law no. 7: Tampering with Services-
No member of AOP is allowed to disturb/alter/tamper the common services appliances
such as water valves, water tank covers, cable network connections, water pump/motor
etc, directly. Any complaint of the same is to be lodged with the respective member of the
executive committee who will arrange for attending the complaints

8. Bye-Law no. 8: Dealing with the Developer -


AOP through its executive committee shall keep a status check with the Developer – M/s
Shaurya Infrastructure, for completing the apartment facilities which were promised,
completing the legal formalities such as title clearance of the apartment, maintenance
collection on behalf of the unsold flats by the developer, etc.
