HOMOPARENTAL ADOPTION

INTRODUCTION

Since economic, cultural and political world contexts are constantly changing and
evolving in society, you can not ignore that gay couples are also part of that change, and
express this transformation, the desire to form a family.

The same-sex couples, unable to procreate on their own, would be opting for the
adoption of an infant as a valid option to achieve the goal of homoparentalism, but
given by different socio-cultural obstacles that this group of society must face in the
context in which they live, this option would be difficult, even impossible.

On the other hand, according to a UNICEF report, worldwide, 2.7 million children live
in orphanages (Petrowsky et al., 2017). Therefore, homosexual adoption should be a
valid option without any hindrance to this type; since a wider range of people who can
take less abandoned orphanage children. Because the Urban Institute (2017) showed
that 52% of gays and 41% of lesbians would be willing to adopt them.

"Over 25 years of research prove that there is no relationship between sexual orientation
of parents and the emotional, psychological and behavioral development" in raising the
child (Pawelski et al., 2006, pp. 349-64), ie that is not relevant that orientation or gender
of progenitors for the welfare of children (Biblarz & Stacey, 2001). Therefore, the
homoparental adoption should be permitted and recognized without discrimination and
hindrance of any kind alternative; because what is not relevant to raising a child, you
can not influence in any way -positive or negative in their integral development;

Similarly, comparative studies by psychologist Abbie Goldberg (2007) showed that gay
parents scored higher on parental responsibility, that is in effect on school performance
of the child, mental, emotional health or social development, tolerance and be more
likely to understand the role of equitable relationships, when being evaluated for their
ability to educate a child than heterosexual parents who had children by accident. Thus,
the homoparental adoption could be a more recognized and this allowed without any
hindrance alternative; Given that, who better rated on attributes of parental
responsibility to raise a child should be able to adopt a child for international adoption
or in most countries, They take into account the capacity to be guardians of couples, as a
requirement for adoption. (Goldberg, 2007).

Likewise, gay parents have more motivation and commitment to raising a child than the
average heterosexual parents hence the adoption by parents and gay couples should not
present any obstacle to be recognized and allowed; as a father with greater motivation
and commitment, should be able to adopt a child because the motivation and
commitment of parents are key to raising a child according to Goldberg (2007), and that
would qualify as fundamental attributes to acquire and legitimize infant adoption.

On the other hand, denying legal paternity, through adoption, to one or both parents
prevents "children enjoy legal and psychological security that comes from having two
loving, capable and loving parents" (Portugal, 2011, p . 3). Therefore, the adoption of
children by homosexual couples should not present any discrimination and interference
to take place; since, according to the American Academy of Pediatrics he states that
"children are to be adopted have the right to know that their relationships with each of
their parents are stable and legally recognized" (Portugal, 2011, p. 3), ie legally
recognized parents, greater safety for the child who needs family.

Similarly, the Legal theory paternal affiliation of procreational Will of Diaz de Guijarro
(cited in Perez, 2016, p. 19), allows same-sex conform families with children, which
have been obtained either by the method assisted reproduction, have recognized the
biological children of their partners, or have adopted a child. For this reason the
adoption of children by couples made up of individuals of the same sex should be
allowed and recognized this alternative affiliation be an alternative and recognized
permitted without discrimination and hindrance of any kind; Whereas parents are the
ones who will have a procreational (an intention of parenting) and not only those able to
bear children biologically.

In conclusion, we can say that there is no sufficient reason or scientific basis, to hinder
and not acknowledge paternity homosexual couples who show the desire to form a
family from adopting, as the evidence suggests that sexual orientation and/or parent
does not adversely affect the overall development of the child way, allowing this type of
family formation is completely valid, in addition to primary welfare child's right to have
a family, with parents legally recognized.
