MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Agreement is made and entered into this ____ day of ___________, 2018 at ______________,
Zamboanga Sibugay by and between:

__________________________________, of legal age, a duly authorized representative of ALBE

Enterprises with office address at Brgy. Don Andres, Ipil Zamboanga Sibugay, hereinafter
referred to as the FIRST PARTY

- AND -

__________________________________, of legal age with residential address at

__________________________________, Zamboanga Sibugay, hereinafter referred to as the
SECOND PARTY

WITNESSETH THAT:

WHEREAS, ALBE Enterprises, duly represented by the FIRST PARTY, was able to secure a contract for the
construction of a Day Care Center in the Municipality of Payao, Province of Zamboanga Sibugay. The FIRST PARTY
was tasked to complete the said contract within a period of two (2) months from the signing of this contract. Thus,
the FIRST PARTY would need the services of a construction foreman to help him complete the job within the said
period.

WHEREAS, the SECOND PARTY was offered the job as construction foreman by the FIRST PARTY and
the SECOND PARTY accepted the offer;

NOW THEREFORE, for and in consideration of the above premises, the Parties hereby agree as follows:

1. The FIRST PARTY obligates to pay the SECOND PARTY the total sum of P200,000.00
(excluding materials) which represents the “Total Salary” for the entire, whole, total, perfect and
full completion of the construction of the Day Care Center. The payment shall not be made in full
but only in installment on the month and day determined by the FIRST PARTY;

2. The parties agree that all salaries of the workers including the salary of the SECOND
PARTY shall be chargeable only to the Total Salary;

3. The salary of the workers shall be paid on a weekly-basis and on Saturdays;

4. The SECOND PARTY shall engage the services of other workers to help him complete
the construction project within a period of two (2) months from the signing of this contract;

5. The SECOND PARTY shall undertake to manage, supervise, and construct from 0
percent of the project up to 100 percent or completion of the construction project;

6. The parties agree that the construction project shall be deemed completed only upon
the entire completion of the construction project and upon approval of the concerned agency of
the Municipality of Payao that the said project is good for turn-over to the said Municipality;

7. The parties agree that the SCOPE OF WORK of the SECOND PARTY shall include but not
limited to the following:

a. Construction of Sub-base
b. Roofing
c. Installation of Septic Tank
d. Floor Elevation
e. Installation of Grills, Windows and Doors
f. Electrical Works

g. Painting Works
h. Other scope of works related to the project.

8. The SECOND PARTY agrees that he shall supervise and manage the use of the
construction materials. Any unaccounted or lost construction material shall be at the expense of
the SECOND PARTY;

9. This Agreement shall take effect immediately upon the signing hereof.

IN WITNESS WHEREOF, the Parties have hereunto affixed their signatures on the date and the place

ACKNOWLEDGMENT

BEFORE ME, a Notary Public for and in the Municipality of Ipil, Zamboanga Sibugay, the parties personally
appeared who presented to me their competent proof of their identity and known to me and to me known to be
the same persons who executed the foregoing instrument and acknowledged to me that the same is his/her free
act and voluntary deed.

This instrument, consisting of two (2) pages, including the page on which this acknowledgment is written,
has been signed on the second page of this instrument by the concerned parties and the witnesses, and all pages
are sealed with my notarial seal.
