EXECUTTVE OFFSHORE SDN BHD
Definttions
In these Terms and Conditions:
Contract: means the Contract signed by you, as the seafarer,
and us on behalf of the owner of the Ship.
Contract Period: means the period specified in the Contract.
Home Port: means the national/ international airport at the
city stated as the Port of Engagement while joining and Port of
Repatriation while signing off in the Contract
Ship: means the Ship named in the Contract
These Terms: means these Standard Terms and Conditions of
Employment
Us: means 'Executive Offshore Sdn Bhd" and/or any
subsidiary, subcontractors or any company within the same
group from time to time.
You/ your: refers to and means the seafarer named in the
Contract
DSV: Diving Support Vessel
ROV: ROV Support Vessel
CSV: Construction Support Vessel
/ ROV / CSV
OSV: Offshore Support Vessel other than DSV
Contract Cessation: coming to end of this employment
contract due to completion of contract period, early termination
of contract specified in this contract or on your demise.
PPEr Personal prctective equipment refers to protective
clothing, helmets, goggles, or other garments or equipment
designed to protect the wearefs body from injury.
2 Appointment and Employm€nt
2.1 Your employment and entitlement to wages and other
remuneration shall commence on the date of departure from
your home port.
2.2 Your employment continues under the Contract and is subject
to these Terms until the date of sign off from the vessel.
2.3 we expect you to have and apply the qualifications, skills and
experience appropriate for the rank specified in the Contract
and other qualifications, skills and experience indicated by you
during your application to Employer.
zt If the Contract is your first employment with us, then the first
month of your employment shall be probationary.
2.5 &rring your Contract, you may be re-assigned at any time to
any type of Ship operating anywhere in the world, in which
case the provisions of clause 6 shall apply. If you are assigned
b a different class of ship then your Contract Period may be
extended or reduced (depending on the normal contract period
br ships of the type to which you are assigned, pro-rata to the
Contract Period not served on the original type of Ship). So, a

transfier to a DSV ROV I CSV from an OSV may result in a
sfiortening of your Contract Period. For a transfer to a
diftrent ship due to promotions or any other reasons, the
costs of the equivalent certificates and licenses (if required)
will be on your account. Refusal to transfer to another vessel
will be considered as resignation.
2.6 We may reguire you to attend training courses ashore or on
board the Ship. We may also require you to attend to the
building or inspection of new ships, either afloat or on the
building berth. If accommodation is not available on board the
vessel, then we will provide alternative accommodation and
arange for transport if necessary.
2.7 We may assign you to work on other ships under management
by us or for persons who are our principals. However, under
such circumstances, your conditions of service, salary and
other benefits shall be equivalent to those specified in the
Contract.
2.A You may be required to work in the engine room or on deck.

work on staging, in a Bosun's chair, in tanks, under the bridge
wings, on masts or over the side of the Ship whilst the Ship is
at sea or in port. You may also be required to man/ work from
the rescue craft, board other vessels as deemed safe by the
Master in the nature of vessel's charter requirements,
2.9 In the circumstance that you have been certified medically
unfit by the company doctor for offshore work then the offer
letter or contract of employment issued to you will stand to be
null and void.
2.10 If on company's instruction you have travelled from your home
port and while undergoing medicals to comply with FIag state
or charterer's requirements are certified unfit for offshore
work, your contract stands terminated with immediate effect.
Company will arrange for you to be repatriated back to your
home port as specified in contract of employment.
2.11 You shall hold at your own time and cost valid STCW
Certification and other Industry Certification required by
Petronas Crew HSE Matrix for crew servlng on Offshore
Support vessels in Malaysia.
2.12 The company will arrange and pay for any Company /
Charterer Specific Training over and above that mentioned in
2.11 above.

Contract of Employment.
3 Contract Period
3.1 The Contract period shall be as mentioned in your contract of
employment and we will endeavor to have you signed olf and
repatriated prior to the expiry of the Contract Period. In the
event crew change cannot be effected due to circumstances
beyond our control (such as delay in vessel returning to port,
work permit issuance, etc.), your contract remains valid and
you wil, continue to perform the duties assigned to you
onb@rd till such time that the crew change can be carried out.
We will make every effort to expedite your relief in such cases.
Any violation or breach of agreed contract period will be
subjected to disciplinary and/ or legal action. If the Ship
becomes a total loss or is laid up or ceases to be under our
management then we may need to terminate the Contract
before the expiry of the Contract Period although we will
endeavor to assign you to another ship.
3.2 The Contract Period may be varied if you are transferred to a
different type of ship. By consenting to the transfer you are
consenting to any extension or reduction in the Contract
Period.
3.3 If you are promoted on board then you will be required to sign
a new contract,

4.1 We shall arrange travel for you from your Home Port to the
Ship or the shipyard, as applicable, at the start of your
Contract and to repatriate you to the same Home Port on
Contract Cessation.
4.2 We shall also arrange for necessary vlsas for you to travel from
your Home Port to the Ship or the shipyard and, at Contract
Cessation, from the Ship or the shipyard to the Home Port.
4.3 All air travel shall be economy class (including seaman class or
other dlscount class of tickets). You shall be responsible for all
baggage charges (if any) for baggage in excess of the baggage
allowance stipulated in your air-ticket.
4.4 We shall pay for air-fares, security charges, taxes and visa fees
in respect of the above-mentioned travel. No refunds shall be
made in lieu of airfares.
4.5 In case ofjoining and repatriation, all costs of your travel from
your residence to and from the airport at your Home Port shall
be bome by you.
