Washington State Horse Expo will not be held responsible for any statements made by
sellers. Please represent your horse honestly and completely as possible.

Showcase Sale is limited to 24 horses. These horses will be selected from the
applications received. Management will choose the horses that best fit the saleʼs quality
standard. Payment must accompany application- however, should your application
be denied, payment will be returned in full.

TERMS AND CONDITIONS OF AGREEMENT SHOWCASE SALE

LIABILITY Showcase Sale Participant (horse owner/rider) agrees to indemnify and hold harmless Washington State Horse Expo ,
including its principles, agents, officers, directors, employees (collectively, referred to herein as “Management”) and Management’s
contractors and invitees from all claims, losses, costs, damages or expenses resulting or arising from any and all injuries to or death
of any person or damage to any property, including those caused by an act, omission or neglect of Sale Participant, its principles,
agents, officers, directors, employees, invitees or contractors which occur in or about the Sale. Sale Participant agrees to partici-
pate at Sale Participant’s own risk, and hereby releases Management and Management’s contractors and invitees from all claims for
any damage, loss or injury to persons or property to the full extent permitted by law occurring in or about the Sale, including, but not
limited to damages, loss or injury to persons or property, resulting from the acts of other Sale Participants, Clinicians, Management
and/or Expo Visitors, theft, vandalism, fire and other casualty events or damage arising from any defects in the premises.
CONTRACT The Agreement shall constitute a valid and binding contract upon signature and receipt of deposit or full payment by
Wa State Horse Expo. Showcase Sale Participant agrees to waive, release and hold Management harmless from any and all claims
for loss, damage, costs or expenses if the show is cancelled or postponed due to circumstances beyond the control of Management.
SHOWCASE SALE ENTRY The Showcase Sale is designed to bring buyers and sellers together. As a Seller you will have the
opportunity to show your horse to prospective buyers once a day during a scheduled “Showcase.” At this time, your script will be
read and you will have 3:30 minutes to display to the audience what your horse can do. Outside of the designated “Showcase” time
slot, buyers will be encouraged to come take a look at the “Sale Row” where sale horses will be on display. Sellers will be encour-
aged to be readily available to answer questions prospective buyers may have. Showcase Sale manager will be available to sched-
ule ride times/ find open arenas should a prospective buyer want to try your horse. There will be a separate arena available at all
times for warm-up, lunging and showing horses. Entires are due by December 5th 2010. Once and applicant has been accepted by
the management, no refunds will be made.
SCRIPTS Demonstrations are to be 3:30 minutes in lengths. Once application has been accepted into the sale, a script must be
provided to Kellmerph@gmail.com by January 5th, 2011. Sellers are encouraged to talk about the horses attributes, strengths,
qualities, training, pedigree and show record.
PAYMENT POLICY Payment is due with application. Make check out to: Fairgrounds Site Management Group/WHE
EXHIBITOR BOOTH SPACE AND ADVERTISING Non-Profit Breed Associations wishing to purchase an exhibitor booth space will
receive a $25.00 discount on a 10x10 booth. Booth exhibitors are eligible for a 20% discount on advertising in the show guide.
CANCELLATION No other refunds or credits shall be provided after November 15, 2010.
ARRIVAL & DEPARTURE Horse(s) must be unloaded at the Jack Giesy Arena parking area and transporting truck and trailer im-
mediately moved to the upper parking area. A shuttle service will be provided to move tack to stable barn. No trucks, trailers or cars
will be allowed to remain parked in the Jack Giesy Arena or Stall barn areas except while unloading or loading horses. Breed Exhibi-
tors will locate the Jack Giesy Arena coordinators and check in upon arrival.
STALLS Breed Exhibitors may request specific stall number(s)/location(s) based on those available. Stall assignments are on a first
come first serve basis. Assignments are at the discretion of Management. Showcase Sale stalls must be well staffed by Showcase
Sale Participants during Expo hours and Showcase Sale passes must be visible at all times. No Stall signs/curtains to be taken
down prior to 6:00pm Violation of this rule will result in refusal of space the following year. Prior to loading horses Showcase Sale
Participants will locate the Jack Giesy Arena Coordinator to check out. All Stalls must be completely decorated and ready to present
by 1 PM Friday, February 8th, 2011. An award for the “Most Creative and Inviting” stall decoration will be handed out on Sunday
Morning. Emergency phone numbers must be posted on stall doors at all times. Stall Participants must keep stall area clean and
inviting for all event spectators.
HORSE CARE Breed Exhibitor is responsible for the daily feeding and care of their horse while it is stalled at the Clark County
Event Center at the Fairground.
OPEN ARENA TIMES The Jack Giesy Arena and wash rack area will be open at scheduled times each day. Please check and fol-
low the schedule as posted.
NON-GUARANTEE Management makes no guaranty or warranty, express or implied, as to the profitability or potential loss to or of
Breed Exhibitor with regard to Breed Exhibitor’s participation in the Expo.
RIGHT TO REFUSE Management reserves the right to review and reject any application for Expo participation in Management’s
sole discretion.
REPRESENTATION No representations are or have been made unless in writing, in this Agreement.
FAILURE TO PERFORM Should the Participant fail to observe any of the terms or conditions of this Agreement or any of the rules
and regulations as set forth by Management, Participant may be prevented from further participation in the Wa State Horse Expo,
with forfeiture of its participation. Management reserves to right to exercise all other remedies available at law or in equity. Man-
agement shall not be responsible to Participant for any financial loss or other damage arising out of Participant’s use of the facility,
operation of facility policies or force major events including power interruptions, utility failures, terrorism, bomb threat or undue “acts
of God” (i.e. flood, fire, earthquake).
AMENDMENTS This Agreement may only be amended by written agreement of the parties bearing a date subsequent to the date of
this Agreement.
GOVERNING LAW AND ENFORCEABILITY This Agreement shall be governed and construed in accordance with the laws of the
State of Washington. If any term or provision of this Agreement is determined to be void or unenforceable, the remainder of this
Agreement shall remain enforceable and in effect, as if that void or unenforceable provision was not included.
