Bucknon (65981) reported a memo at 1409 Cowart St Police ware diepetchad to 1400 Cowert Stfor e noise comypiaint. Police pulled up to Coyote Jacke night club where the music wos coming from and sew thet all af the lights were stil on, Police attempted to use the front door to go insids but it was locked. Polica than walked to a sida entry door whera thrae perties were cested inside the night club sitting at table in the downstairs pert of tha club, Police knocked an the door end which did not galn the parties attention dus to tha loud level of tha music. Mr. Marcee stoted that they were there because it was tha owner, Ms, Tammy Anthony, birthday end they wore just hanging out, Police osked where the cther two parlies hed gone and Mr. Marcee hesitertly answered he wasnt sure, Mr. Morcse slated that he thought there were seven more parties upstairs ot that time. Police asked Mr. Marcee to go hove all of the present parties step downstairs. Mr. Mercee came back downsisirs with (Mr. Timothy Weaver and a Mr. Oarek Green, Mr, Green stoted that he wes the GM and ‘wea upstairs in the restroom, Police asked Mr, Green why he would have the music playing so toudly at this time of night and he stated he didnt realize it was loud. At thet time, Mr, Timothy Weaver interrupted and statad that thay are testing new equipment, Police then asked Mr. Weaver what time they usually open which fe replied 4:00pm. Police asked Mc. Weaver and Mr. Green if they thought it would be @ better iden to test equipment at thet time instead of twa hours alter close of business and both replied yes. Police then heard movement corning from the upstairs floor of the nightclub. Coyote Jacks was involved in a shooting incident wooks before where witnesses stated the owner hae been involved in the selling of llegol drugs. Police esked Ms. Tammy Anthony why there wes 4 strong odar of marijuana but she acted oblivious to the question. Whilo police were on scene, police observed thet Mr. Marcse as heavily iotriccted end! tho chor ompleyees of Coyote Jacke seemed es if they ware unde the influence a8 well. While speaking with all of the porte, it was recognized that there were multiple different storis thet were inconsistent and the employees were clearly being deceitful, Police left the scene without incident. Chattanooga Beer/ Wrecker Serbice Board Meeting Minutes February 1, 2018 The Beer/Wrecker Board of the City of Chattanooga met Thursday, February 1, 2018 in regular open meeting. The Beer Board was created pursuant to Ordinance No, 7666, and the Wrecker Board was created pursuant to Ordinance No. 8415. In attendance were Board members Andre Harriman, Ron Smith, Trevor Atchley, Dan Mayfield and Ed Townson. Christopher Keene and James Hobbs were absent. Also present were City Attorney Keith Reisman, Court Reporter Lori Roberson, Officer John Collins, Bertha Lawrence and Ruthie Tudos from the Regulatory Bureau’s Office, Captain Chuck Hartung from the Fire Department, Travis Patton from TABC, Dan Tolliver from IT, Jamie Baker from Cherokee Distributing, Tom Wadsworth from Budweiser and Gail Perry from Chattanoogn.com. The meeting was called to order by Chairperson Ron Smith at 9:02 a.m. The Sunshine Law was applied. Appeared before the board on 2/16/17 REF: VIOL of SEC: 5-48 and Offenses involving minors; loitering; and gambling (fake id’s) and Overcrowding was violated on 2/5/17 per CPD #17-11479 which resulted in a 7 DAY SUSPENSION (Bella Vita) 2. Appeared before the board on 9/7/17 REF: VIOL of SEC: 5-50 Sales to Incapacitated person per CPD #17-75891 violated on 8/5/17 which resulted in a 3 DAY SUSPENSION. Officer John Collins informed the board that there are a couple of members of the community that wished to address the board regarding this business. Officer Collins added that District Attorney Neal Pinkston, who is interested in a couple of today’s cases, was present. Officer Collins testified that he received an email from Officer Edward Buckman regarding an incident that occurred at Coyote Jacks a couple of weeks ago. Officer Collins stated that reading through the narrative he saw several violations and forwarded it to Attorney Reism: Officer Edward Buckman, CPD # 776, testified: On the morning in question he received a phone call at 5:38 a.m. of a noise complaint. Upon arrival approximately one hundred (100) or so feet away from the business he could hear the music thumping even with the car windows rolled up. He along with other officers went to the front door... it was locked but they could see three (3) parties on the inside sitting at a table, They went to a side door to get a better view of the parties while holding flashlights to the door. ‘The parties looked over at them twice and continued their conversation and then two (2) of the parties quickly walked away. After a while, a third party that remained allowed them on the inside. ‘That party ‘was intoxicated and stated that they were having a birthday party for the owner. When the two (2) that scurried off early finally came downstairs they were questioned about the loud music and they stated that they were testing the new sound system...two (2) conflicting stories. Noises were coming from the Upstairs area and the parties were asked if there was anyone else in the building and they answered “Not that we know of.” They were admonished to go upstairs and get whomever was up there to come downstairs. A few other folk came down but there were more noises coming from the upstairs. Other officers arrived on the scene and the upstairs area was searched. One (1) of the back office doors was locked and there was no response when the officers knocked. Officer Buckman stated that when he knocked, after a while, the door was opened and there were six to seven (6-7) people, including the owner Tammy Taylor, inside. There was a strong odor of marijuana in the office and several conflicting stories as to what was going on, Everyone were instructed to exit the office and to go downstairs. Officer Buckman was questioned by the board and advised that there was no marijuana or drugs found on the premises. Officer Buckman was questioned by Attorney Keith Reisman, Officer Collins informed the board that there is no copy of the report in today’s paper work but Coyote Jack’s attorney had received a copy of the report. Officer Collins stated that there is video from the officer’s body cam that needs to be presented today. Boer/Wrecker Service foarc Meeling Agenda February 1, 2018 Page 3of 13 Attorney Russell King, representing Coyote Jacks, questioned Officer Buckman and informed the board that he has video also, Attorney King stated that Attorney Resiman has shared CPD’s video with him. Attomey King informed Officer, Buckman that the person from Knoxville, TN the he is listed on the report is an individual that the business knows nothing about and is not an employee of Coyote Jacks. Officer Buckman stated that everyone that was on the scene that night was listed in his report. Video of officer’s body camera was played. [Exhibit #1] Attorney Keith Reisman questioned Officer Buckman as to how many people were it night and who exactly made the noise complaint phone call the building that Attomey King presents witnesses: Roland Dover, Head of Security, stated that he has worked with the business for five (5) years. Mr. Dover stated that he does not drink but was accused by the officer of being under the influence that night. Mr. Dover also stated that he did not see anyone drinking that night. Mr. Dover explained why he was unable to see police at the door when they arrived. Mr. Dover was questioned by the board and Attorney Reisman. When asked why he went upstairs Mr. Dover stated that he went looking for his General ‘Manager who was in the bathroom and then he, himself, had to use the bathroom. He also stated that he told Ms. Taylor to stay in her office and close the door because he didn’t know who the people were outside and that he didn’t know what was about to happen. Mr. Dover also stated that there was another ‘gentleman in the office with Mrs. Taylor. Joshua Marsce, Manager, stated that he has worked with the business for one year and a half (11/2) and ‘was at the business that night planning for a party. Mr. Marsce stated that he did not have anything to drink that night but was accused by the officer of being under the influence. Mr. Marsce added that he didn’t see anyone else drinking that night. Mr. Marsce stated that he let the police inside when he discovered that they were police after about forty-five (45) seconds. Mr. Marsce added that they are at the business after hours usually counting money and cleaning up. Mr. Marsce was questioned by the board and stated that the music was loud because they had two (2) new speakers and they were testing the equipment, Mr. Marsce was questioned by Attorney Reisman and stated that he told police that thet wore seven (7) people in the building. (Potice reports states ten (10) people in the building.) (Video shows rine (9) people.) Timothy Weaver, Marketing Director/Executive Assistant for the Owners/D. J., stated that he was there that night testing the new equipment for the next day’s event, Mr. Weaver admitted that he was the one responsible for having the music’s volume high but said that it was not over one hundred and twenty (120) decimals and that one could not hear the music past the sidewalk but there would be a bit of vibration of the windows. Mr. Weaver added that once the doors are locked he is not allowed to open them... that is the job for the G.M. Mr. Weaver added that he had not had anything to drink that night nor did he see anyone else drinking that night. Attorney King informed the board that all employees that were there that night were present in today’s meeting and to hear other testimonies would be a the same as they have already heard that nobody was drinking that night and that the doors were locked. Attorney Reisman stated that he is sure that the board would like to hear from someone who was locked in that room. Beer/Wrecker Service Board Meeting Agenda February 1, 2018 Page ‘of 13, ‘*AAKAS Minute Recess***** Tammy Renee Anthony Taylor, Part Owner, testified that she does not allow employees to drink on duty. Mrs. Taylor stated that she and other employees were upstairs of the business that night planning a New Year's Eve party. Mrs. Taylor also stated that they had a compressor and a cooler that went down that night and had to move food from one place to another. Mrs. Taylor also stated that the promoter had come in from Atlanta late in the evening and brought two (2) speakers in for testing. Mrs. Taylor stated that she could not see a police car outside on her camera and she and her staff have been on high guard because of the previous incident in the Republic Parking lot. Mrs. Taylor stated that when Roland told her that there were people at the door and to close her office door she went and got the others and shut the door and remained there until police knocked on the door. Mrs. Taylor stated that there was no marijuana and no alcohol in the office. Mrs. ‘Taylor was questioned by Attorney Reisman. Attomey Reisman showed Mrs. Taylor and Attorney King the video that was shared with him by her council that shows that two (2) police cars were visible outside the lighted area of the front of her building. Attorney Reisman shared a still shot of the officer’s car outside the building with the board. Mrs. Taylor was questioned by the board and was asked why didn’t they call 911 if they were so frightened about who was at their door. Taylor stated that as she watched the video of her foyer she could tell that the persons appeared to be but she wasn’t sure. Mrs. Taylor added that the only problem that she had with the police report ‘was that she was named as being a drug dealer. Attorney King concluded that the video clearly shows that the business was locked and secured; that police had access within a few minutes, and that music was played at an unusual time....no alcohol...n0 misbehavior...no violation of the ordinance. Attorney Reisman reminded the board that they have three (3) violations before them: #1 Hours Regulated (no sale of beverages also they cannot be open for business at that time) #2 Denies Access #3. Consumes on the Pres Attorney Reisman reminded the board that there are five (5) members present today and for the vote to carry it requires a quorum vote of five (5). Trevor Atchley made a motion to DISMISS the violation of Hours Regulated for Coyote Jacks due to the fact that he didn’t see any evidence of alcohol being consumed. Andre Harriman seconded the motion. Motion carried unanimously. Andre Harriman made a motion to DISMISS the violation of Denies Access for Coyote Jacks, Ed Townson seconded the motion. Motion failed with a 2-3 vote, Dan Mayfield, Trevor Atchley and Ron Smith opposed. Attorney Reisman stated that there will be no action on this violation and it will be held over to the next meeting when there will be more members present; however, we will not be able to hear it on February 15%; so it will need to be PASSED to the meeting scheduled for March 1, 2018. Officer Collins explained: that he received an email from Officer Sarah Rogers regarding a delayed assault that occurred at the business the night before where a female was jumped on by several girls, Officer Collins stated that he checked with dispatch and there were no calls from the business regarding a fight. Officer Collins stated that he received a cell phone video of the fight from the victim. Board Member Trevor Atchley stated that section (b) of the code Section 5-55 was left off the agenda: Beer/Wrecker Service Boord Meeting Agenda: February 1, 2018 Page 7 of 13, (b) All permittees shall report all fights and other public disorders occurring on such premises rmediately to the Chattanooga Police Department, whether or not participants in any such disorder have left the premises. Attorney Reisman questioned Attorney Doug Cox who represents Skyzoo if there was a dispute of a disturbance that night. Attorney Cox stated that there was no dispute. Attorney Reisman stated that the only dispute is that the disturbance was not called in. Tiara Davenport, vietim, testified that she was assaulted by multiple girls inside the business and the fight spilled over into the parking lot where mace was used by Skyzoo’s security guards. Ms. Davenport ‘was questioned by Attorney Reisman, Video of the fight was played. [Exhibit #2] (There was no audio.) Officer Sarah Rogers, CPD #765, testified that she responded to Skyzoo where she met with Ms. Davenport and a couple of her friends who stated that Mrs. Davenport was rushed by ten to twelve (10- 12) females. Officer Rogers stated that the owner of the business also came out to speak with her and her Sargent. Officer Rogers questioned the owner who confirmed that the incident had occur inside. Officer Rogers asked the owner if he had called police and he replied that he did but told them to never mind...don’t come. Officer Rogers stated that there was no call sent into dispatch. Officer Rogers was questioned by the board and Attorney Cox and advise that she was told there was no video on the inside from the cameras. ‘Attomey Reisman asked for the video on Facebook which was produced from a cell phoned with sound [exhibit #3] Attorney Doug Cox, representing Skyzo0, questioned owner Leonardo Dacoregio. Leonardo Dacoregio, part-owner of Skyzoo, testified that they had a fight around 1:40 a.m. that involved girls pushing and falling. Mr. Dacoregio stated that his security guards jumped in and broke up the fight. Mr. Dacoregio stated that he called police. Dispatch asked him if he needed backup and he told them no. Mr. Dacoregio stated that on the outside he asked the victim what happened and she told him to call police and he told her that he had called the police carlier and that he was not calling police again, Attorney Cox presented a screen shot of Mr. Dacoregio’s cell phone where he called police on the non- emergency line. {Exhibit #4] Mr. Dacoregio was questioned by the board and he stated that he always calls the non-emergency line when there is a problem, Attorney Reisman stated that he heard the phone call and there was not a mention of a fight but about someone getting drunk on the inside. Attorney Reisman reminded the board of SEC. 5-55 (a) (b) Telephone and reports of disorders {a) All permittees under this article are required to maintain a telephone in good working order that provides direct access to the City’s emergency communication telephone line, or 9-1-1, and provides the street address for the permit holder’s location. A cellular or wireless telephone or other communication media shall not be used as the primary telephone service at a location permitted (o sell alcoholic beverages under this Chapter unless such media provides direct access to 9-1-1. The permit holder shall be responsible for notifying the Chattanooga Police Department or any changes in the permit holder’s, telephone number. Andre Harriman made a motion for a 3 DAY SUSPENSION for Skyzoo. Motion failed for a lack of a second. Dan Mayfield then made a motion to DISMISS the violation for Skyzoo based on the evidence. Ed Townson seconded the motion, Motion failed with a 2-3 vote. Andre Harriman, Ron Smith, and Trevor Atchley opposed. The violation has been pushed to the meeting scheduled for March 1, 2018. The three (3) stated that they have read and understand the beer codes. Mr. Billue was questioned by Attorney Reisman. Mr. Billue stated that the occupancy is one thousand and five hundred (1500) and that they will use Access Security who will wand and ID at the door. No wristbands will be used. “A stamp on the hand will be used for those of age and the under aged will receive a large X that cannot be washed off for days. There will be two (2) bars and no smoking. Attorney Reisman informed the victim that the board could not accept more facts since the board has heard the case and Skyzoo was no longer present. The victim stated that she cannot come to another meeting because she is in school and she works. © Share Robinson James, sister of the fatality at Coyote Jacks informed the board that she has received “not so nice” inboxes from Facebook trom the owner of Coyote Jacks in reference to her brother’s death, Mrs. James was questioned by Attorney Reisman. Chuck Hartung with the Fire Department explained to the board that the 911 calls that comes into the 911 center on a land line shows up on a computer screen and it shows the addi of the emergency. If the call is from a cell phone it will show the cell phone tower in the distance of where that cell phone call is coming from. Calls coming from the 698-2525 number has neither capability. When a call is placed to 911 the call taker will ask the location of the emergency to verify what is shown on the screen. Mr. Hartung was questioned by the board.
