ORDER

UPON motion by the Applicant for an interim injunction ordering, among other things,

that the Returning Officer for the Federal Electoral District of Regina-Qu’Appelle accept the

“All CANDIDATES” nomination forms filed by Patrick Strzalkowski and nine (9) other

individuals;

AND UPON motion by the Respondent, Attorney General of Canada, that he be removed

as a Respondent; and

UPON consent of the Applicant and the Respondent Elections Canada to the motion

made by the Attorney General of Canada;

AND UPON HEARING counsel for the Applicant and Respondent Elections Canada on

the issues raised by the Applicant;

AND UPON considering the tripartite test set out in RJR-MacDonald Inc v Canada

(Attorney General), [1994] 1 SCR 311, by which the Applicant must establish there is a serious

issue to be determined, irreparable harm would result if the injunction were not granted and the

balance of convenience favours the granting of the injunction;

AND UPON being satisfied there is no serious issue to be determined:

THIS COURT ORDERS that:

1. The style of cause is amended to remove the Attorney General of Canada as a

Respondent, and henceforth shall read as follows:
