Copyright is a legal right, existing in many countries, that grants the creator of an original
work exclusive rights to determine whether, and under what conditions, this original work may be
used by others. This is usually only for a limited time. The exclusive rights are not absolute but
limited by limitations and exceptions to copyright law, including fair use. A major limitation on
copyright on ideas is that copyright protects only the original expression of ideas, and not the
underlying ideas themselves.
Example of copyright
1. Literary, musical, graphic.
2. Sculptural works.
3. Motion pictures and other audio-visual works.
4. Derivatives of protected works, such as a sequel (i.e. the Star Wars movies).
5. Original compilations of facts, such as a field guide.

A patent is a form of intellectual property. A patent gives its owner the right to exclude others from
making, using, selling, and importing an invention for a limited period of time, usually twenty
years. The patent rights are granted in exchange for an enabling public disclosure of the invention.
People who are employed to do research are often obligated by their employment
contracts to assign inventions to their employer. In most countries patent rights fall under civil
law and the patent holder needs to sue someone infringing the patent in order to enforce their
rights. In some industries patents are an essential form of competitive advantage; in others they
are irrelevant.

A trademark, trade mark, or trade-mark is a recognizable sign, design, or expression which
identifies products or services of a particular source from those of others, although trademarks
used to identify services are usually called service marks. The trademark owner can be an
individual, business organization, or any legal entity. A trademark may be located on a package,
a label, a voucher, or on the product itself. For the sake of corporate identity, trademarks are often
displayed on company buildings.
Example of trademarks
1. Name - Coco Chanel is a perfect example of a name that is a trademark.
2. Symbol - The McDonalds golden arch is a classic example of a symbol trademark. Golden
arches align interstate highways to alert customers when there is a McDonalds located at next
exit. There is no mention of the name McDonalds on these golden arches.
3. Catchphrases - a catchphrase that is identifiable to a person or company that is used to sell
merchandise can be trademarked.
4. Figure or Mascot - a classic example of a trademark character is Geico’s talking gecko. Geico’s
talking gecko was featured in many commercials advertising Geico’s insurance.
5. Lyrics - A songwriter’s lyrics are trademarks. Bob Seger and the Silver Bullet Band made a hit
single song “Like a Rock” in 1986. In 1991, this song helped Chevrolet bounce back from a near
bankruptcy situation.
