2. Existing service provider of JMC PROJECT (INDIA) LTD need to submit a

declaration in their Company Letter Head mentioning the equivalent EMD
amount to be considered from their outstanding bills.
3. The successful service provider shall have to submit a SD of Rs. 1,00,000
(One lakh Only) in the name of “JMC PROJECT (INDIA) LTD “
4. JMC needs SD of 1,00,000 immediately after approval OR ELSE EMD will
be forfeited, Contract will be null and void & we will award contract to
alternate source.
5. There will be no interest on EMD/SD.
6. EMD shall be forfeited if H1 party fails to place the vehicles.

TRANSPORTATION CONTRACT TERMS AND CONDITIONS

1. Payment
Payment of the bills shall be released within 60 days from receipt of bills duly supported by clear receipt from the
consignee, in absence of which payment shall be withheld till confirmation of receipt of material by the consignee.

2. Supply of Vehicle for outgoing material

Vehicle shall be supplied within Twenty-four (24) hours from our intimation on E-mail. Vehicle shall report at
loading location before 12.00 pm. Failure in reporting of Vehicle before stipulated time may result in loading on
next working day. If Vehicle are not arranged within 2 days from our intimation, we shall arrange from other
transporter and any additional cost shall be recovered from your outstanding. No Vehicle shall be loaded /
unloaded on Sundays & Holidays unless prior intimation is given by the transporter and loading / unloading
arrangements are confirmed by us.

3. Shortage / Damage
It shall be sole responsibility of transporter to deliver the material to consignee within the reasonable time in full
and in intact condition. Any loss suffered due to shortage, damage or transit delay shall be to the transporter’s
account. Material shall be reconciled based on number of pieces and not tonnage.

4. Detention of Vehicle
Any detention caused to Incoming / Outgoing Vehicle in our factory under any circumstances & force-majeure shall
not be entertained. Under no circumstances any consignment, in part or full, shall be detained or unloaded by
transporter in his godown for any reason or dispute. In case any transporter does so, Company shall take legal
action against such erring transporter and recover material cost and other loss suffered by the Company. Company
reserves the right of imposing penalty for Detention / Unloading of consignment enroute and same shall be
recovered from transporter’s pending bills, security deposit or by any other legal means

5. Subcontract
Subcontracting to any other transporter by you is prohibited under this contract.

6. Awarding Contract to other transporter

Company reserves its right to transfer a part or balance quantity of the contract to any other transporter without
assigning any reason or compensation in case transporter is unable to lift the material or fulfill contractual
obligations of the contract.

7. Weight
Weight as per supplier’s invoice shall be considered final for billing

8. Taxes and Duties

Transporter shall comply with all applicable provisions provided in CGST / SGST / IGST as applicable.

9. Termination
In case Company feels that the services of transport are not satisfactory, Company reserves its right to cancel the
contract and forfeit the security deposit and also recover losses from the transporter for nonfulfillment of
contractual obligations.

10. Liability
Company shall not be liable in case of any accident or damage to the vehicle directly or indirectly occurred or
caused, sustained or incurred in the event of death of person(s) employed by the contractor during execution of the
contract.

11. Penalty
11.1 – Placement of Vehicle
Timely delivery of material is essence of this contract. Post receipt of intimation from our procurement department
you shall arrange Vehicle to lift material within 24 hours. In case of failure to lift material within required time
penalty at the rate of Rs. 100/- per day per tonne shall be levied and recovered from you. Repeated failure would
be treated as breach of contract and losses incurred will be recovered from your outstanding or security deposit;
further company reserves right to terminate contract.
11.2 – Transit Time
Standard Transit time (including grace period) within Chhattisgarh state is 2 days and from outside state is 5 days
from the date of LR till physical delivery at our plant. In case of failure in delivery of material within standard transit
time, a penalty of Rs. 100/- per day per tonne shall be levied and recovered from you.

12. Return Journey Cost

Transportation charges indicated therein do not include cost of transportation for the return journey of the empty
Vehicle/ vehicle, the deduction of the said transportation charges will not be admissible.

13. Transit Insurance

JMC shall arrange for transit insurance

14. Transshipment
Transshipment of material not permitted except in case of breakdown of truck with prior permission from the
company.

15. Price Variation clause

Rates mentioned above shall remain firm for first six months from the date of this contract. Thereafter, Price Variation
clause would be applicable in case of any Increase / decrease in diesel price beyond 5% from the diesel price level as
on date of Contract. Increase / decrease in % diesel price beyond 5% shall be applicable on 35% of agreed Contract
price.
16. Jurisdiction
All disputes are Subject to Mumbai Jurisdiction only.
