‘’J.Facts:Pelayo filed a complaint against Lauron and Abella when they refused to payhim for services he
rendered in the birth of their daughter-in-law’s child. Theyclaimed in their answer the she died after the
childbirth and that she lived with herhusband independently of them and that they are not bound to pay for
theirdaughter-in-law’s expenses. The trial court ruled in favor of Lauron and Abella.’’

Ruling:No.The person bound to pay the fees due to the plaintiff for the professionalservices that he rendered to
the daughter-in-law of the defendants during herchildbirth, is the husband of the patient and not her father and
mother- in-law, thedefendants herein. The fact that it was not the husband who called the plaintiff
andrequested his assistance for his wife is no bar to the fulfillment of the saidobligation, as the defendants, in
view of the imminent danger, to which the life ofthe patient was at that moment exposed, considered that
medical assistance wasurgently needed, and the obligation of the husband to furnish his wife in
theindispensable services of a physician at such critical moments is speciallyestablished by the law, as has
