EXTRAJUDICIAL SETTLEMENT OF ESTATE

OF THE LATE ROSARIO P. PEREÑA,


WITH WAIVER OF RIGHTS IN
FAVOR OF RACHEL PEREÑA IBARRA

KNOW ALL MEN BY THESE PRESENTS:

THIS AGREEMENT, executed this ___th of ______________,


2019, in Cavite City, by and between:

MERCEDES P. DESTURA, Filipino, married, of legal


age, with residence and postal address at Barangay Asis I,
Mendez-Nunez, Cavite City;

AMPARO P. FERMA, Filipino, widow, of legal age, with


residence and postal address at No. 143 Llamado St., Asis
III, Mendez-Nunez, Cavite City;

LEVITA P. REFORMADO, Filipino, married, of legal


age, with residence and postal address at No. 106
Evangelista St., Talaba I, Cavite City;

FLORANTE P. PEREÑA (deceased), represented by his


daughter RACHEL PEREÑA IBARRA, Filipino,
married, of legal age, with residence and postal address at
No. 111 Gen. P. Garcia St., Caloocan City;

REMIGIO PEREÑA (deceased), represented by his


daughter, BERNADETTE P. CASTILLO Filipino,
married, of legal age, with residence and postal address at
203, Sanja Mayor, Tanza, Cavite; and

ISRAEL PEREÑA (deceased), represented by his son


WILLIAM M. PEREÑA, Filipino, married, of legal age,
with residence and postal address at No. 82 E. Maliksi St.,
Bacoor, Cavite City;

under oath, hereby freely and voluntarily - -

DECLARE AND MAKE MANIFEST:


That, we are the only and exclusive heirs of ROSARIO P.
PEREÑA who died last March 1, 1999, in Mendez, Cavite City,
without leaving any Last Will and Testament, and without any
indebtedness known to us whatsoever;

That said deceased left a parcel of land located in Gen. Trias St.,
Mendez, Cavite City, particularly covered by TAX DECLARATION
NO. 14-0012-00179, and technically described as follows, to wit:

Cadastral Lot : 6122, Cad 469-D

BOUNDARIES:
NORTH : 30 (Lot6120) SOUTH : 11 (Lot6123)
EAST : Creek WEST: 40 to 42 (Lot6121)

That pursuant to Section 4 Rule 74 of the Revised Rules of Court


of the Philippines, and the parties herein being all of age, WE have
agreed to WAIVE, TRANSFER and CONVEY, unto and in favor of the
other heir RACHEL P. IBARRA the above-described real property,
together with all the improvements erected thereon, if any, free from
any liens and encumbrances.

That they hereby affirm that they have executed the foregoing
instrument out of their own voluntary free will without force,
intimidation or violence upon their person, that they received their just
and proper share and have no more claims or demands, whether past,
present, or contingent, against each other.

instrument and every page thereof, were voluntarily affixed by them
and acknowledged to me that the same is their free and voluntary act
and deed.
This instrument consisting of Four (4) pages including this page
whereon the acknowledgment is written refers to an Extrajudicial
Settlement of Estate of the Late ROSARIO P. PEREÑA with Waiver
of Rights in favor of RACHEL PEREÑA IBARRA, and has been
signed by the parties and their witnesses and sealed with my notarial
seal.
