FORMAL ACTION:
The Board of Supervisors at their August 5, 2019 meeting by unanimous vote adopted Resolution No.
2019- 086 supporting the City of Needles, California, in declaring their city a " Second Amendment
Sanctuary City."
The establishment of a Sanctuary County is a movement that we are seeing local jurisdictions
implement country- wide, the majority of which are intent on protecting the rights granted by the United
States Constitution, specifically the Second Amendment. Discussions with Doug Schuster, Mohave
County Sheriff have also indicated that law enforcement is in support of this movement. A draft
resolution has been prepared for discussion purposes.
RECOMMENDED MOTION:
DISCUSSION AND POSSIBLE ACTION RE: Determination of the Board' s position on becoming a
Second Amendment Sanctuary County, discussion of the draft resolution, if necessary, and provide
direction to staff.

RESOLUTION NO. 2019- 118
WHEREAS, the Board of Supervisors met in Regular Session this 4th day of
November, 2019; and
WHEREAS, Arizona Revised Statute § 11- 251( 17) and ( 21) provide authorization
for the Board of Supervisors to " adopt provisions necessary to preserve the health of
the county" and " make and enforce necessary rules and regulations for the government
of its body, the preservation of order and the transaction of business;" and
with service in a militia, for traditionally lawful purposes, such as self-defense within the
home; and
WHEREAS, the Supreme Court, in United States v. Miller, 307 U. S. 174 ( 1939),
opined that firearms that are part of ordinary military equipment, or whose use could
contribute to the common defense, are protected by the Second Amendment; and
WHEREAS, the members of this Board took an oath to support the United States
Constitution, the Constitution of Arizona and the laws of the State of Arizona and today
reaffirm our commitment, the Mohave County Board of Supervisors does support the
United States Constitution, the Constitution of Arizona and the laws of the State of
Arizona ; and

BE IT FURTHER RESOLVED that the Board affirms its support of the Second
Amendment to the U. S. Constitution, and declares Mohave County a Second
Amendment Sanctuary County.
