CONTRACT TO SELL

KNOW ALL MEN BY THESE PRESENTS:

This Contract to Sell (Agreement) is made and entered into by and between:

EMILY N. LIBO-ON, of legal age, Filipino, widowed, and a


resident of Brgy. Kirayan Tacas, Miagao, Iloilo, hereinafter
referred to as the “FIRST PARTY”

-and-

CECELIA N. NUÑEZA, of legal age, Filipino, married to Romeo


Nuñeza, and a resident of San Jose, Antique, hereinafter referred
to as “SECOND PARTY.”

WITNESSETH THAT:

WHEREAS, the FIRST PARTY is the absolute and registered owner of Unit 17,
BLISS Project, located at Brgy. Kirayan Tacas, Miagao, Iloilo. Said property consists of
Three Hundred Fifty (350) square meters.

WHEREAS, the SECOND PARTY offered to buy and the FIRST PARTY agreed
to sell the above mentioned party subject to the terms and conditions specified
hereinafter;

NOW THEREFORE, for and in consideration of the foregoing premises and for
an agreed purchase price of ONE HUNDRED EIGHTY THOUSAND PESOS
(P180,000.00) the FIRST PARTY agrees to sell the above-mentioned property to the
SECOND PARTY under the terms and conditions herein below set forth:

1. The total consideration of ONE HUNDRED EIGHTY THOUSAND PESOS


(P180,000.00), Philippine currency, shall be payable as follows:

a. The amount of THIRTY THOUSAND PESOS (P30,000.00) was already


paid and settled by the SECOND PARTY, to the satisfaction of the FIRST
PARTY.

b. The amount of SEVENTY FIVE THOUSAND PESOS (P75,000.00) on


October 3, 2019. Said payment to EMILY N. LIBO-ON.

c. The balance of SEVENTY FIVE THOUSAND PESOS (P75,000.00) shall


be paid on or before November 30, 2019. Said payment shall be paid to
EMILY N. LIBO-ON.

2. Possession to the subject property shall be delivered by the FIRST PARTY to the
SECOND PARTY after three (3) months upon full payment of the total
consideration.

3. Upon full payment of the purchase price, the FIRST PARTY shall duly execute a
Deed of Absolute Sale in favor of the SECOND PARTY to effect the transfer of
ownership.
4. In the event of failure on the part of the SECOND PARTY to pay the total
consideration on or before November 30, 2019, this Contract to Sell shall be
terminated. Thereafter, all installment payments made by the SECOND PARTY
shall be forfeited in favor of the FIRST PARTY. Upon the termination of this
Contract to Sell, the FIRST PARTY shall be free to sell and dispose the property
to any willing third party.

This Contract shall be binding upon the heirs, successors, executors,


administrators, and assigns of the respective parties hereto.

ACKNOWLEDGMENT

The principals appeared in person before me this ________________ in Miagao,


Iloilo, presented to me an integrally complete instrument or document, exhibited to me
their identification documents, and represented to me that the signatures thereon were
voluntarily affixed by them for purposes stated therein, and declared that they executed
the same as their free and voluntary act and deed, or if acting in a particular capacity,
that they have the authority to sign in that capacity.

The principals were identified by competent evidence of identity, showing to me


their current identification documents bearing their photographs and signatures:
