Civil Cases
Motion for Extension of Time to File Petition

1. Number of pleadings required

a. Original pleading and 14 copies For: En Banc cases under the


1987 Philippine Constitution
COMELEC and COA cases
Writ of Amparo
Writ of Kalikasan
HRET/SET cases Issues affecting National Interest
Constitutionality cases

b. Original pleading and 4 copies


For: Division cases – decisions of lower courts/tribunal

2. Attachments:

a. For personally filed pleadings - Proof of Service to the lower


court/tribunal and adverse party/parties.

For pleadings filed thru registered mail – Proof of Service to


the lower court/tribunal and adverse party/parties and
Affidavit of Service.

b. Annexes, if any, and must be labeled as “A”, “B”, “C”, etc.Soft


copy of the pleading and annexes in PDF (in CD, USB) and a
printed Verified Declaration that the PDF files contained in the
CD/USB are complete and true copies of the pleading and
annexes, if any, filed with the Supreme Court. There should
be one (1) CD/USB per case containing one (1) PDF file of the
original pleading filed with the Court and separate PDF files for
the annexes, if any, i.e. one (1) PDF file per annex and not
per page. The filename of the PDF files must be the same as
the title of the original pleading.

If the CD/USB and the Verified Declaration are not attached


with the original pleading at the time of filing with the Court,
the soft copy of the pleading and annexes, if any, may be sent
thru email at efile_jro@sc.judiciary.gov.ph within twenty- four
(24) hours from date of filing of the original pleading with the

Supreme Court.

The email should have a cover letter enumerating the


attachment/s sent. Thus:
 One (1) PDF file per pleading filed with the Supreme
Court.
 One (1) PDF file per annex, if any. If several
annexes, create one (1) PDF file per annex and label
each accordingly.
 One (1) PDF file for the Verified Declaration that the
PDF file/s attached to the email are complete and are
true copies of the original pleading and annexes filed
with the Supreme Court.
 The filename of the attached PDF file must be the
same as the title of the original pleading filed with
the Supreme Court.

Large files may be sent in several batches (10MB per email


and 2MB per attachment).

a. Verification and Certification on Non-Forum Shopping. If the
signatory is not the petitioner, proof of authority (ex. Secretary’s
Certificate, Special Power of Attorney) to sign for petitioner/s
must be attached.

b. For personally filed pleadings - Proof of Service to the lower


court/tribunal and adverse party/parties. For pleadings filed thru
registered mail – Proof of Service to the lower court/tribunal and
adverse party/parties and Affidavit of Service.

c. Certified true copy/copies of the assailed decision, resolution or


order of the lower court/tribunal.

d. Annexes, if any, and must be labeled as “A”, “B”, “C”, etc.

e. Soft copy of the pleading and annexes in PDF (in CD, USB) and a
printed Verified Declaration that the PDF files contained in the
CD/USB are complete and true copies of the pleading and
annexes, if any, filed with the Supreme Court. There should be
one (1) CD/USB per case containing one (1) PDF file of the

Appeal

1. Original records of the case forwarded by the Court of Appeals

2. Notice of Appeal filed by the accused-appellant/s with the
Court of Appeals or Sandiganbayan
3. Court Resolution giving due course to the notice of appeal

Steps for Filing

INITIATORY PLEADINGS / DOCUMENTS

1. Stamp mark on the upper left-hand portion of the 1st page of the
ORIGINAL pleading and 1st page of every
Annexes.

2. Present Pleadings for verification and/or assessment of fees.


3. Proceed to Cashier (SC Main Building) for payment of assessed fees.
4. Return to Window 1 and present Proof of payment (O.R.) issued by the
cashier and submit pleadings (original and required number of copies)
to be filed.

5. Await verification of content of CD / USB, pursuant to Efficient Use of
Paper Rule.
6. Await verification of completeness/accuracy of the requirements by the
Receiving Officer.
7. Assign and stamp a new case number.
8. Receive Filer’s Copy of the pleadings assigned with a new case number
and stamped date/time with the Judicial Records Office receiving
machine.

NOTE: Follow up on the status of a case shall be with the Office of the Clerk of
Court of the Division where the case is assigned.

SUBSEQUENT PLEADINGS / DOCUMENTS

1. Stamp mark on the upper left-hand portion of the 1st page of the
ORIGINAL pleading and 1st page of every

Annexes.
2. Present Pleadings for verification and/or assessment of fees, if with
prayer for issuance of TRO/WPI or Motion for Special Raffle or Second
and other subsequent Motion for Reconsideration.
3. Proceed to Cashier (Main Building) for payment of assessed fees.
(Application for TRO/ WPI, etc., if any)
4. Return to Window 2 and present Proof of payment (O.R.) issued by the
cashier and submit pleadings (original and required number of copies)
to be filed.
5. Await verification of content of CD / USB, pursuant to Efficient Use of
Paper Rule.
6. Await verification of completeness/accuracy of the requirements by the
Receiving Officer.
7. Receive Filer’s Copy of the pleadings stamped date/time with Judicial
Records Office receiving machine.

NOTE: Follow up on the status of a case shall be with the Office of the Clerk of
Court of the Division where the case is assigned.

Filing Fees

Legal Fees for Initiatory Cases

Pursuant to the En Banc Resolution dated January 10, 2018 in A.M. No. 17-12-
09-SC (Re: Initial Recommendations on Administrative Adjustments from the
Judiciary-Wide Committee on Legal Fees), docket and other legal fees for
initiatory cases, including a petition-for-intervention, shall be the following:

If the pleading is with a Motion for Special Raffle, there will be an additional
P500.00 filing fee.

If the petitioner/petitioners is/are represented by the Public Attorney’s Office or


the Office of the Solicitor General, the total amount for filing fee shall be
P1,000.00 as Sheriff’s Trust Fund (A.M. No. 17-12-09-SC).
