CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This Agreement, made and entered into by and between:

MERCEDES L. LUBAS, of legal age, married and a resident of


Brgy. Sta. Rosa, Mandurriao, Iloilo City, Philippines, hereinafter called the
LESSOR;

-and-

_______________________________, of legal age, single/married


with address at _______________________________________________,
Philippines, hereinafter called the LESSEE;

WITNESSETH:

WHEREAS, the LESSOR is the absolute owner of a residential


apartment building standing on Lot No. 4, Block 1 of the subdivision plan,
situated at Brgy. Sta. Rosa, Mandurriao, Iloilo City covered by Transfer
Certificate of Title No. T-152266 of the Register of Deeds of Iloilo City;

WHEREAS, the LESSEE has applied for a lease of a portion of the


said apartment building and the LESSOR is agreeable thereto;

NOW THEREFORE, for and in consideration of the foregoing


premises and the conditions, covenants and undertakings hereunder
contained, the LESSOR hereby lease and lets unto the LESSEE the above-
mentioned apartment building subject to the following terms and conditions:

1. SUBJECT OF LEASE:
1.1. The leased premises consists of the Residential apartment
building on the above-parcels of land known as Door No.
________;

1.2. The LESSEE shall pay the electric and water consumption.

2. PERIOD OF LEASE:

2.1. This lease shall be for a period of ________(_____)


months/year commencing on ________________________ and
will automatically terminate on _____________________.
This period shall not be deemed extended for any reason
whatsoever unless the parties shall agree in writing on such new
terms and conditions as may be agreed by them;

3. RENTALS:

3.1. Upon the signing of this contract the LESSEE shall pay
the LESSOR (1) one month advance rental and two (2)
months deposit. The rental is ______________________
Pesos (P______________) per month;

3.2. Each monthly rental shall be due and payable without


need of any demand at the office of the LESSOR on the
9th day of the month. In the event that any monthly
rental is not paid on time, the LESSEE shall pay the
penalty equivalent to 20 percent (20%) of the rental due
for each month and with the succeeding months with
interest compounded;

3.3. The failure of refusal of the LESSEE to pay any monthly


rental plus penalties, if any, when due shall entitle the
LESSOR to terminate this Contract of Lease and
thereupon take possession of premises leased and eject
the LESSEE from the premises therefore extra-judicially
and padlock the premises.

4. SPECIAL RESTRICTIONS:

4.1. The LESSEE is prohibited to do any or all the following


acts without the prior written consent of the LESSOR;
otherwise, the LESSOR are entitled to terminate this
contract of lease and thereupon take possession of the
premises leased;
4.1.1 Effect or cause any change or alteration to be
effected in the leased premises, save those that may be
directed by urgent repairs for the preservation of the
leased premises.
4.1.2 Enter into any partnership, joint ventures or similar
undertaking with respect to the use of the leased
premises with any third person;
4.1.3 Assign, transfer or waive his rights under this
contract to any person;
4.1.4 Preterminate this lease without the prior written
consent of the LESSOR.

5. DEPOSITS:
5.1 The amount deposited shall be forfeited in favor of
the LESSOR by reason of any or all of the following
instances:
5.1.1 Non-payment of monthly rentals and penalties
therein, if any;
5.1.2 Refusal to vacate upon expiration of the period; or
5.1.3 Violation of any condition of this Contract of
Lease.
5.2 The forfeiture of the deposit shall not be deemed a
waiver nor shall if preclude the LESSOR from availing
of other remedies available to the LESSOR in this
contract of lease.
5.3 The deposit herein made shall be retried to the
LESSEE without interest upon expiration of the period of
this lease if the LESSEE shall have faithfully complied
with all his obligations and undertakings as provided in
this contract.
6.TERMINATION OF LEASE:
6.1 Upon termination of the period of this agreement,
the LESSEE shall surrender and vacate peacefully
the leased premises without need of any demand to
the LESSOR and the LESSOR reserves the right to
close and lock the premises if the LESSEE fails to
vacate the same upon the expiration of the period;

6.2 In the event that the LESSEE continue to occupy


the premises of the LESSOR after the expiration of
the period of this lease without a new written contact
having been entered into between the parties, and/or
the LESSEE refuses or fails to vacate the premises in
case of any breach of any of the provisions of this
agreement by the LESSEE and the LESSOR exercise
their right to cancel this contract of lease, then the
LESSEE agrees to pay the LESSOR the amount of
P1,000.00 per day as liquidated damages for the
unlawful use and occupation of the premises from
the date of the expiration of the lease or written
demand of the LESSOR until the premises are
actually vacated by the LESSEE aside from the
regular monthly rentals and attorney’s fees and

expenses of litigation in case an action is filed in


court.
7. PROVISIONS FOR BREACH OF CONTRACT
10.1 The LESSOR, reserved the right to cancel or
terminate this agreement for the violation by the
LESSEE of any undertaking herein mentioned and/or
in case of the non-payment of rentals the LESSOR
may further eject the LESSEE from the leased
premises and immediately take possession of the
leased premises without prejudice to such proper
legal action which the LESSOR may institute.
10.2 In case the LESSOR are compelled to litigate to
enforce their rights under this agreement, the parties
agree that venue shall exclusively be vested with the
courts of proper jurisdiction in the City of Iloilo.
10.3 The LESSEE further agrees to pay the LESSOR
the amount of P10,000.00 as liquidated damages for
attorney’s fees and incidental costs of litigation aside
from the liquidated damages for the use and
occupation of the premises in case the LESSEE fail or
refuses to vacate the premises after the expiration of
the period of this contract and/or if this contract is
cancelled and/or if this contract is terminated due to
any breach of any of the provisions hereof by the
LESSEE.

CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

This Agreement, made and entered into by and between:

MERCEDES L. LUBAS, of legal age, married and a resident of


Brgy. Sta. Rosa, Mandurriao, Iloilo City, Philippines, hereinafter called the
LESSOR;

-and-

BEATRICE MARQUISE THERESE LIM, of legal age,


single/married with address at La Citta della Subd., Talamban, Cebu City,
Philippines, hereinafter called the LESSEE;

WITNESSETH:

WHEREAS, the LESSOR is the absolute owner of a residential


apartment building standing on Lot No. 4, Block 1 of the subdivision plan,
situated at Brgy. Sta. Rosa, Mandurriao, Iloilo City covered by Transfer
Certificate of Title No. T-152266 of the Register of Deeds of Iloilo City;

WHEREAS, the LESSEE has applied for a lease of a portion of the


said apartment building and the LESSOR is agreeable thereto;

NOW THEREFORE, for and in consideration of the foregoing


premises and the conditions, covenants and undertakings hereunder
contained, the LESSOR hereby lease and lets unto the LESSEE the above-
mentioned apartment building subject to the following terms and conditions:

3. SUBJECT OF LEASE:
1.2. The leased premises consists of the Residential apartment
building on the above-parcels of land known as Door No.
_____;

1.2. The LESSEE shall pay the electric and water consumption.

4. PERIOD OF LEASE:

2.1. This lease shall be for a period of one (1) year


commencing on October 30, 2015 and will automatically
terminate on October 30, 2016. This period shall not be
deemed extended for any reason whatsoever unless the parties

shall agree in writing on such new terms and conditions as may


be agreed by them;

6. RENTALS:

6.1. Upon the signing of this contract the LESSEE shall pay
the LESSOR (1) one month advance rental and two (2)
months deposit. The rental is Fifteen Thousand Pesos
(P15,000.00) per month;

6.2. Each monthly rental shall be due and payable without


need of any demand at the office of the LESSOR on the
9th day of the month. In the event that any monthly
rental is not paid on time, the LESSEE shall pay the
penalty equivalent to 20 percent (20%) of the rental due
for each month and with the succeeding months with
interest compounded;

6.3. The failure of refusal of the LESSEE to pay any monthly


rental plus penalties, if any, when due shall entitle the
LESSOR to terminate this Contract of Lease and
thereupon take possession of premises leased and eject
the LESSEE from the premises therefore extra-judicially
and padlock the premises.

7. SPECIAL RESTRICTIONS:

7.1. The LESSEE is prohibited to do any or all the following

otherwise, the LESSOR are entitled to terminate this
contract of lease and thereupon take possession of the
premises leased;
4.1.1 Effect or cause any change or alteration to be
effected in the leased premises, save those that may be

leased premises.
4.1.2 Enter into any partnership, joint ventures or similar
undertaking with respect to the use of the leased
premises with any third person;
4.1.3 Assign, transfer or waive his rights under this
contract to any person;
4.1.4 Preterminate this lease without the prior written
consent of the LESSOR.

8. DEPOSITS:
5.1 The amount deposited shall be forfeited in favor of
the LESSOR by reason of any or all of the following

5.3 The deposit herein made shall be retried to the
LESSEE without interest upon expiration of the period of
this lease if the LESSEE shall have faithfully complied
with all his obligations and undertakings as provided in
this contract.
6.TERMINATION OF LEASE:
6.1 Upon termination of the period of this agreement,
the LESSEE shall surrender and vacate peacefully
the leased premises without need of any demand to
the LESSOR and the LESSOR reserves the right to
close and lock the premises if the LESSEE fails to
vacate the same upon the expiration of the period;

6.2 In the event that the LESSEE continue to occupy


the premises of the LESSOR after the expiration of
the period of this lease without a new written contact
having been entered into between the parties, and/or
the LESSEE refuses or fails to vacate the premises in
case of any breach of any of the provisions of this
agreement by the LESSEE and the LESSOR exercise
their right to cancel this contract of lease, then the
LESSEE agrees to pay the LESSOR the amount of
P1,000.00 per day as liquidated damages for the
unlawful use and occupation of the premises from
the date of the expiration of the lease or written
demand of the LESSOR until the premises are
actually vacated by the LESSEE aside from the

regular monthly rentals and attorney’s fees and


expenses of litigation in case an action is filed in
court.
7. PROVISIONS FOR BREACH OF CONTRACT
10.1 The LESSOR, reserved the right to cancel or
terminate this agreement for the violation by the
LESSEE of any undertaking herein mentioned and/or
in case of the non-payment of rentals the LESSOR
may further eject the LESSEE from the leased
premises and immediately take possession of the
leased premises without prejudice to such proper
legal action which the LESSOR may institute.
10.2 In case the LESSOR are compelled to litigate to
enforce their rights under this agreement, the parties
agree that venue shall exclusively be vested with the
courts of proper jurisdiction in the City of Iloilo.
10.3 The LESSEE further agrees to pay the LESSOR
the amount of P10,000.00 as liquidated damages for
attorney’s fees and incidental costs of litigation aside
from the liquidated damages for the use and
occupation of the premises in case the LESSEE fail or
refuses to vacate the premises after the expiration of
the period of this contract and/or if this contract is
cancelled and/or if this contract is terminated due to
any breach of any of the provisions hereof by the
LESSEE.
