TINGUHA SISONA married to Ernesto Sisona, a resident of Mamyang, Zamboanga City,
NOYME TINGUHA VILLA married to Exoperto Villa, MAXITO M. TINGUHA, single, both
residents of Bacong, Negros Oriental, PONCIANA TINGUHA FERNANDO married to
Virgilio Fernando, a resident of Lamitan, Basilan, CARIDAD M. TINGUHA, widow, a
resident of Bacong, Negros Oriental, CLARISSA M. TINGUHA married to Edwin Irenea,
a resident of General Santos, Cotabato City, LEVY TINGUHA VILLA married to Alberto
Villa, FRANKLIN M. TINGUHA married to Maria Luisa De Dios, both residents of Bacong,
Negros Oriental, TESSIE TINGUHA IRENEA married to Ian Irenea, a resident of South
Cotabato, JANET TINGUHA DAGOY married to Cris Donel Dagoy, EDITHA TINGUHA
SIENES married to Walter Sienes, EVANGELINE TINGUHA, widow, HERMES
TINGUHA, JR. single/married to ____________, ESCOLASTICO TINGUHA married to
Pearly Abilla, ERMIE TINGUHA PATAL married to Merlin Patal, LORNA TINGUHA
NAMIAS married to Eleuterio Namias, Jr., and FIDEL TINGUHA married to Florida M.
Real, all residents of Bacong, Negros Oriental, all of legal ages, Filipinos, and hereinafter
referred to as the HEIRS;

WITNESSETH:

WHEREAS, the HEIRS OF ALEJANDRO TINGUHA are absolute co-owners of a

parcel of land Lot No. 2399-A, Psd-07-067899, being a portion of Lot No. 2399 covered
by Original Certificate of Title No. 17485, situated in Buntis, Bacong, Negros Oriental,
Philippines, by virtue of an Extrajudicial Settlement of Real Property and Partition
otherwise known as Doc. No. 476; Page No. 97; Book No. 2; Series of 2006 of the notarial
register of Notary Public Atty. Janette L. Icao in Dumaguete City, which parcel of land is
more particularly described and bounded as follows:

LOT NO. 2399-A, PSD-07-067899

“A parcel of land (Lot No. 2399-a, Psd-07-067899) situated in Buntis,

Bacong, Negros Oriental, Island of Negros. Bounded by Lot No. 2399-B,
Psd-07-067899 along line 1-2; by ______ along line 2-3; by Lot No. 2399-
F, Psd-07-067899 along line 3-4; by Lot No. 2392, Bacong Cadastre, along
line 4-5; by Lot No. 2393, Bacong Cadastre, along lines 5-7; by Lot No.
2394, Bacong Cadastre, along line 7-8; by Lot No. 2396, Bacong Cadastre,
along line 8-9; and by Lot No. 2397, Bacong Cadastre, along line 9-1.
Containing an area of THREE THOUSAND FIVE HUNDRED SEVENTY-
EIGHT (3,578) SQUARE METERS, more or less.”

WITNESSETH FURTHER:

Whereas, ALEJANDRO TINGUHA and his wife Marcela Montargo died intestate
and without debts on _________________ and on ______________, respectively, at
Bacong, Negros Oriental, and at the time of his/their death(s), he/they left his/their
children as his/their only surviving compulsory and forced heir namely JOSEFA TINGUHA
AUSEJO, CATALINO TINGUHA, DOROTEA M. TINGUHA, HERMINIA TINGUHA

SISONA, NOYME TINGUHA VILLA, MAXITO M. TINGUHA, PONCIANA TINGUHA

FERNANDO, FRANCISCO M. TINGUHA, and AMBROCIO M. TINGUHA;

Whereas, DOROTEA M. TINGUHA, single and without issues, died intestate and
without debts on ____________ at Bacong, Negros Oriental, and at the time of her death,
she left her eight (8) siblings as her surviving compulsory and forced heirs;

Whereas, FRANCISCO M. TINGUHA died intestate and without debts on

____________ at Bacong, Negros Oriental, and at the time of his death, he left his wife
and children as his only surviving compulsory and forced heirs, namely CARIDAD M.
TINGUHA, CLARISSA M. TINGUHA, LEVY TINGUHA VILLA, FRANKLIN M. TINGUHA,
TESSIE TINGUHA IRENEA and JANET TINGUHA DAGOY;

Whereas, AMBROCIO M. TINGUHA married to Ananias A. Tinguha died intestate

and without debts on ____________ and on ____________, respectively, at Bacong,
Negros Oriental, and at the time of his/their death(s), he/they left his/their children as
his/their only surviving compulsory and forced heirs, namely EDITHA TINGUHA SIENES,
HERMES TINGUHA, ESCOLASTICO TINGUHA, ERMIE TINGUHA PATAL, LORNA
TINGUHA NAMIAS and FIDEL TINGUHA;

Whereas, HERMES TINGUHA died intestate and without debts on ____________

at Bacong, Negros Oriental, and at the time of his death, he left his wife and son as his
only surviving compulsory and forced heirs, namely EVANGELINE TINGUHA and
HERMES TINGUHA, JR.;

Whereas, invoking Section 1, Rule 74, of the Rules of Court, and the laws on
intestate succession, the herein HEIRS of the above-named deceased person/s, hereby
adjudicate unto themselves, their undivided share to the aforementioned parcels of land,
subject to Section 4, Rule 74, re: The liabilities imposed therein.

FURTHER WITNESSETH:

WHEREAS, it is to the convenience and advantage of the herein HEIRS that the
existing community of ownership of the aforementioned parcels of land, between them be
terminated, and their respective shares and participation determined by mutual
agreement and adjudication;

WHEREAS, for purposes of this partition agreement, the above HEIRS have
mutually and voluntarily agreed to partition and adjudicate between themselves their
common property as above-described and hereto have caused the subdivision of the
aforementioned parcel of land into SEVEN (7) lots;

WITNESSETH FURTHER:

NOW THEREFORE, by virtue of the foregoing circumstances, the HEIRS agree to

partition the above-mentioned parcel of land into SEVEN (7) sub-lots in the following
manner:

1. LOT NO. 2399-A-1, PSD-______________ consisting of FOUR HUNDRED

TWENTY-NINE (429) SQUARE METERS, more or less, to CATALINO M.
TINGUHA;

WITNESSETH FURTHER:

PREMISES CONSIDERED, we hereunto respectfully pray that the Honorable

Register of Deeds of the Province of Negros Oriental, to PARTIALLY cancel Original
Certificate of Title No. 17485 and issue SEVEN (7) separate titles, in favor of the HEIRS
with respect of the preceding paragraph;
